The 2015 British General Election: Capitalism’s One-Horse Race

RINF, Global Research, Countercurrents, Counterpunch

Britain is currently in the grip of a general election campaign. Voting takes place on 7 May and election fever in the media is building as various commentators and politicians engage in empty rhetoric about British values and democratic principles. Due to the nature of the 'first past the post' voting system, the only two parties with a realistic hope of achieving a majority of seats in parliament are Labour and the Conservatives. As in the outgoing parliament, the party most likely to achieve third place, the Liberal Democrats, might hold the balance of power in a hung parliament.

On TV last week there was a ‘leaders’ debate’. The issues debated revolved around the economy, the National Health Service and immigration. Leaders of the three main parties embraced a cosy consensus based on the need to continue with ‘austerity’ but quibbled over the nature or speed of cuts to the public sector and public services. The debate has set the tone for the unfolding campaign.

All three main parties are pro-big business and are aligned with the neoliberal economic agenda set by the financial cartel based in the City of London and on Wall Street and by the major transnational corporations. The likes of Chatham House, Centre for Policy Studies, Foreign Policy Centre, Reform, Institute of Economic Affairs and the International Institute for Strategic Studies (most of which the British public have never heard of) have already determined the pro-corporate and generally pro-Washington policies that the parties will sell to the public. Pressure tactics at the top level of politics, massively funded lobbying groups and the revolving door between private corporations and the machinery of state have also helped shape the policy agenda.

As if to underline this, in 2012 Labour MP Austin Mitchell described the UK’s big four accountancy firms as being "more powerful than government." He said the companies’ financial success allows them privileged access to government policy makers. Of course, similar sentiments concerning 'privileged access' could also be forwarded about many other sectors, not least the arms industry and global agritech companies which armed with their poisons, unsustainable model of industrial agriculture and bogus claims have been working hand in glove with government to force GMO's into the UK despite most people who hold a view on the matter not wanting them.

The impact and power of think tanks, lobbying and cronyism means that the major parties merely provide the illusion of choice and democracy to a public that is easily manipulated courtesy of a toothless and supine corporate media. The knockabout point-scoring of party politics serves as entertainment for a public that is increasingly disillusioned with politics.

The upshot is that the main parties have all accepted economic neoliberalism and the financialisation of the British economy and all that it has entailed: weak or non-existent trade unions, an ideological assault on the public sector, the offshoring of manufacturing, deregulation, privatisation and an economy dominated by financial services.

In Britain, long gone are the relatively well-paid manufacturing jobs that helped build and sustain the economy. In its place, the country has witnessed the imposition of a low taxation regime, low-paid and insecure ‘service sector’ jobs (no-contract work, macjobs, call centre jobs - much of which soon went abroad), a real estate bubble, credit card debt and student debt, which all helped to keep the economy afloat and maintain demand during the so-called boom years under Tony Blair. Levels of public debt spiraled, personal debt became unsustainable and the deregulated financial sector demanded the public must write down its own gambling debts.

The economy is now based on (held to ransom by) a banking and finance-sector cartel that specialises in rigging markets, debt creation, money laundering  and salting away profits in various City of London satellite tax havens and beyond. The banking industry applies huge pressure on governments and has significant influence over policies to ensure things remain this way.

If you follow the election campaign, you will see no talk from the main parties about bringing the railway and energy and water facilities back into public ownership. Instead, privatisation will continue and massive profits will be raked in as the public forks out for private-sector subsidies and the increasingly costly ‘services’ provided.

There will be no talk of nationalising the major banks or even properly regulating or taxing them (and other large multinationals) to gain access to funds that could build decent infrastructure for the public benefit.

Although the economy will be glibly discussed throughout the campaign, little will be mentioned about why or how the top one percent in the UK increased their wealth substantially in 2008 alone when the economic crisis hit. Little will be said about why levels of inequality have sky rocketed over the past three decades.

When manufacturing industry was decimated (along with the union movement) and offshored, people were told that finance was to be the backbone of the ‘new’ economy. And to be sure it has become the backbone. A spineless one based on bubbles, derivatives trading, speculation and all manner of dodgy transactions and practices. Margaret Thatcher in the eighties sold the economy to bankers and transnational corporations and they have never looked back. It was similar in the US.

Now Britain stands shoulder to shoulder with Washington’s militaristic agenda as the US desperately seeks to maintain global hegemony - not by rejecting the financialisation of its economy, rebuilding a manufacturing base with decent jobs and thus boosting consumer demand or ensuring the state takes responsibility for developing infrastructure to improve people's quality of life - but by attacking Russia and China which are doing some of those very things and as a result are rising to challenge the US as the dominant global economic power.

The election campaign instead of focusing on 'austerity', immigrants or welfare recipients, who are depicted by certain politicians and commentators as bleeding the country dry, should concern itself with the tax-evading corporate dole-scrounging super rich, the neoliberal agenda they have forced on people and their pushing for policies that would guarantee further plunder, most notably the Transatlantic Trade and Investment Partnership (TTIP).

However, with a rigged media and all major parties representing the interests of an unaccountable financial-corporate-state elite, we can expect Britain to continue to fall in line behind Washington’s militarism and a further hollowing out of what remains of the economy and civil society.

No matter who wins on 7 May, the public is destined for more of the same. The real outcome of the election has already been decided by the interlocking directorate of think tanks, big business and its lobby groups and the higher echelons of the civil service. The election will be akin to rearranging the deckchairs on a sinking ship.

Greek Government in Talks with Israel to Purchase Surveillance Drones

Timothy Alexander Guzman, Silent Crow News – With growing anger in Greece due to austerity measures, the government under President Karolos Papoulias of the Panhellenic Socialist Movement (PASOK) is in talks with several Israeli firms to purchase surveillance drones to monitor the country’s borders due to an influx of illegal immigration, spy on organized crime syndicates and to prevent terrorist attacks. According to the online news source of www.ekathimerini.com who published a report titled ‘Drones to boost police security effort’ states:

The Public Order Ministry is in talks with Israeli firms regarding the acquisition of unmanned aerial vehicles (UAVs), commonly known as drones, to bolster the efforts of the Greek Police (ELAS) to monitor the country’s borders and curb illegal immigration as well as cracking down on organized crime and domestic terrorism, Kathimerini has learned. It remains unclear how many drones the ministry is seeking to acquire and what type. In any case the aircraft, once acquired, will be able to provide Greek security services with useful data including cell phone signals that could help avert crimes and terrorist attacks

Between 2010 and 2012, protests across Greece including general strikes by unions against the government’s plans to cut public spending and raise taxes across the board through austerity measures. The Greek government agreed with the European Union’s €110 billion bailout plan to solve the 2010-2011 Greek Debt Crises. In May 2011, anti-austerity protests were organized by the ‘Direct Democracy Now movement known as the Indignant Citizens Movement. Major protests began all across Greece, some turned violent. Violence between riot police and protesters erupted when the Greek parliament accepted the EU’s austerity requirements. It was reported that the police used excessive force and used tear gas against protesters. Now, the Greek government wants unmanned aerial vehicles (UAVs), or drones to monitor an increasing dire situation within Greece. According to the report:

According to an extremely well-informed source, Greek authorities first considered the acquisition of such aircraft during the summer of 2011 when the “Indignants” movement of citizens opposed to austerity was growing rapidly with thousands gathering in Syntagma Square day and night. A drone was used to trace several Albanian convicts who escaped from Trikala Prison in central Greece in March last year. It is likely that European Union subsidies will be used for the purchase of the UAVs though it remains unclear what sum has been earmarked for the investment

Greece unemployment is close to 30%, with more than 50% affecting those under 25 years old. The European Union is a colossal failure as Portugal, Italy and Spain continue to suffer from high-unemployment and a mass exodus of its citizens to other countries that might offer economic opportunities. Governments within the EU are concerned that more protests across the region will increase and in many circumstances can turn violent. The rise of extreme right-wing groups is on the increase. According to a the Guardian earlier this year, the leader of the United Kingdom Independence Party Nigel Farage spoke out in the European Parliament when he criticized Greek Prime Minister Antonis Samaras for allowing the EU and IMF to control the Greek economy. The Article titled ‘Nigel Farage becomes popular in Greece after outburst against the PM’ Farage was quoted as saying:

You come here, Mr Samaras, and tell us that you represent the ‘sovereign will of the Greek people’. Well, I am sorry but you are not in charge of Greece, and I suggest you rename and rebrand your party,” railed Farage last week as Samaras, slumped in his seat, looked on haplessly. “It is called New Democracy; I suggest you call it No Democracy because Greece is now under foreign control. You can’t make any decisions, you have been bailed out and you have surrendered democracy, the thing your country invented in the first place

The article also stated:

Reminding Samaras of the heavy price Greece had paid to be rescued from insolvency by creditors at the EU and IMF, he said: “I must congratulate you for getting the Greek presidency off to such a cracking start. Your overnight successful negotiation … will have them dancing in the streets of Athens. “No matter that your country, very poorly advised by Goldman Sachs, joined a currency that it was never suited to. No matter that 30% of its people are unemployed, that 60% of youth are unemployed, that a neo-Nazi party is on the march, that there was a terrorist attack on the German embassy.”

The Greek government’s decision to accept the EU’s recommendations on the economy will increase anger and resentment among the Greek people as the economy continues to worsen.  They are concerned that a civil war can possibly take place.  With the possibility of the Greek government purchasing Israeli made drones, I assume that is what they are expecting.

Real Business Leaders Want to Save Capitalism

A few weeks ago I was visited in my office by the chairman of one of the country’s biggest high-tech firms who wanted to talk about the causes and consequences of widening inequality and the shrinking middle class, and what to do about it.

I asked him why he was concerned. “Because the American middle class is the core of our customer base,” he said. “If they can’t afford our products in the years ahead, we’re in deep trouble.”

I’m hearing the same refrain from a growing number of business leaders.

They see an economic recovery that’s bypassing most Americans. Median hourly and weekly pay dropped over the past year, adjusted for inflation.

Since the depths of the Great Recession in 2009, median real household income has fallen 4.4 percent, according to an analysis by Sentier Research.

These business leaders know the U.S. economy can’t get out of first gear as long as wages are declining. And their own businesses can’t succeed over the long term without a buoyant and growing middle class.

They also recognize a second danger.

Job frustrations are fueling a backlash against trade and immigration. Any hope for immigration reform is now dead in Congress, and further trade-opening agreements are similarly moribund. Yet the economy would be even worse if America secedes into isolationism.

Lloyd Blankfein, CEO of Goldman Sachs, warned recently on “CBS This Morning” that income inequality is “destablilizing” the nation and is “responsible for the divisions in the country.” He went on to say that “too much of the GDP over the last generation has gone to too few of the people.”

Blankfein should know. He pulled in $23 million last year in salary and bonus, a 9.5 percent raise over the year before and his best payday since the Wall Street meltdown. This doesn’t make his point any less valid.

Several of business leaders are suggesting raising the minimum wage and increasing taxes on the wealthy.

Bill Gross, Chairman of Pimco, the largest bond-trading firm in the world, said this week that America needs policies that bring labor and capital back into balance, including a higher minimum wage and higher taxes on the rich.

Gross has noted that developed economies function best when income inequality is minimal.

Several months ago Gross urged his wealthy investors, who benefit the most from a capital-gains tax rate substantially lower than the tax on ordinary income, to support higher taxes on capital gains. “The era of taxing ‘capital’ at lower rates than ‘labor’ should now end,” he stated.

Similar proposals have come from billionaires Warren Buffett and Stanley Druckenmiller, founder of Duquesne Capital Management and one of the top performing hedge fund managers of the past three decades. Buffett has suggested the wealthy pay a minimum tax of 30 percent of their incomes.

The response from the denizens of the right has been predictable: If these gentlemen want to pay more taxes, there’s nothing stopping them.

Which misses the point. These business leaders are arguing for changes in the rules of the game that would make the game fairer for everyone. They acknowledge it’s now dangerously rigged in the favor of people like them.

They know the only way to save capitalism is to make it work for the majority rather than a smaller and smaller minority at the top.

In this respect they resemble the handful of business leaders in the Gilded Age who spearheaded the progressive reforms enacted in the first decade of the twentieth century, or those who joined with Franklin D. Roosevelt to create Social Security, a minimum wage, and the forty-hour workweek during the Depression.

Unfortunately, the voices of these forward-thinking business leaders are being drowned out by backward-lobbying groups like the U.S. Chamber of Commerce that are organized to reflect the views of their lowest common denominator.

And by billionaires like Charles and David Koch, who harbor such deep-seated hatred for government they’re blind to the real dangers capitalism now faces.

Those dangers are a sinking middle class lacking the purchasing power to keep the economy going, and an American public losing faith that the current system will deliver for them and their kids.

America’s real business leaders understand unless or until the middle class regains its footing and its faith, capitalism remains vulnerable.

Kerry at Yale

Kerry at Yale

by Stephen Lendman

On May 18, he returned to his alma mater. He's class of 1966. He was a mediocre student. He barely managed to graduate.

He got four freshman year Ds. His cumulative four-year 76 numerical rating barely avoided failure. Gentlemen C's got him through.

He was Yale's featured Class Day speaker. He addressed graduating students. His mother stressed integrity.

"Integrity, John," she said. His father said "diplomacy was really being able to see the world through the eyes of someone else, to understand their aspirations and assumptions."

Two important lessons Kerry never learned. He's vying for Washington's worst ever Secretary of State dishonor.

He fronts for imperial lawlessness. He's an unindicted war criminal. He represents America's dark side.

He mocks legitimacy. He shames the office he holds. He's mindless of rule of law principles. He's a serial liar. He's a moral coward.

He's deplores peace. He's brazenly hawkish. He's indifferent to human suffering.

He relishes spoils of war. He's what Paul Craig Roberts calls a "two-bit punk." More on what he said below.

In November 1984, he was elected Massachusetts junior senator. He succeeded Paul Tsongas. He stepped down for health reasons.

On January 2, 1985, he took office. For over 29 years, he supported US imperial lawlessness. He was Senate Foreign Relations Committee chairman.

On February 1, 2013, he became America's 68th Secretary of State. Its top diplomat. Its front man for ruthless power.

His style reflects bullying, bluster and Big Lies. His job involves telling other nations who's boss. Explaining Washington rules. Demanding compliance or else.

His estimated net worth exceeds $300 million. He's a billionaire through his wife's wealth. She's heir to the Heinz fortune.

Kerry's Senate voting record was deplorable. He was Israel's man in Washington.

He supported NAFTA, Big Media, welfare reform, Plan Columbia, Authorization for Use of Military Force (AUMF/September 2001), the USA Patriot Act, its 2006 and 2011 reauthorizations, and annual national defense budgets for war.

He endorsed war on terror lawlessness. He backed Bush's imperial aggression. He supported Obama's war on Libya.

He favors ravaging and destroying Syria. He's for targeting Iran next. He's administration Ukraine agenda front man. He supports illegitimate fascist putschist rule.

Earlier he backed Bush's No Child Left Behind scheme to privatize public education.

He endorsed energy policies benefitting Big Oil, Obamacare, reduced food stamp funding, and freedom threatening cybersecurity legislation among other undemocratic measures.

He favors doubling special forces death squads. He wants them deployed globally. He wants their role in America's war on terror enhanced.

He wants greater US military strength. He wants it better able to wage global wars. He wants stepped up intelligence gathering. He favors tougher anti-terrorist policies.

He supports offensive national missile defense. He's against cutting nuclear weapons below START levels.

He's brazenly anti-Russian. He's hostile to Moscow/Beijing ties. He has close Wall Street ties. He and George Bush are Yale grads.

He was president of Yale's Political Union. He belonged to Skull and Bones. So did Bush, his father, and grandfather.

In 1832, it was founded. Throughout most of its history as an all-male secret society. Women were excluded until selectively admitted in the 1990s. Its headquarters building is called the Tomb.

Alumni include former presidents, Supreme Court chief justices, CIA officials, cabinet members, congressmen, senators, business leaders, and other prominent members of society.

Hundreds of living ones remain. S&B is Yale's elitist secret society. Members are carefully vetted.

It's more than a club. Fifteen members are chosen annually. It may be America's most elite network.

Inductees are considered potential future business, government, legal, and other type prominent leaders.

Its alumni have enormous influence. They run America. They've done it for years. Dominant S&B alumni families control it.

They include Bush, Bundy, Harriman, Lord, Phelps, Rockefeller, Carnegie, Ford, Taft, and Whitney, among others. Inter-marriage is encouraged.

One observer calls it "an international mafia - unregulated and all but unknown."

Its agenda reflects New World Order dominance. It wants personal freedoms compromised. Ceremonial silence is sworn.

Bonesmen automatically advance to positions of power. They're expected to serve prominently. Former members financed Hitler. Current ones are fascists. They're neo-Nazis.

Many Bonesmen have close Wall Street ties. At least a dozen are linked to the Fed.

They control America's media, prominent legal institutions, the Council on Foreign Relations, and Trilateral Commission.

Silence is Skull and Bones' golden rule. Bonesmen are sworn to secrecy. They reflect the worst of America's dark side. Kerry is current Exhibit A.

His Class Day address ignored his imperial agenda. It substituted lies for vital truths.

He pretended support for peace, civil rights, popular needs, immigration reform that matters, and environmental sanity.

He ludicrously called what happened after he graduated a "daring journey of progress played out over years, decades, and even generations."

"On the world stage," he said, "you will not escape it…We see huge, growing populations of young people in places that offer little education, little economic or political opportunity."

He fabricated concern for "do(ing) more to coordinate an attack on extreme poverty, provide education, opportunity, and jobs…"

He stressed "refus(ing) to accept the downsizing of America's role in a very complicated world."

He told class of 2014 Yale grads: "Your job is to disturb the universe."

He pretended for better, not worse. He meant furthering US dominance.

Enforcing Washington rules. Targeting outliers for removal. Eliminating major rivals. Waging war on humanity.

He ludicrously claimed "most of the rest of the world doesn’t lie awake at night worrying about America’s presence."

"They worry about what would happen in our absence…(W)hat makes America different from other nations…is that we are united by an uncommon idea…"

"(T)hat we’re all created equal and all endowed with unalienable rights."

"America is not just a country like other countries. America is an idea and we. All of us, you - get to fill it out over time."

"At Yale, we say your degree admits you to all its 'rights and responsibilities.' "

"It means we need to renew that responsibility over and over again every day. It's not a one-time decision."

Kerry urged keeping faith in government. Remain hopeful. Stay active. Find solutions.

Keep "faith with the ability of institutions to do big things when demanded."

It bears repeating. Kerry ignored America's dark side. His lead role. His criminal agenda.

His war on freedom. His hawkishness. Disdaining peace. Supporting wrong over right.

Defending the indefensible. Failing as America's top diplomat. Remaining unaccountable. His policies risk potential global war.

Yale's class of 2014 includes students from 61 countries. Vietnam among others. Ones America ravaged and destroyed.

They know America's dark side best. Likely Kerry's lead imperial role. His support for wealth, power and privilege. His lawlessness.

His deplorable human rights record. His support for wrong over right. His disdain for what matters most.

New grads can make a difference. Doing so requires making right choices.

Hopefully one is being Kerry's worst nightmare. Being opposite his imperial madness.

Being on the right side of history. Wanting societies fit to live in. Supporting peace, equity and justice. Governance of, by and for everyone.

Endorsing right over wrong. Doing it because it matters. Spreading the word.

Urging others to do the same thing. Beating Kerry and like-minded scoundrels at their own dirty game.

John Kerry says Africa has “Natural Resources”, Therefore the US is a “Natural Partner”

Timothy Alexander Guzman, Silent Crow News – US Secretary of State John Kerry declared that the US is interested in Africa’s natural resources. Kerry said that the US and the continent of Africa are “Natural Partners” because of its abundant resources and their “know-how for economic development”. The Associated Press reported what Kerry said to members of the Addis Ababa diplomatic corps and the Young Africa leader network following his visit to Addis Ababa, the capital of Ethiopia. He said:

Africa has the natural resources, capacity and the know-how for economic development, Kerry said, adding that the U.S. is the continent’s “natural partner.” He said that over the next three years, 37 of the 54 African nations will hold national elections with millions of voters going to the polls. And he called on Africans to combat the political corruption that the African Union says has cost the people of Africa tens of billions of dollars

The report said that “U.S. Secretary of State John Kerry highlighted crises in Nigeria, South Sudan, Somalia and the Central African Republic and urged Africans to demand stability and financial development.” Well obviously it does not include a handful of dictatorships Washington has supported over the years including Teodoro Obiang Nguema Mbasogo of Equatorial Guinea in West Africa. He is also known as “the country’s God” according to a report conducted by BBC in 2003. The state-controlled radio program had announced to the public that “He can decide to kill without anyone calling him to account and without going to hell because it is God himself, with whom he is in permanent contact, and who gives him this strength,” a presidential aide announced on the show” according to the report. Obiang is a staunch US ally and Africa’s longest ruling dictator since 1979 after he executed his uncle, Francisco Macías Nguema. Obiang was actually trained in Spain under the fascist leadership of Francisco Franco. Equatorial Guinea’s oil exports and corruption has made the Obiang family one of the wealthiest families on the African continent. In 2008, the US Department of State’s own human rights report stated the following concerning Equatorial Guinea:

limited ability of citizens to change their government; increased reports of unlawful killings by security forces; government-sanctioned kidnappings; systematic torture of prisoners and detainees by security forces; life threatening conditions in prisons and detention facilities; impunity; arbitrary arrest, detention, and incommunicado detention; harassment and deportation of foreign residents with limited due process; judicial corruption and lack of due process; restrictions on the right to privacy; restrictions on freedom of speech and of the press; restrictions on the rights of assembly, association, and movement; government corruption; violence and discrimination against women; suspected trafficking in persons; discrimination against ethnic minorities; and restrictions on labor rights

Equatorial Guinea is an example. It has natural resources and a government that is friendly to Washington and its corporate interests. The speech made by Kerry mentioned countries that lacked security and democratic values for its people as he said that the US was “ready to help increase its ties with Africa, but nations across the continent need to take stronger steps to ensure security and democracy for its people”. He did not mention Equatorial Guinea, Uganda, Rwanda or Ethiopia. All are whom supported by Washington. “And he called on Africans to combat the political corruption that the African Union says has cost the people of Africa tens of billions of dollars” According to the AP report. Kerry also said “That money could build new schools and hospitals, new roads and bridges, new pipes and power lines. That’s why it’s a responsibility for citizens in Africa and in all nations to demand that public money is providing services for all, not lining the pockets of a few” Just like President Teodoro Obiang. It is no secret that Africa has an enormous amount of resources including oil, copper, gold and silver. The United States Africa Command (AFRICOM) is expanding its presence in Africa to counter not only China, but Brazil, India and Russia. According to a document published by AFRICOM during a Senate Armed Services Committee hearing with General David M. Rodriquez on March 6th 2014, confirmed Washington’s strategy concerning Africa:

Africa is increasingly important for our European allies, who are directly affected by the rising economic and political influence of some African countries, as well as the symptoms of instability emanating from other countries. Many European Allies view Africa as the source of their greatest external security threats, including terrorism, illegal immigration, human smuggling and trafficking, and drugs and arms trafficking. Our support to allies in addressing mutual security challenges in Africa may influence their willingness and ability to help shoulder the burden in future conflicts in other areas in the world. The African continents energy and strategic mineral reserves are also of growing significance to China, India, and other countries in the broader Indian Ocean basin. Africa’s increasing importance to allies and emerging powers, including China, India and Brazil, provides opportunities to reinforce U.S. security objectives in other regions through our engagement on the continent. While most African countries prefer to partner with the United States across all sectors, many will partner with any country that can increase their security and prosperity. We should be deliberate in determining where we leave gaps others may fill

Africa is Washington’s next colonial project. Expanding AFRICOM and more drone bases will be the norm. Will Africa’s leadership allow Washington and it European partners (who colonized Africa for centuries) to dominate their continent? That is a hard question to answer, especially when leaders such as Equatorial Guinea’s Obiang who became wealthy at the expense of his people.

Koch Brothers-Style Free Society

Koch Brothers-Style Free Society

by Stephen Lendman

Charles and David Koch are modern-day robber barons. They're multi-billionaires. Forbes estimates their April 2014 net worth at $40.3 billion each.

Charles is Koch Industries (KI) chairman and CEO. David is executive vice president.

They're $6 billion richer this year than last. They make money the old fashioned way. Behind every fortune lies a great crime, said Balzac. Maybe he was thinking of Charles and David.

KI is America's second largest private company. Agribusiness giant Cargill holds top spot. Its estimated 2013 revenues were $136.7 billion.

KI's are an estimated $115 billion. Both companies way outdistance number three ranked Dell. Its estimated 2013 revenues were $56.94 billion.

Heads of these and other industrial giants won't go begging. Koch brothers want lots more billions than already.

Getting them any way possible alone matters. They go all-out for all they can. Charles was quoted earlier saying:

"Most power is power to coerce somebody. We don't have the power to coerce anybody."

Their deep pockets do their coercing for them. They want unfettered market freedom. They each own 42% of KI. They prefer remaining private. Charles once said KI will publicly offer shares "literally over (his) dead body."

KI operates in dozens of countries worldwide. It's in 45 US states. It employs tens of thousands of workers.

Its businesses include manufacturing, energy, oil refining and distribution, chemicals, fiber, intermediates and polymers, minerals, fertilizers, pulp and paper, chemical technology equipment, ranching, finance, commodities trading, plus other ventures and investments.

Both brothers buy influence. They finance radical right interests to get it. They bankroll neocon political action groups, think tanks, and ideologically over-the-top politicians.

They advance extremist limited government notions. They favor business friendly anti-populist policies.

They abhor regulations. They want freedom to swindle, cheat and grab all they can.

They want state enterprises sold at fire sale prices. They want first dibs to buy them. They want minimal corporate taxes. Ideally they none at all.

They want their personal tax obligation shrunk to as little as possible. They want ordinary people forced to pay more so they can pay less.

They want social justice eliminated entirely. They want trade unionism weakened. Ideally they want it gone.

They oppose universal healthcare, financial fairness, public education, and environmental sanity. They love job-killing trade deals.

They'll benefit hugely from Keystone XL's pipeline's completion. According to a report released last October, it represents a potential $100 billion windfall.

KI and both brothers separately own two million acres of Alberta, Canada land. It's where Keystone XL's proposed route begins.

KI subsidiaries benefit from pipeline construction. Tar sands oil development is on Koch Exploration Canada land. Koch Supply and Trading benefits from oil derivatives activities.

KI donated millions lobbying for Keystone XL's construction. Supportive think tanks and congressional members are beneficiaries.

Charles and David's influence is pernicious and then some. They want unfettered freedom replacing civil society restraints. They want information about their activities suppressed.

They want unchallenged control. They want nothing interfering with generating maximum revenues.

They donate millions annually to right wing causes. On March 27, the Center for Public Integrity (CPI) headlined "Inside the Koch brothers' campus crusade."

It spans America. It philosophizes about the "moral imperatives of free markets and individual liberty."

It's proselytizing goes way beyond Capitol Hill. It focuses on winning hearts and minds of college students.

It manipulates their minds destructively. It does so at 163 colleges and universities. They're in 41 states and the District of Columbia. Many are left of center. Some have liberal faculty members.

Koch Brothers want students turned against them. They want their vision taught in classrooms. They claim otherwise. So do recipient schools.

Funds aren't donated strings-free. Agenda politics comes with them.

Americans for Prosperity (AFP) advocates entrepreneurship freedom. It abhors regulatory restraint. It wants minimal taxes.

It wants "encroachment of government in the economic lives of citizens" halted. It wants nothing restricting what business wants to do.

It fronts for Koch Industries. In 2004, David Koch and KI board member Richard Fink were co-founders. AFP targets progressive initiatives. Millions are spent doing it. Funding surges in election years.

AFP's agenda is corporatist, soulless, anti-labor, anti-eco-sanity, and anti-fairness. It's against consumer protections. It abhors populism. It wants corporate crooks kept free from prosecution.

It's pro-business, pro-war, pro-privilege, pro-super-wealth, anti-dissent, anti-democracy, anti-civil and human rights, and anti-government of, by and for everyone equitably and fairly.

Charles Lewis serves as American University School of Community Investigative Reporting Workshop's executive director. Earlier he founded CPI.

"The Kochs are on a whole different level," he said earlier. There's no one else who has spent this much money."

"The sheer dimension of it is what sets them apart. They have a pattern of lawbreaking, political manipulation, and obfuscation."

"I've been in Washington since Watergate, and I've never seen anything like it. They are the Standard Oil of our times."

Their lobbying expenses rank among America's highest. They go all-out to have their interests served.

Ideally they want their message alone getting out. They pressure employees to support candidates they endorse.

They warn them about dire consequences otherwise. Their jobs are on the line. They'll pay for disobedience.

What Charles and David say goes. They represent dual noxious influences. They're more dangerous than corrupt politicians in positions of power.

They wield their own irresponsibly. Super-wealth lets them do what they want. They take full advantage.

For every dollar spent, they expect huge returns. They take no prisoners. They're all take and no give.

They oppose labeling carcinogens found in their products. They want them freely used.

They're mindless about potential harm to millions. Profits alone matter. People are expendable. Their welfare is unimportant. Business priorities count most of all.

Tony Carrk is Center for American Progress Health Care War Room director. In April 2011, he headlined "The Koch Brothers: What You Need to Know About the Financiers of the Radical Right," saying:

"Any attempt to understand the modern conservative movement will eventually lead to billionaire brothers Charles and David Koch."

"Using their vast wealth and connections, the Koch brothers are key players in bankrolling right-wing political action groups, think tanks, and individual politicians, using this array of political power to advance their ideological agenda of limited government and less regulation."

"Chances are they are part of any recent right-wing attack you have seen lately."

Charles and David use their vast wealth, business empire, and "political network to pursue their right-wing agenda at nearly every level of government. "

"Whether they are contributing millions in campaign contributions, spending millions on lobbying, or investing millions in right-wing think tank and advocacy groups, the Koch brothers’ influence is pervasive."

Their extreme right wing agenda benefits them at the expense of popular interests. They want them eliminated altogether.

They want unfettered freedom to invest, speculate, trade and accumulate maximum wealth unrestrained. They want nothing interfering in their right to do so.

Anti-government fervor was a Koch brothers opportunity. They helped organize and fund Tea Party protesters. They turned their private agenda into a mass movement.

They took full advantage shaping and controlling an anti-big government uprising. They turned it into serving their personal interests.

They got millions of ordinary people to support what harms their own welfare. They got supportive right-wing media help.

Talk show hosts, commentators, and other media figures joined the movement. The New York Times earlier called it "a diffuse American grassroots group that taps into anti-government sentiment."

It's well-organized. It's controlled top down. It's a combination of loosely affiliated organizations. They're ideologically anti-big government, anti-spending, anti-immigration, and anti-compromise.

They're organized, funded and controlled by right-wing corporate lobbying groups. They're manipulated to support business interests.

Companies like KI benefit enormously. It denies involvement disingenuously. Its communications director said earlier:

"Koch companies value free speech and believe it is good to have more Americans engaged in key policy issues."

"(N)o funding has been provided by Koch companies, the Koch foundations, Charles Koch or David Koch specifically to support the tea parties."

Their activities declined significantly since 2010. According to Professor Theda Skocpol, chapters dropped from about 1,000 to 600.

It's still a "very good survival rate," she said. Most groups shifted from national to local issues.

Doing so affected their visibility. Chapters place more emphasis on getting preferred candidates elected than pubic events.

Involvement in 2012 Republican presidential primaries was minimal. Perhaps lack of enthusiasm for unimpressive candidates was responsible.

After Mitt Romney chose Paul Ryan as his running mate, The New York Times called Tea Party lawmakers "indisputably at the core of the modern Republican Party."

Koch brothers influence is very much involved. They bankroll Tea Party candidates. They do so with company and personal contributions.

They're a pernicious influence on US politics. What benefits them harms most others.

They're not going away. Their financial clout hugely influences US policies. Americans get the best democracy money can buy.

A Final Comment

Wall Street Journal editors gave Charles Koch feature op-ed space. On April 2, he headlined "I'm Fighting to Restore a Free Society."

What he has in mind isn't fit to live in. He lied claiming his vision would "create greater well-being and opportunity for all Americans."

He means super-rich ones like himself at the expense of all others. He claims to oppose big government.

He wants federal, state and local politicians as well as bureaucrats benefitting him. He wants government resources helping his interests.

He wants social America destroyed. He ludicrously claimed he's not "trying to rig the system."

Millions spent lobbying buy influence. They're not used for good will. They're investments. Effective ones reap huge returns.

They go right to KI's bottom line. They fill Charles and David's pockets. They come out of ours.

His notion of "liberty" is more for him and less for us. Everyone should embrace his "vision," he urges.

America already is unfit to live in. Imagine one run his way. Orwell put it this way:

"If you want a vision of the future, imagine a boot stamping on a human face - forever."

Duplicitous Obama Civil Rights Hyperbole

Duplicitous Obama Civil Rights Hyperbole

by Stephen Lendman

Obama represents the worst of rogue governance. On April 10, he honored Lyndon Johnson. One war criminal paid tribute to another.

He spoke at his Austin-based Presidential Library and Museum. He did so commemorating the 50th anniversary of the 1964 Civil Rights Act.

His words rang hollow. The New York Times called his speech "stirr(ing)." It stopped short of denouncing his duplicity. More on what he said below.

America's human and civil rights record is by far the world's worst. No other nation matches its lawlessness. None approach it.

It's by far the world's most unprincipled. It's responsible for virtually every crime imaginable and then some.

It's police state than democracy. It's more battleground than homeland.

Lawless FBI, CIA, NSA, FEMA, Immigration and Customs Enforcement (ICE), Border Patrol, and other federal operatives work jointly with state and local authorities.

They target fundamental freedoms. They harm their own people.

Anyone can be arrested, charged, prosecuted, and imprisoned for any reason or none at all. US citizens at home or abroad can be murdered. Obama can order them killed by presidential diktat.

Others can be arrested and detained. They can be held indefinitely. They can be thrown into military dungeons. They can be denied civil justice. They can be held uncharged.

Innocence is no defense. State terrorism is official policy at home and abroad. Police states operate this way. America is by far the world's worst.

Freedom, human rights, and other democratic values don't matter. Supporting right over wrong is hazardous.

Challenging Washington's right to dominate globally risks persecution or death. America is unfit to live in. Things go from bad to worse.

Obama exceeds the worst of his predecessors. Rogue governance defines his agenda. Humanity may not survive on his watch.

On July 2, 1964, Lyndon Johnson signed the Civil Rights Act into law. Officially it's called:

"An act to enforce the constitutional right to vote, to confer jurisdiction upon the district courts of the United States of America to provide injunctive relief against discrimination in public accommodations, to authorize the Attorney General to institute suits to protect constitutional rights in public facilities and public education, to extend the Commission on Civil Rights, to prevent discrimination in federally assisted programs, to establish a Commission on Equal Employment Opportunity, and for other purposes."

It was more feel good than do good. Objectives fell short of promise. They were more hype than reality. They weren't achieved. Things today are worse than ever in modern times.

On June 11, 1963, Jack Kennedy called for legislation "giving all Americans the right to be served in facilities which are open to the public…"

He included "hotels, restaurants, theaters, retail stores, and similar establishments." He urged "greater protection for the right to vote."

Segregationists kept legislation from being enacted. Bottling it up in committee works as intended.

Kennedy's November 22, 1963 assassination changed things. Johnson was a former Senate Majority Leader. He was a powerful mover and shaker.

He wielded bully pulpit power as president. He supported civil and voting rights legislation. On November 27, 1963, he told Congress:

"No memorial oration or eulogy could more eloquently honor President Kennedy's memory than the earliest possible passage of the civil rights bill for which he fought so long."

Enactment of legislation he sought followed. Designed to prohibit discrimination based on race, color, religion, sex, or national origin fell woefully short.

Powers enacted were weak. They remain so. Equal protection under law is more fantasy than real. It's a figure of speech.

Millions of persons of color bear witness. Muslims in America at the wrong time know the sting of US injustice. They're persecuted for praying to the wrong God. Constitutional protections don't help.

Johnson's July 2, 1964 statement rang hollow. He called signing the Civil Rights act a "proud triumph."

"Americans of every race and color have died in battle to protect our freedom," he said.

They died for imperial lawlessness. More than ever today. Johnson didn't explain. Nor presidents following him.

"Americans of every race and color have worked to build a nation of widening opportunities," he said. For America's rich, well-born and able alone.

"Now our generation of Americans has been called on to continue the unending search for justice within our own borders," he added.

It's selectively given. America has the best democracy money can buy.

"We believe that all men are created equal," said Johnson. "Yet many are denied equal treatment."

The vast majority do today. A select few benefit. They do so at the expense of all others.

"We believe that all men have certain unalienable rights," said Johnson.

"Yet many Americans do not enjoy those rights." Overwhelming numbers enjoy few today.

Freedom is an endangered species. It's disappearing in plain sight. Tyranny is on a fast track toward replacing it. International, constitutional and US statute laws don't matter.

Democracy is pure fantasy. A year after civil rights legislation passed, the Voting Rights Act followed. On August 6, 1965, Johnson signed it into law.

It nominally supports 15th Amendment protections. They prohibit federal or state governments from denying citizens voting rights based on "race, color, or previous condition of servitude."

On February 3, 1870, it was ratified. Fulfillment didn't follow promise. Nor from the 1965 Voting Rights Act.

US voting rights were constitutionally flawed by design. America's founders enfranchised adult white male property owners only.

Laborers were excluded. So were women. They were considered homemakers and child-bearers alone. Slaves were called property, not people.

Native Americans, free Black men, apprentices, felons, and persons considered incompetent were denied.

From inception to today, US elections were never open, free and fair. Big money controls them. Electoral fraud is rife.

Things are pre-scripted. Voters have no say. Secrecy and back-room deals substitute for a free, fair and open process.

Candidates are pre-selected. Monied interests own them. Key outcomes are predetermined. America is a one-party state.

Republicans and Democrats are two sides of the same coin. Not a dime's worth of difference separates them.

Independent candidates are shut out. Media scoundrels ignore them.

Issues mattering most are unaddressed. Horse race journalism and trivia substitute.

Millions of Americans are disenfranchised. Criminal records alone exclude many. Effort to suppress minority voters are rife.

Half of eligible voters opt out. They do so because interests they most care about go unaddressed.

Because candidates from either party don't care. Because corporate-controlled touchscreen electronic voting machines are rigged.

They're programmed using secret software. They're easy to manipulate. They steal elections.

They provide no receipts. Excluding them prevents vetting. Opponents end up with voter choices. Losers are declared winners.

Partisan politics serves privileged elites. Democracy is pure illusion. It's a figure of speech. It bears repeating. Americans get the best one money can buy.

Supreme Court rulings affirmed it. One dollar = one vote. Deep pockets cast many. It's the American way. It shams the right way.

Commemorating civil rights legislation ignores today's deplorable conditions. Duplicitous Obama rhetoric highlighted the disgraceful state of the nation. He called expressing them "a singular honor."

Doors "swung open for" him, he said. "That's why I'm standing here today," he added.

"…I have lived out the promise of LBJ's efforts." He spoke at the end of a three-day summit. It commemorated civil rights law. Carter, Clinton and GW Bush spoke earlier.

None connect to popular struggles. Jim Crow never touched their lives. Human and civil rights eroded on their watch.

So did other fundamental freedoms. They did nothing to prevent it. They support wealth, power and privilege. Ordinary people don't count. People of color least of all.

Clinton signed the repressive 1996 Anti-Terrorism and Effective Death Penalty Act (AEDPA) into law. It violates constitutional protections.

It compromises habeas rights. It limits judicial relief. It assured more capital punishment for innocent victims.

Nearly always, people of color, Muslims, or others among society's most disadvantaged are affected.

Clinton lied calling AEDPA "an important step forward in the federal government's continuing efforts to combat terrorism."

Its enactment had nothing whatsoever to do with it. International or homegrown terrorism is a ruse.

Clinton said he requested legislation after Oklahoma City. On April 19, 1995, a massive explosion destroyed its downtown Murrah Federal Building.

It killed 168 people. Hundreds more were injured. A 16-block area was affected. Over 300 buildings were destroyed or damaged.

Elgin Air Force Base's Armament Wright Laboratory studied the incident. No single truck bomb caused it.

Former director/explosives and ordnance expert/(Ret.) Brig. General Benton K. Partin was in charge. His report was damning. In part it said:

"Indeed, a careful examination of photographs showing the collapsed column bases reveal a failure mode produced by (internally installed) demolition charges and not by a blast from (a) truck bomb" as claimed.

Additional forensic evidence showed other devices were involved. Official reports suppressed what happened.

Lies substituted for truth. It's longstanding US practice. So-called terror plots are state-sponsored. 9/11 is Exhibit A.

Bush administration police state laws followed. Civil and human rights were targeted. They were eviscerated.

Patriot Act legislation alone gutted Fifth and 14th Amendment due process rights.

First Amendment ones eroded. Anyone can be wrongfully accused. Prosecutions can claim membership in, association with or support for so-called "undesirable groups."

Fourth Amendment protections against illegal searches and seizures no longer exist. Unchecked surveillance was authorized.

Powers include accessing personal financial, medical and other records. So-called "sneak and peak" searchers are OK.

"Delayed notice" warrants were approved. Warrantless searches became standard practice.

So were roving wiretaps, email and text message tracking, as well as Internet and telecommunications monitoring.

Prosecutions include secret evidence withheld from defense counsel. It's officially OK. It's common police state practice.

Guilt by accusation follows. For the first time, so-called "domestic terrorism" became a federal crime.

Virtually none exists. Numerous innocent victims were charged. They languish unjustly in America's gulag. Hundreds, perhaps thousands, of other political prisoners do so.

Patriot Act legislation began things. Other harsh measures followed. Homeland Security is America's Gestapo.

It operates ruthlessly. It does so extrajudicially. It targets innocent victims. It lies calling them terrorists.

Military commission legislation gutted civil protections. It grants extraordinary power to detain, interrogate, and prosecute alleged terrorists extrajudicially.

It legalized torture. Bush made it official US policy. It continues under Obama. He exceeded the worst of all his predecessors.

He presides over a repressive police state apparatus. Big Brother watches everyone. Mass surveillance is official US policy.

Fake war on terror persists. Rule of law principles don't matter. Nor democratic values. Human and civil liberty violations are rife.

Administration policies are the most secretive in US history. Whistleblowers are ruthlessly targeted. Exposing government lawlessness was criminalized.

So is protesting for fundamental constitutional rights. Tyranny is official US policy. Executive diktats can declare martial law.

Constitutional law can be suspended. It can be abolished altogether. Federal troops can be deployed against ordinary people.

Peaceful protests are endangered. National Defense Authorization Act (NDAA) legislation authorized indefinite detentions.

Anyone can be held without charge or trial. Solely based on suspicions, baseless allegations or none at all is OK.

Presidents have unchecked authority to arrest, interrogate and indefinitely detain law-abiding citizens. They can target anyone they wish. They can do it extrajudicially.

No one is safe. Due process, civil protections, and judicial fairness don't apply. Abuse of power replaced them. Obama endorses them.

He mocks legitimacy. He governs lawlessly. His duplicitous civil right rhetoric rings hollow. His agenda bears witness to his lies.

'No one knew politics and no one loved legislating more than President Johnson," he said .

"He was charming when he needed to be, ruthless when required."

"Those of us who've had the singular privilege to hold the office of the presidency know well that progress in this country can be hard and it can be slow, frustrating. And sometimes you're stymied."

"You're reminded daily that in this great democracy, you are but a relay swimmer in the currents of history, bound by decisions of those who came before, reliant on the efforts of those who will follow to fully vindicate your vision."

"But the presidency also affords a unique opportunity to bend those currents by shaping our laws and by shaping our debates, by working within the confines of the world as it is, but also by reimagining the world as it should be."

Obama's demagoguery wore thin long ago. Duplicity substitutes for truth. His deplorable record speaks for itself. He's a world class con man.

He's a war criminal multiple times over. He's a serial liar. He's a moral coward. Throughout is tenure, he waged war on freedom.

He's gone all-out to destroy it altogether. He deplores equity and justice for all. He's beholden solely to monied interests.

He supports wealth, power and privilege. He's mindless of popular needs. He trashed human and civil rights throughout his tenure.

He represents the worst of rogue governance. His agenda is state terrorism writ large. His worst crimes go unpunished.

He's got nearly three more years left in office. Humanity may not survive his onslaught.

3. The Committee notes with appreciation the many efforts undertaken, and the progress made in protecting civil and political rights by the State party. The Committee welcomes, in particular, the following legislative and institutional steps taken by the State party:
(a) The full implementation of article 6(5) of the Covenant in the aftermath of the Supreme Court’s judgment in Roper v. Simmons, 543 U.S. 551 (2005), despite the State party’s reservation to the contrary;
(b) The recognition by the Supreme Court in Boumediene v. Bush, 553 U.S. 723 (2008), of the extraterritorial application of constitutional habeas corpus rights to aliens detained at Guantánamo Bay;
(c) The Presidential Executive Orders 13491 (“Ensuring Lawful Interrogations”), 13492 (“Review and Disposition of Individuals Detained at the Guantanamo Bay Naval Base and Closure of Detention Facilities”) and 13493 (“Review of Detention Policy Options”), issued on 22 January 2009;
(d) The support for the U.N. Declaration on the Rights of Indigenous Peoples announced by President Obama on 16 December 2010;
(e) The Presidential Executive Order 13567 establishing periodic review for detainees at the Guantanamo Bay detention facility who have not been charged, convicted, or designated for transfer, issued on 7 March 2011.
C. Principal matters of concern and recommendations
Applicability of the Covenant at national level
4. The Committee regrets that the State party continues to maintain its position that the Covenant does not apply with respect to individuals under its jurisdiction but outside its territory, despite the contrary interpretation of article 2(1) supported by the Committee’s established jurisprudence, the jurisprudence of the International Court of Justice and state practice. The Committee further notes that the State party has only limited avenues to ensure that state and local governments respect and implement the Covenant, and that its provisions have been declared to be non-self-executing at the time of ratification. Taken together, these elements considerably limit the legal reach and the practical relevance of the Covenant (art. 2).
The State party should:
(a) Interpret the Covenant in good faith, in accordance with the ordinary meaning to be given to its terms in their context, including subsequent practice, and in the light of its object and purpose and review its legal position so as to acknowledge the extraterritorial application of the Covenant under certain circumstances, as outlined inter alia in the Committee’s general comment No. 31 (2004) on the nature of the general legal obligation imposed on States parties to the Covenant;
(b) Engage with stakeholders at all levels to identify ways to give greater effect to the Covenant at federal, state and local levels, taking into account that the obligations under the Covenant are binding on the State party as a whole, and that all branches of government, and other public or governmental authorities, at every level are in a position to engage the responsibility of the State party under the Covenant (General Comment. No. 31, para. 4);
(c) Taking into account its declaration that provisions of the Covenant are non-self-executing, ensure that effective remedies are available for violations of the Covenant, including those that do not, at the same time, constitute violations of U.S. domestic law, and undertake a review of such areas with a view to proposing to the Congress implementing legislation to fill any legislative gaps. The State party should also consider acceding to the Optional Protocol to the Covenant providing for an individual communication procedure.
(d) Strengthen and expand existing mechanisms mandated to monitor the implementation of human rights at federal, state, local and tribal levels, provide them with adequate human and financial resources or consider establishing an independent national human rights institution, in accordance with the principles relating to the status of national institutions for the promotion and protection of human rights (Paris Principles) (General Assembly resolution 48/134).
(e) Reconsider its position regarding its reservations and declarations to the Covenant with a view to withdrawing them.
Accountability for past human rights violations
5. The Committee is concerned at the limited number of investigations, prosecutions and convictions of members of the Armed Forces and other agents of the U.S. Government, including private contractors, for unlawful killings in its international operations and the use of torture or cruel, inhuman or degrading treatment or punishment of detainees in U.S. custody, including outside its territory, as part of the so-called “enhanced interrogation techniques” program. While welcoming the Presidential Executive Order 13491 of 22 January 2009 terminating the programme of secret detention and interrogation operated by the Central Intelligence Agency (CIA), the Committee notes with concern that all reported investigations into enforced disappearances, torture and other cruel, inhuman or degrading treatment that had been committed in the context of the CIA secret rendition, interrogation and detention programmes were closed in 2012 leading only to a meagre number of criminal charges brought against low-level operatives. The Committee is concerned that many details of the CIA programme remain secret thereby creating barriers to accountability and redress for victims (arts. 2, 6, 7, 9, 10, and 14).
The State party should ensure that all cases of unlawful killing, torture or other ill-treatment, unlawful detention, or enforced disappearance are effectively, independently and impartially investigated, that perpetrators, including, in particular, persons in command positions, are prosecuted and sanctioned, and that victims are provided with effective remedies. The responsibility of those who provided legal pretexts for manifestly illegal behavior should also be established. The State party should also consider the full incorporation of the doctrine of ‘command responsibility’ in its criminal law and declassify and make public the report of the Senate Special Committee on Intelligence into the CIA secret detention programme.
Racial disparities in the criminal justice system
6. While appreciating the steps taken by the State party to address racial disparities in the criminal justice system, including the enactment in August 2010 of The Fair Sentencing Act and plans to work on reform of mandatory minimum sentencing statutes, the Committee continues to be concerned about racial disparities at different stages in the criminal justice system, sentencing disparities and the overrepresentation of individuals belonging to racial and ethnic minorities in prisons and jails (arts. 2, 9, 14, and 26).
The State party should continue and step up its efforts to robustly address racial disparities in the criminal justice system, including by amending regulations and policies leading to racially disparate impact at the federal, state and local levels. The State party should ensure the retroactive application of the Fair Sentencing Act and reform mandatory minimum sentencing statutes.
Racial profiling
7. While welcoming plans to reform the “stop and frisk” program in New York City, the Committee remains concerned about the practice of racial profiling and surveillance by law enforcement officials targeting certain ethnic minorities, and the surveillance of Muslims undertaken by the Federal Bureau of Investigation (FBI) and the New York Police Department (NYPD) in the absence of any suspicion of wrongdoing (arts. 2, 9, 12, 17, and 26).
The State party should continue and step up its measures to effectively combat and eliminate racial profiling by federal, state and local law enforcement officials, inter alia by: (a) pursuing the review of the 2003 Guidance Regarding the Use of Race by Federal Law Enforcement Agencies and expanding protection against profiling on the basis of religion, religious appearance or national origin; (b) continuing to train state and local law enforcement personnel on cultural awareness and inadmissibility of racial profiling; and (c) abolishing all “stop and frisk” practices.
Death penalty
8. While welcoming the overall decline in the number of executions and the increasing number of states that have abolished the death penalty, the Committee remains concerned about the continuing use of the death penalty and, in particular, racial disparities in its imposition that affects disproportionately African Americans, exacerbated by the rule that discrimination has to be proven case-by-case. It is further concerned by the high number of persons wrongly sentenced to death, despite existing safeguards, and by the fact that 16 retentionist states do not provide for compensation for the wrongfully convicted and other states provide for insufficient compensation. Finally, the Committee notes with concern reports about the administration by some states of untested lethal drugs to execute prisoners and the withholding of information on such drugs (arts. 2, 6, 7, 9, 14, and 26).
The State party should (a) take measures to effectively ensure that the death penalty is not imposed as a result of racial bias; (b) strengthen safeguards against wrongful sentencing to death and subsequent wrongful execution by ensuring inter alia effective legal representation for defendants in death penalty cases, including at the post-conviction stage; (c) ensure that retentionist states provide adequate compensation for the wrongfully convicted (d) ensure that lethal drugs for executions originate from legal, regulated sources, and are approved by the U.S. Food and Drug Administration (FDA) and that information on the origin and composition of such drugs is made available to individuals scheduled for execution; (e) consider establishing a moratorium on the death penalty at the federal level and engage with retentionist states with a view to achieving a nationwide moratorium. The Committee also encourages the State party, on the 25th anniversary of the Second Optional Protocol to the Covenant aiming at the abolition of the death penalty, to consider acceding to the Protocol.
Targeted killings using unmanned aerial vehicles (drones)
9. The Committee is concerned about the State party’s practice of targeted killings in extraterritorial counter-terrorism operations using unmanned aerial vehicles (UAV) also known as ‘drones’, the lack of transparency regarding the criteria for drone strikes, including the legal justification for specific attacks, and the lack of accountability for the loss of life resulting from such attacks. The Committee notes the State party’s position that drone strikes are conducted in the course of its armed conflict with Al- Qaida, the Taliban, and associated forces and in accordance with its inherent right of national self-defense and are governed by international humanitarian law, as well as by the Presidential Policy Guidance that sets out standards for the use of lethal force outside areas of active hostilities. Nevertheless, the Committee remains concerned about the State party’s very broad approach to the definition and the geographical scope of an armed conflict, including the end of hostilities, the unclear interpretation of what constitutes an “imminent threat” and who is a combatant or civilian taking a direct part in hostilities, the unclear position on the nexus that should exist between any particular use of lethal force and any specific theatre of hostilities, as well as the precautionary measures taken to avoid civilian casualties in practice (arts. 2, 6, and 14).
The State party should revisit its position regarding legal justifications for the use of deadly force through drone attacks. It should: (a) ensure that any use of armed drones complies fully with its obligations under article 6 of the Covenant, including in particular with respect to the principles of precaution, distinction and proportionality in the context of an armed conflict; (b) subject to operational security, disclose the criteria for drone strikes, including the legal basis for specific attacks, the process of target identification and the circumstances in which drones are used; (c) provide for independent supervision and oversight over the specific implementation of regulations governing the use of drone strikes; (d) in armed conflict situations, take all feasible measures to ensure the protection of civilians in specific drone attacks and to track and assess civilian casualties, as well as all necessary precautionary measures in order to avoid such casualties; (e) conduct independent, impartial, prompt and effective investigations of allegations of violations of the right to life and bring to justice those responsible; (f) provide victims or their families with an effective remedy where there has been a violation, including adequate compensation, and establish accountability mechanisms for victims of allegedly unlawful drone attacks who are not compensated by their home governments.
Gun violence
10. While acknowledging the measures taken to reduce gun violence, the Committee remains concerned about the continuing high numbers of gun-related deaths and injuries and the disparate impact of gun violence on minorities, women and children. While commending the U.S. Commission on Civil Rights’ investigation of the discriminatory effect of “Stand Your Ground Laws”, the Committee is concerned about the proliferation of such laws that are used to circumvent the limits of legitimate self-defence in violation of the State party’s duty to protect life (arts. 2, 6, and 26).
The State Party should take all necessary measures to abide by its obligation to effectively protect the right to life. In particular, it should: (a) continue its efforts to effectively curb gun violence, including through the continued pursuit of legislation requiring background checks for all private firearm transfers in order to prevent possession of arms by persons recognized as prohibited individuals under federal law and strict enforcement of the Domestic Violence Offender Gun Ban legislation of 1996 (the “Lautenberg Amendment”); and (b) review Stand Your Ground Laws to remove far-reaching immunity and ensure strict adherence to the principles of necessity and proportionality when using deadly force in self-defence.
Excessive use of force by law enforcement officials
11. The Committee is concerned about the still high number of fatal shootings by certain police forces, including, for instance, in Chicago, and reports of excessive use of force by certain law enforcement officers including the deadly use of tasers, which have a disparate impact on African Americans, and use of lethal force by Customs and Border Protection (CBP) officers at the U.S.-Mexico border (arts. 2, 6, 7, and 26).
The State Party should  (a) step up its efforts to prevent the excessive use of force by law enforcement officers by ensuring compliance with the 1990 UN Basic Principles on the Use of Force and Firearms by Law Enforcement Officers; (b) ensure that the new CBP directive on use of deadly force is applied and enforced in practice; and (c) improve reporting of excessive use of force violations and ensure that reported cases of excessive use of force are effectively investigated, alleged perpetrators are prosecuted and, if convicted, punished with appropriate sanctions, that investigations are re-opened when new evidence becomes available, and that victims or their families are provided with adequate compensation.
Legislation prohibiting torture
12. While noting that acts of torture may be prosecuted in a variety of ways at both the federal and state levels, the Committee is concerned about the lack of comprehensive legislation criminalizing all forms of torture, including mental torture, committed within the territory of the State party. The Committee is also concerned about the inability of torture victims to claim compensation from the State party and its officials due to the application of broad doctrines of legal privilege and immunity (arts. 2 and 7).
The State party should enact legislation to explicitly prohibit torture, including mental torture, wherever committed and ensure that the law provides for penalties commensurate with the gravity of such acts, whether committed by public officials or other persons acting on behalf of the State, or by private persons. The State party should ensure the availability of compensation to victims of torture.
Non-refoulement
13. While noting the measures taken to ensure compliance with the principle of non-refoulement in cases of extradition, expulsion, return and transfer of individuals to other countries, the Committee is concerned about the State party’s reliance on diplomatic assurances that do not provide sufficient safeguards. It is also concerned at the State party’s position that the principle of non-refoulement is not covered by the Covenant despite the Committee’s established jurisprudence and subsequent state practice (arts. 6 and 7).
The State party should strictly apply the absolute prohibition against refoulement under articles 6 and 7 of the Covenant, continue exercising the utmost care in evaluating diplomatic assurances, and refrain from relying on such assurances where it is not in a position to effectively monitor the treatment of such persons after their extradition, expulsion, transfer or return to other countries and take appropriate remedial action when assurances are not fulfilled.
Trafficking and forced labour
14. While acknowledging the measures taken by the State party to address the issue of trafficking in persons and forced labour, the Committee remains concerned about cases of trafficking for purposes of labour and sexual exploitation, including of children, and criminalization of victims on prostitution-related charges. It is concerned about the insufficient identification and investigation of cases of trafficking for labour purposes and notes with concern that certain categories of workers, such as farm workers and domestic workers, are explicitly excluded from the protection of labour laws, thus rendering these categories of workers more vulnerable to trafficking. The Committee is also concerned that workers entering the U.S. under the H-2B work visa programme are also at a high risk of becoming victims of trafficking/forced labour (arts. 2, 8, 9, 14, 24, and 26).
The State party should continue its efforts to combat trafficking in persons, inter alia by strengthening its preventive measures, increasing victim identification and systematically and vigorously investigating allegations of trafficking in persons, prosecuting and punishing those responsible and providing effective remedies to victims, including protection, rehabilitation and compensation. It should take all appropriate measures to prevent the criminalization of victims of sex trafficking, including child victims, to the extent that they have been compelled to engage in unlawful activities. The State party should review its laws and regulations to ensure full protection against forced labour for all categories of workers and ensure effective oversight of labour conditions in any temporary visa program. It should also reinforce its training activities and provide training to law enforcement and border and immigration officials, as well as to other relevant agencies such as labour law enforcement agencies and child welfare agencies.
Immigrants
15. The Committee is concerned that under certain circumstances mandatory detention of immigrants for prolonged periods of time without regard to the individual case may raise issues under article 9 of the Covenant. It is also concerned about the mandatory nature of the deportation of foreigners without regard to elements such as the seriousness of crimes and misdemeanors committed, the length of lawful stay in the U.S., health status, family ties and the fate of spouses and children staying behind, or the humanitarian situation in the country of destination. Finally, the Committee expresses concerns about the exclusion of millions of undocumented immigrants and their children from coverage under the Affordable Care Act and the limited coverage of undocumented immigrants and immigrants residing lawfully in the U.S. for less than five years by Medicare and Children Health Insurance, all resulting in difficulties in access of immigrants to adequate health care (arts. 7, 9, 13, 17, 24 and 26).
The Committee recommends to the State party to review its policies of mandatory detention and deportation of certain categories of immigrants in order to allow for individualized decisions, to take measures ensuring that affected persons have access to legal representation, and to identify ways to facilitate access of undocumented immigrants and immigrants residing lawfully in the U.S. for less than five years and their families to adequate health care, including reproductive health care services.
Domestic violence
16. The Committee is concerned that domestic violence continues to be prevalent in the State party, and that ethnic minorities, immigrants and American Indian and Alaska Native women are at a particular risk. The Committee is also concerned that victims face obstacles to obtaining remedies, and that law enforcement authorities are not legally required to act with due diligence to protect victims of domestic violence, and often inadequately respond to such cases  (arts. 3, 7, 9, and 26)
The State party should, through the full and effective implementation of the Violence against Women Act and the Family Violence Prevention and Services Act, strengthen measures to prevent and combat domestic violence, as well as to ensure that law enforcement personnel appropriately respond to acts of domestic violence. The State party should ensure that cases of domestic violence are effectively investigated and that perpetrators are prosecuted and sanctioned. The State party should ensure remedies for all victims of domestic violence, and take steps to improve the provision of emergency shelter, housing, child care, rehabilitative services and legal representation for women victims of domestic violence. The State party should also take measures to assist tribal authorities in their efforts to address domestic violence against Native American women.
Corporal punishment
17. The Committee is concerned about the use of corporal punishment of children in schools, penal institutions, the home, and all forms of child care at federal, state and local levels. It is also concerned about the increasing criminalization of students to tackle disciplinary issues arising in schools (arts. 7, 10, and 24).
The State party should take practical steps, including through legislative measures where appropriate, to put an end to corporal punishment in all settings. It should encourage non-violent forms of discipline as alternatives to corporal punishment and should conduct public information campaigns to raise awareness about its harmful effects. The State party should also promote the use of alternatives to the application of criminal law to address disciplinary issues in schools.
Non-consensual psychiatric treatment
18. The Committee is concerned about the widespread use of non-consensual psychiatric medication, electroshock and other restrictive and coercive practices in mental health services (arts. 7 and 17).
The State party should ensure that non-consensual use of psychiatric medication, electroshock and other restrictive and coercive practices in mental health services is generally prohibited. Non-consensual psychiatric treatment may only be applied, if at all, in exceptional cases as a measure of last resort where absolutely necessary for the benefit of the person concerned provided that he or she is unable to give consent, for the shortest possible time, without any long-term impact, and under independent review. The State party should promote psychiatric care aimed at preserving the dignity of patients, both adults and minors.

Criminalization of homelessness
19. While appreciating the steps taken by federal and some state and local authorities to address homelessness, the Committee is concerned about reports of criminalization of people living on the street for everyday activities such as eating, sleeping, sitting in particular areas etc. The Committee notes that such criminalization raises concerns of discrimination and cruel, inhuman, or degrading treatment (arts. 2, 7, 9, 17, and 26).
The State party should engage with state and local authorities to: (a) abolish criminalization of homelessness laws and policies at state and local levels; (b) ensure close cooperation between all relevant stakeholders including social, health, law enforcement and justice professionals at all levels to intensify efforts to find solutions for the homeless in accordance with human rights standards; and (c) offer incentives for decriminalization and implementation of such solutions, including by providing continued financial support to local authorities implementing alternatives to criminalization and withdrawing funding for local authorities criminalizing the homeless.
Conditions of detention and use of solitary confinement
20. The Committee is concerned about the continued practice of holding persons deprived of their liberty, including juveniles and persons with mental disabilities under certain circumstances, in prolonged solitary confinement, and about detainees being held in solitary confinement also in pretrial detention. The Committee is furthermore concerned about poor detention conditions in death row facilities (arts. 7, 9, 10, 17, and 24).
The State party should monitor conditions of detention in prisons, including private detention facilities, with a view to ensuring that persons deprived of their liberty be treated in accordance with the requirements of articles 7 and 10 of the Covenant and the UN Standard Minimum Rules for the Treatment of Prisoners. It should impose strict limits on the use of solitary confinement, both pretrial and following conviction, in the federal system, as well as nationwide, and abolish the practice in respect of anyone under the age of 18 and prisoners with serious mental illness. It should also bring detention conditions of prisoners on death row in line with international standards.
Detainees at Guantánamo Bay
21. While noting President Obama’s commitment to close the Guantánamo Bay facility and the appointment of Special Envoys at the Departments of State and Defense to continue to pursue the transfer of detainees designated for transfer, the Committee regrets that no timeline for closure of the facility has been provided. The Committee is also concerned that detainees held in Guantánamo Bay and in military facilities in Afghanistan are not dealt with within the ordinary criminal justice system after a protracted period of over a decade in some cases (arts. 7, 9, 10, and 14).
The State party should expedite the transfer of detainees designated for transfer, including to Yemen, as well as the process of periodic review for Guantánamo detainees, and ensure either their trial or immediate release, and the closure of the Guantánamo facility. It should end the system of administrative detention without charge or trial and ensure that any criminal cases against detainees held in Guantánamo and military facilities in Afghanistan are dealt with within the criminal justice system rather than military commissions and that those detainees are afforded the fair trial guarantees enshrined in article 14 of the Covenant.
NSA surveillance
22. The Committee is concerned about the surveillance of communications in the interests of protecting national security, conducted by the National Security Agency (NSA) both within and outside the United States through the bulk phone metadata program (Section 215 of the PATRIOT Act) and, in particular, the surveillance under Section 702 of Amendments to the Foreign Intelligence Surveillance Act (FISA) conducted through PRISM (collection of the contents of communications from U.S.-based companies) and UPSTREAM (tapping of fiber-optic cables in the U.S. that carry internet traffic) programs and their adverse impact on the right to privacy. The Committee is concerned that until recently, judicial interpretations of FISA and rulings of the Foreign Intelligence Surveillance Court (FISC) have largely been kept secret, thus not allowing affected persons to know the law with sufficient precision. The Committee is concerned that the current system of oversight of the activities of the NSA fails to effectively protect the rights of those affected. While welcoming the recent Presidential Policy Directive (PPD-28) that will now extend some safeguards to non-US persons “to the maximum extent feasible consistent with the national security”, the Committee remains concerned that such persons enjoy only limited protection against excessive surveillance. Finally, the Committee is concerned that those affected have no access to effective remedies in case of abuse (arts. 2, 5(1), and 17).
The State party should:
(a) take all necessary measures to ensure that its surveillance activities, both within and outside the United States, conform to its obligations under the Covenant, including article 17; in particular, measures should be taken to ensure that any interference with the right to privacy complies with the principles of legality, proportionality and necessity regardless of the nationality or location of individuals whose communications are under direct surveillance;
(b) ensure that any interference with the right to privacy, family, home or correspondence be authorized by laws that (i) are publicly accessible; (ii) contain provisions that ensure that collection of, access to and use of communications data are tailored to specific legitimate aims; (iii) are sufficiently precise specifying in detail the precise circumstances in which any such interference may be permitted; the procedures for authorizing; the categories of persons who may be placed under surveillance; limits on the duration of surveillance; procedures for the use and storage of the data collected; and (iv) provide for effective safeguards against abuse;
(c) reform the current system of oversight over surveillance activities to ensure its effectiveness, including by providing for judicial involvement in authorization or monitoring of surveillance measures, and considering to establish strong and independent oversight mandates with a view to prevent abuses;
(d) refrain from imposing mandatory retention of data by third parties;
(e) ensure that affected persons have access to effective remedies in cases of abuse.
Juvenile justice and life without parole sentences
23. While noting with satisfaction the Supreme Court decisions prohibiting life without parole sentences for children convicted of non-homicide offenses (Graham v. Florida), and barring mandatory life without parole sentences for children convicted of homicide offenses (Miller v. Alabama) and the State party’s commitment to their retroactive application, the Committee is concerned that a court still may, within its discretion, sentence a defendant to life without parole for a homicide committed as a juvenile and that a mandatory or non-homicide related sentence of life without parole may still be applied to adults. It is also concerned that many states exclude 16 and 17 year olds from juvenile court jurisdictions and thus juveniles continue to be tried in adult courts and to be incarcerated in adult institutions (arts. 7, 9, 10, 14, 15, and 24).
The State party should prohibit and abolish all juvenile life without parole sentences irrespective of the crime committed, as well as all mandatory and non-homicide related sentences of life without parole. It should also ensure that all juveniles are separated from adults during pretrial detention and after sentencing and that juveniles are not transferred to adult courts. States that automatically exclude 16 and 17 year olds from juvenile court jurisdictions should be encouraged to change their laws.
Voting rights
24. While noting with satisfaction Attorney General Holder’s statement of 11 February 2014 calling for a reform of prisoner disenfranchisement State laws, the Committee reiterate its concern about the persistence of state-level felon disenfranchisement laws, its disproportionate impact on minorities, and the lengthy and cumbersome state voting restoration procedures. The Committee is further concerned that voter identification and other recently introduced eligibility requirements may impose excessive burdens on voters resulting in de facto disenfranchisement of large numbers of voters, including members of minority groups. Finally, the Committee reiterates its concern that residents of the District of Columbia are denied the right to vote for and election of voting representatives to the U.S. Senate and House of Representatives (arts. 2, 10, 25, and 26).
The State party should ensure that all states reinstate voting rights to felons who have fully served their sentences, provide inmates with information about their voting restoration options and remove or streamline lengthy and cumbersome state voting restoration procedures, as well as review automatic denial of the vote to any imprisoned felon, regardless of the nature of the offence. It should also take all necessary measures to ensure that voter identification requirements and the new eligibility requirements do not impose excessive burdens on voters resulting in de facto disenfranchisement. The State party should also provide for the full voting rights of residents of Washington, D.C.
Rights of indigenous people
25. The Committee is concerned about the insufficient measures being taken to protect the sacred areas of indigenous peoples against desecration, contamination and destruction as a result of urbanization, extractive industries, industrial development, tourism and toxic contamination. It is also concerned about restricted access of indigenous people to sacred areas essential for preservation of their religious, cultural and spiritual practices and the insufficiency of consultation conducted with indigenous peoples on matters of interest to their communities (art. 27).
The State party should adopt measures to effectively protect sacred areas of indigenous peoples against desecration, contamination and destruction and ensure that consultations are held with the communities that might be adversely affected by State party’s development projects and exploitation of natural resources with a view to obtaining their free, prior and informed consent for the potential project activities.
26. The State party should widely disseminate the Covenant, the text of the fourth periodic report, the written responses that it has provided in response to the list of issues drawn up by the Committee and the present concluding observations so as to increase awareness among the judicial, legislative and administrative authorities, civil society and non-governmental organizations operating in the country, as well as the general public. The Committee also requests the State party, when preparing its fifth periodic report, to continue its practice of broadly consulting with civil society and non-governmental organizations.
27. In accordance with rule 71, paragraph 5, of the Committee’s rules of procedure, the State party should provide, within one year, relevant information on its implementation of the Committee’s recommendations made in paragraphs 5, 10, 21 and 22 above.

28. The Committee requests the State party, in its next periodic report, due to be submitted on 28 March 2019, to provide specific, up-to-date information on all its recommendations and on the Covenant as a whole

The Damn Fool in the White House

The Damn Fool in the White House

by Stephen Lendman

Geopolitical conditions today are incendiary. Obama's war on Syria rages. No end in sight looms.

Washington manipulated peace talks to fail. Odds favor full scale US intervention. Doing so risks regional war.

In late February, Israel bombed Hezbollah targets. It did so along Lebanon's border with Syria.

Hezbollah vowed to respond "at the appropriate time." It justifiably denounced "blatant" Israeli "aggression."

Washington and Israel partner in regional adventurism. Do Obama and Netanyahu want war on Lebanon? Are they planning regional conflict?

Will Iran be targeted? Will US-orchestrated Venezuelan violence continue? Will other nations be targeted for regime change?

The damn fool in the White House risks global war. Ukraine is a major flashpoint. Conditions today are the most dangerous since the 1962 missiles of October crisis.

Jack Kennedy was president. Early in his administration he changed from cold warrior to peacemaker.

He wanted all nuclear weapons abolished. He favored "general and complete disarmament." He wanted all US forces out of Vietnam by December 1965.

He wanted to "splinter the CIA in a thousand pieces and scatter it to the winds."

After resolving the 1962 crisis, he said he "never had the slightest intention" of confronting Cuba or Soviet Russia aggressively.

The damn fool in the White House is no Jack Kennedy. Neocons infest his administration. Rogue elements make policy.

Ousting Ukraine's democratically elected government was planned long before violence erupted last November.

Obama partnered with neo-Nazis extremists. He's got a tiger by the tail. Millions of Ukrainians reject them. Expect millions more to join them once their agenda becomes apparent.

Eastern Ukraine is largely pro-Russian. Crimeans may choose independence. East/West tensions keep escalating.

The damn fool in the White House risks war. He outrageously warned Putin against intervening.

On Saturday, Russia's upper house Federation Council authorized use of military forces in Crimea.

Putin requested deployment permission to protect the safety of Russian nationals.

On Sunday, RIA Novosti reported "(l)arge movements of Russian troops...around the (Crimean) peninsula…"

Western media headlines lied. They screamed Russian invasion. The CIA-linked Washington Post claimed "Russian forces seize(d) Crimea."

Neo-Nazi coup d'etat interim Ukraine president Oleksandr Turchynov accused Russia of "direct aggression against the sovereignty of Ukraine."

Neocon WaPo editors headlined "Condemnation isn't enough for Russian actions in Crimea."

"Invasion," they screamed. They outrageously accused Putin of "provoking a separatist rebellion..."

Obama and EU partners "must act quickly to prevent Ukraine's dismemberment," they said.

They support Ukraine's illegitimate xenophobic, ultranationalist, anti-Semitic, neo-Nazi coup plotters. They demand Moscow recognize them.

They demand Obama order a "heavy price" otherwise. They want Western monied interests given a free hand to rape and pillage Ukraine. They barely stopped short of urging war.

On Saturday, Obama and Putin spoke for 90 minutes. The damn fool in the White House wrongfully accused him of breaching international law.

He threatened unspecified "costs." Washington won't participate in upcoming preparatory G-8 talks, he said. Russia risks political and economic isolation, he added.

Ukrainians have the right to determine their own future, he claimed. His orchestrated coup denies them entirely.

Putin won't be bullied. He won't roll over for Washington. He'll responsibly defend Russian interests.

He'll do so, he told Obama. He'll protect the safety and security of Crimean Russian nationals, he said. He'll do so in other eastern areas if needed.

Real threats exist. He'll address them responsibly. If violence threatens Russian nationals, he'll take "all necessary measures" against it.

He'll do so "within the framework of international law." He stressed the need to prevent crisis conditions from escalating. He expressed concern about Kiev ultranationalist putschists usurping power.

Security Council members held an emergency Saturday session. Vitaly Churkin is Russia's UN ambassador.

Crimean authorities requested Russian help, he said. Claims about invading Russian forces are false.

"In the eastern part of Ukraine and Crimea in particular, we have seen the emergence of people from Kiev with a clear intention of repeating what has been happening in the Western part of Ukraine," he said.

Coup plotters "want to replace regional governments," he stressed.

Radicalized elements control Kiev, he added. They replaced what remains of legitimate Ukrainian governance.

Churkin called on Security Council members to act responsibly. He wants them to tell Kiev elements to refrain from violence.

Gunmen attempts to seize control of Crimean government buildings were foiled, he explained.

Russia's Federation Council authorized limited stabilizing military forces "on the territory of Ukraine" until "socio-political" conditions "normal(ize)."

Putin hasn't yet ordered it, he said. Claims otherwise are false. Or that Russia intends using military force against Ukraine.

Churkin urged all sides act "with cool heads." He wants Security Council members to order reinstitution of the February 21 agreement.

He wants Ukraine's legitimate government respected. He recommended establishing national unity governance.

Events in Ukraine remain fluid. Voice of Russia (VOR) reported mass defections from Ukraine's military serving in Crimea.

Deployed units are joining local self-defense forces. Soldiers doing so reject Kiev putschists. They resigned from Ukraine's military. Key is what its commanders do ahead.

At the same time, thousands of pro-Moscow supporters rallied in eastern Ukrainian cities. They back Russia's anti-Kiev position.

On Saturday, RT.com headlined "Ukrainian Navy flagship takes Russia's side - report."

The Hetman Sahaidachny reportedly refused to follow Kiev orders. It hoisted the Russian flag.

Federation Council member Igor Morozov said it "c(ame) over to our side today." The move came after Ukraine's "Navy command resigned Friday," said RT.

Coup d'etat president Aleksandr Turchinov appointed Rear Admiral Denis Berezovsky new navy chief.

He defected straightaway. "I, Berezovksy Denis, swear allegiance to the Crimean people and pledge to protect them, as required by (military) regulations.," he said.

The Hetman Sahaidachny headed home to Sevastopol after taking part in a Yanukovych authorized counter-piracy operation with NATO and the EU.

On Saturday, Russian Prime Minister Dmitry Medvedev spoke to his illegitimate Ukrainian counterpart, Arseniy Yatsenyuk. He urged both sides prioritize stability.

He said Russia reserves the right to protect "the lawful interests of citizens and servicemen deployed in the territory of the Autonomous Republic of Crimea."

If needed, Russian forces "have the right to act in the framework of the mandate issued by the Federation Council to the president," he added.

Ukrainian officials act irresponsibly "if they make unlawful decisions on the use of force against Russian citizens," he stressed.

On Sunday, Ukraine's coup d'etat parliament held an emergency closed-door session. Reports suggest martial law may be imposed.

Neo-Nazis operate this way. Rule of law principles don't matter. Imposed tyranny ups the stakes further.

It remains to be seen how western Ukrainians react. Expect eastern ones to ignore Kiev diktats. What happens then is up for grabs.

On Sunday, Crimean Prime Minister Vladimir Konstantinov told Kiev to stay out of Crimea's business.

"You in Kiev sort it out between yourselves, and we will deal with the republic's problems," he said.

Most Crimean law enforcement and military officials feel the same way, he added. They support local defense forces.

They want protection from anti-Russian elements. Konstantinov warned Kiev against forcefully trying to usurp control in Crimea as well as other areas resisting its authority.

On March 2, Ukraine's Belgorod Governor Yevgeny Savchenko said three pro-Russian regions reported increasing refugee flows.

Thousands from southern, eastern and central Ukraine came to Belgorod. They reject Kiev authority. They're concerned for their safety.

Rostov Region Governor Vasily Golubev said Ukrainians no longer feel safe in their country. Bryansk Region Governor Nikolay Denin said the same thing.

Russia's Federal Border Guard Service estimates around 675,000 Ukrainians sought refuge in Russia in January and February.

Expect many thousands more to join them. Chaotic conditions drive them to seek safety.

On Saturday, Russian immigration authorities reported 143,000 asylum requests in a two week period. They promised expedited processing of their requests.

According to Federal Migration Service citizenship department head Valentina Kazakova:

"The tragic events in Ukraine have sharply increased the number of applications to regional migration authorities."

"People are bewildered, frightened and despondent, she added.

Increasing numbers of Ukrainians living in Russia are applying for citizenship.

The neocon infested Project for the New American Century (PNAC) renamed itself the Foreign Policy Initiative (FPI).

Its directors and staff include a rogue's gallery of hard-right extremists. They deplore peace. They crave war. On March 1, they issued a statement on Russia's so-called "intervention in Ukraine."

They lied claiming "Putin has violated Ukrainian sovereignty..." Obama 'warned' him, they said. '(T)here will be costs for any military intervention in Ukraine,' he said.

FPI rogues want Obama to "lead the world (in) impos(ing) (them) and to ensure his bullying fails."

They demand Putin renege on his promise to protect Crimean Russian nationals.

They want John Kerry and Chuck Hagel to visit Kiev. They want them to "show solidarity" with its neo-Nazi coup d'etat government.

They want bilateral US/Russian discussions suspended unrelated to ongoing events.

They want financial sanctions imposed on Russian officials.

They want NATO member states having the option of abandoning NATO-Russia Founding Act of 1997 provisions.

They include prohibiting NATO force deployments in former Warsaw Pact countries. Ten, including former Soviet republics, are NATO member nations.

"It is critical that the United States and the international community make clear to President Putin that his military intervention in Ukraine is unacceptable, and will isolate the Russian government diplomatically, politically and economically," said FPI.

"Failure to do so will only reward President Putin's indefensible and dangerous actions, and could embolden him to take further actions towards Ukraine and its neighbors."

Obama's administration is infested with FPI type extremists. How he'll respond to events remains to be determined.

At stake is world peace. Will the damn fool in the White House undermine it further? His track record isn't encouraging.

Peace Philosophy and Public Life

The following is the foreword by David Swanson to a new book called Peace Philosophy and Public Life: Commitments, Crises, and Concepts for Engaged Thinking edited by Greg Moses and Gail Presbey, available from the publisher or amazon or your local bookstore.

This book makes a compelling case that if we are to rid the world of war, we will want to employ not only the usual tools—organization, education, activism, lobbying, nonviolent resistance, art, entertainment, and the creation of alternative structures that lead away from war—but we will also want to employ a healthy dose of philosophizing. By that I do not mean attempting to arrive at extra-human, divine, pure, or objective viewpoints on anything, but rather, attempting to bring into focus how much of our view of things is optional, and to propose preferable options.

In these pages, you will likely grasp the utility, not just the curiosity, of reconsidering any number of ways in which we speak and think, including what we mean by “we” when discussing foreign affairs, what we mean by “nationalism,” by “terrorism,” or by “humanitarianism.” Why do we assume that forgiveness has no place in public policy while overlooking those cases in which we unwittingly demand and expect it? We reject arguments from authority as consumers and voters but not—this book suggests—when we listen to law enforcement. Why?

Any number of contradictions in our labeling of practices should be examined. Can the prison and war industries really be described as creating jobs? Can we have a corrections institution that corrects nothing, or a counter-terrorism policy that increases terrorism? Are there other approaches to our public life that we haven’t properly considered? Or, rather, given the endless variety of alternative approaches that we have not considered, what provocative proposals can we bring ourselves to invent for consideration?

This is why we need philosophers and books like this one.

A couple of years ago, science writer John Horgan made a lengthy argument for the possibility of eliminating war from the world. He debunked the claim that war is in our genes, the claim that war is driven by population changes, the claim that a handful of sociopaths inevitably leads a nation to war, the claim that resource scarcity or inequality or stockpiles of weaponry make war unavoidable. After mountains of research, Horgan concluded that war exists only in those societies that accept or celebrate the idea of war. Therefore, we are free to choose to reject the idea of war and with it the practice, as others have done before.

Jean Paul Sartre, of course, arrived at this same conclusion without a speck of research. I actually think it is important that we arrive at the conclusion that we can end war without the research. We should not get into the habit of imagining that we must wait for authorities to prove to us that something has been done before, before we attempt to do it. Nothing could be more limiting. If we cannot have a world government until someone has demonstrated that world governments have existed before, we will never have one, and the idea of having one will strike us as absurd. Maybe it is absurd. Maybe it’s a horrible idea. But we should not write it off as such simply because it has not yet been tried.

This is not, of course, to suggest that empirical research is of no value. We could hardly survive or thrive without it. We could not speak intelligently about the world we want to change without it. It is hardly a condemnation of facts and data to deny them the role of limiting our imagination. No research to prove that slavery could be abolished existed prior to its abolition. Yet there was willingness by some to accept what is, after all, obvious: slavery would end if people chose to stop utilizing slavery, if they envisioned and constructed a society that lacked it.

People invest great effort in creating wars. They could choose not to do so. Transforming those glaringly obvious observations into a scientific study of whether enough people have rejected war in the past to reject it in the future is both helpful and harmful to the cause. It helps those who need to see that what they want to do has been done before. It hurts the habit we need to develop of imagining innovations.

This book in your hands is full of facts, but it is not fact driven. It is imagination driven. In these pages, you will be led to imagine various conceptions of nationalism and countryism. Is there a benevolent variation on the theme? Is there one with enough good in it to outweigh the harm? Here you will find that material to ponder.

Can we imagine nations with anti-terrorism policies? To do so, we will have to stop assuming we already have them. During the Cold War, the “balance of terror” was perfectly respectable. “Shock and awe” is a terrorist argument. Drone aircraft buzzing over villages are unmanned terrorists. What would a non-terrorist anti-terrorist policy look like?

We are helped along in our thinking by examples throughout the book of how some remarkable people have proposed paths that have not yet been taken. Dorothy Day proposed a response to Pearl Harbor that included forgiveness of the Japanese. Told that hers was an outrageous expectation, Day pointed out that African Americans were regularly lynched or assaulted in the United States and that their loved ones were expected to forgive.

Following 11 September 2001, Shirin Ebadi proposed building schools in Afghanistan named for the victims of the attacks of that day. Such a proposal will still sound crazy to most people when next it is made following some future disaster. But there is little doubt looking back that it would have done far more good than the approach actually taken—the natural, normal, acceptable, mainstream approach of bombing people to punish a crime most of them had never heard of and still have not. When the clearly preferable approach still sounds crazy, that’s a good sign we need to change our perspective.

The contributors to this volume propose shifts in perspective in several interlocking areas. These include immigration, ethics in economics, problems of consumerism, and wealth and poverty. Should we be tolerant of immigrants or welcome them with gratitude? Should we engage in charity or in solidarity? And what impact would these choices have on our acceptance of so-called “humanitarian” wars?

Nick Braune encourages us to think past arguments from authority so far as to radically shift the motivation for police interrogations. Instead of aiming for confessions, interrogators could aim to protect and inform the person being interrogated. If that sounds nonsensical, come back to this foreword after reading the book and maybe it will then seem normal. It is very hard for us to see anything as other than normal, even when it seemed crazy an hour before. But seeing choices, seeing multiple “normals,” is a skill we should practice, because we need to become capable of altering our vision.

The majority of people selling illegal drugs in the United States are white, but only people of color “look like” drug dealers to some police officers. Anyone accused of a crime “looks” guilty to many people employed in the criminal justice system. A “war” on drugs that has been used to generate real wars looks justified by those wars. Surely we would not legalize something we fight wars over!

Our “corrections” industry is not educating prisoners, but it is educating the rest of us to accept mass incarceration. The prison and war industries are promoted as jobs programs, as life-giving, as pro-peace. But we are perfectly capable of a coherent worldview in which that sort of nonsense sounds like nonsense. We should strive to develop that perspective.

Nuclear weapons are sometimes imagined as keeping us safe, but Day and Sartre and Albert Camus responded with appropriate horror immediately upon their creation. It turns out that horror is an appropriate response to all sorts of developments announced as progress or not announced at all. We are filling the skies with killer drones these days and suffering a corresponding deficit of horror.

What new horrors await us? This book warns of some of what we can expect: resource crises, climate catastrophe, mass immigration, refugees, and minority societies existing within hostile larger ones. These problems have solutions and means of prevention, and we should be thinking our way through them now.

Our politicians are largely ignoring Syrian refugees at the moment in which I write, while supporting violence in Syria for the supposed benefit of Syrians. If we had a better understanding of refugee crises in the world, could they get away with this?

We cannot know what all the problems will be. The unknown unknowns await us. But we can know for certain that the unknown knowns—the products of human thought that some people in places of power choose to avoid awareness of—will dominate many a future Donald Rumsfeld.

War is not only the product of the idea of war. It is a product of irrational madness and willful ignorance. It does not hold up on its own terms. The cakewalks are never cakewalks. The liberated are never grateful. The resources slip through the fingers of the plunderers. The bombs persistently fail to generate popular democracies. The freedoms we kill for are inevitably sacrificed to support the killing.

An Open Letter to Barack Obama

An Open Letter to Barack Obama

by Stephen Lendman

Congratulations, Mr. President. You're the latest in a long line of lawless leaders. You achieved rogue status without really trying.

Contempt for rule of law principles, duplicity and moral cowardice define your administration. Pretense otherwise doesn't wash.

Instead of improving lives for ordinary Americans, you created worse than ever conditions.

You more than ever made America a gangster state. Millions worldwide call it a pariah one. They do so for good reason.

You stole public wealth. You handed Wall Street crooks trillions of dollars. You gave war profiteers trillions more.

You impoverished millions. You left 100 million working-age Americans unemployed.

You ignore human need. Homelessness and hunger aren't your concerns.

You're systematically destroying middle class society. You're heading America on a fast track toward third world status. A second one toward full-blown tyranny.

You promised hope and change. You campaigned for peace. You promised all US forces out of Afghanistan in your first year in office.

You assured Palestinian sovereignty free from occupation harshness. You said decades of what Israel imposed would end.

You promised Guantanamo closure once and for all. You pledged within one year of taking office.

Bush administration war criminals will be held accountable, you said. Torture will end by decree.

So will indefinite detentions. Lawless military commissions trials won't be tolerated.

Labor rights will be supported. So will public education. And you can keep your doctor, you said.

You guaranteed universal healthcare with a public option. It'll be more affordable than before, you claimed.

You'll end unconstitutional executive authority. You'll help Americans facing foreclosure keep their homes.

You promised real immigration reform within one year of taking office. You'll "revisit the Patriot Act."

You'll "overturn unconstitutional executive decisions during the past eight years."

You'll be a uniter, not a divider. You'll serve all Americans equitably, justly, fairly and honorably.

"It's time to turn a page," you said. "We'll restore our values." The "days of compromising them are over."

We'll "secure a more resilient homeland." We'll "adhere to the Geneva Conventions."

Freedom is too precious to lose. You've gone all-out to destroy it on your watch. You've done so at home and abroad.

You said openness and transparency in government will be a hallmark of your administration. You'll increase whistleblower protections.

Big Brother will be banished. "(N)o more illegal wiretapping of American citizens," you pledged.

No more "spy(ing) on citizens who are not suspected of a crime." No more privacy invasions.

No more human and civil rights violations. "No more ignoring the law when it is inconvenient."

No more extrajudicial operations. No more favoring monied interests over popular ones. No more wars for power and profit.

No more less than treating everyone equitably and justly. No more defending the indefensible.

Arundhati Roy once called Tony Blair a "psychopath." She described Bush the same way. She said you're no different from them. And then some, this writer adds.

You did more to make America unfit to live in than any of your predecessors. You've waged political, economic and hot wars on humanity.

You threaten its survival. Your policies risk WW III. You're unapologetic. Your rampaging continues.

Your waging multiple direct and proxy wars. You target all independent countries for regime change.

You're waging war on Syria. You launched it. You killed tens of thousands. You bear full responsibility. You want a subservient pro-Western stooge replacing Assad.

You ravaged and destroyed Libya for the same purpose. You turned it into a charnel house. You're doing the same thing to many other countries. Countless millions suffer horrifically on your watch.

Ukraine is your latest victim. Congratulations. You claimed another imperial trophy. As long as you can keep it.

It's at the expense of millions of Ukrainians deserving better. You want them marginalized, exploited, impoverished and denied fundamental freedoms.

You want Ukraine run by fascist extremists. You bought victory on the cheap. Keeping it is something else entirely.

Reports estimate you spent $5 - $10 billion transforming Ukraine from a democracy to a pro-Western fascist police state.

It's pocket change compared to multi-trillions waging war on Afghanistan, Iraq, Libya, Syria, and other countries below the radar.

You elevated anti-Semitic, hate-mongering, xenophobic, ultranational neo-Nazis to power.

You expressed support for their extremism. You called them "the voice of the people." You blamed Ukraine's legitimate government for their street crimes.

You endorsed usurpation of power. On Saturday, your press secretary lied, saying:

"We have consistently advocated a de-escalation of violence, constitutional change, a coalition government, and early elections, and today's developments could move us closer to that goal."

Fact check: You planned violence. You initiated it. You stoked it. You funded it. You want total control over Ukrainian policy. You want ordinary Ukrainians having no say.

"The unshakeable principle guiding events must be that the people of Ukraine determine their own future."

Fact check: You've gone all-out to prevent it. You stole their future.

"We welcome constructive work in the Rada and continue to urge the prompt formation of a broad, technocratic government of national unity."

Fact check: Usurped Rada (parliament) authority has no legitimacy. It's polar opposite real democracy.

You deplore it. You tolerate it nowhere. You deny Americans what they deserve. You operate the same way globally.

"We welcome former Prime Minister Yulia Tymoshenko’s release from a prison hospital today, and we wish her a speedy recovery..."

Fact check: She's a criminal. She stole tens of millions of dollars. She did so at the expense of ordinary Ukrainians. She belongs in prison. Releasing her was lawless.

"We continue to urge an end to violence by all sides and a focus on peaceful, democratic dialogue, working pursuant to Ukraine’s constitution and through its institutions of government."

Fact check: It bears repeating. You spent billions on violently toppling Ukraine's legitimate government. You want pro-Western fascist extremism replacing it.

You got what you wanted so far. Keeping it may be something else entirely. The battle for Ukraine's soul continues. It has miles to go. It's outcome is very much undecided.

"Going forward, we will work with our allies, with Russia, and with appropriate European and international organizations to support a strong, prosperous, unified, and democratic Ukraine."

"…(T)he Ukrainian people should know that the United States deeply values our long-standing ties with Ukraine and will support them as they pursue a path of democracy and economic development."

Fact check: Ukrainian youths are ignorant. They're mindless about what's going on. They're easily manipulated. For how long matters most.

Older Ukrainians aren't stupid. They know how America operates. They know wherever it shows up, extreme violence and human misery follow.

They reversed George Bush's Orange Revolution. Don't bet they won't undo your 2.0 version. The battle for Ukraine's soul just began.

Note: Anonymous Ukraine monitors what's ongoing. It's members are divided. Some are brainwashed by Western propaganda.

Others know their country is being colonized for plunder. They'll fight it. They want no part of exploitive EU membership.

They reject US meddling in Ukraine's internal affairs. They oppose NATO membership. They deplore fascist extremists usurping power. They know your dirty hands are involved.

They want peace and stability. They want Ukrainians deciding their own future. They want sovereign independence defended.

They'll be heard from going forward. They won't stand by idly watching you wreck their country. They won't "go gentle into that good night."

"Operation Independence continues," they said. "Expect us."

One coup d'etat isn't enough for you. You want another. You want Venezuela's democratic government toppled.

You want Bolivarian social justice destroyed. You want Venezuela returned to its bad old days.

You bear full responsibility for street violence. You're funding it. You're directing it. You pull the strings.

Destabilization continues. CIA operatives are involved. So are State Department organizations.

Coup plotting is violent. Days of violence caused 10 deaths so far. Scores were injured. Your funded fascists are responsible.

Since 1999, you, Bush and Clinton spent billions of dollars targeting Venezuela for regime change. Bolivarianism survived everything done to destroy it.

It's resilient. It's institutionalized. The vast majority of Venezuelans support it. They won't tolerate your plot to steal what's too important to lose. Or the Hemisphere's most democratic country.

They'll fight to keep hard won gains. Victor Hugo once explained nothing stronger than "an idea whose time has come."

It's deep-rooted in Venezuela. It reflects Simon Bolivar's vision. He wanted the imperial curse "to plague Latin America with misery in the name of liberty" ended.

He wanted national resources distributed equitably and fairly. Chavez was his modern-day incarnation.

Chavismo reflects his commitment. Maduro carries his torch.

The battle to preserve Bolivarian values continues. They won't wane and die. Your dirty scheme is familiar.

You want Venezuela looking like America. You want police state viciousness replacing democracy. You want neoliberal harshness replacing Bolivarian fairness.

You want what Venezuelans won't tolerate. You want what they won't let you get.

Maybe Americans will awaken to reality. Maybe they'll react the same way. It's their future. If they won't protect it, no one will do it for them.

It bears repeating what other articles said. Resist or perish. There's no in-between. Spread the word. Tell others. We're all in this together. Defeating your agenda is too important a fight to lose.

Obama’s Abominable State of the Union

Obama's Abominable State of the Union

by Stephen Lendman

Obama's State of the Union address reflected beginning-to-end empty rhetoric. More on his comments below.

Throughout five years in office, he's been consistent. Duplicity defines his agenda. He says one thing. He does another.

In his first State of the Union address, he promised "to get our economy growing again, save as many jobs as possible, and help Americans who'd become unemployed."

He called jobs creation his "number one focus." He promised tax relief for ordinary Americans. He promised help for "8 million Americans paying for college."

Graduates are more indebted than ever. Outstanding debt tops $1 trillion. It's second only to mortgage debt.

For millions of young Americans, it represents many years of debt bondage. For too many, it reflects lifetime debt.

Obama's been more a jobs destroyer than creator. Phantom numbers conceal today's reality. Official ones are statistical illusions.

Real unemployment exceeds 23%. Longterm unemployment is at record levels.

Over 100 million working-age Americans have no jobs. It's 10 million more than when Obama took office.

In December, 74,000 new jobs were created. Five times that number "left the labor force." They can't find work.

They're nonpersons. They're ignored. They're not counted. They don't exist. America's official unemployment rate is 7.3%. It's one of many Big Lies.

So is job quality. Most high-pay/good benefit/full-time jobs no longer exist. Part-time/low-pay/poor or no-benefit jobs replaced them.

Many pay poverty or sub-poverty wages. Obama waged war on organized labor. Permanent job losses, rotten ones created, gutted work rules, forfeited security and lost futures followed.

Decades of hard-won gains were lost. Industry got major concessions. Workers were entirely left out. They're worse off today than in generations. They're entirely without rights.

Obama's economic program is no banker left behind. Or war profiteer. Or other corporate favorites. Or America's super-rich.

So-called economic recovery is fake. Protracted Main Street Depression conditions persist. Hard times get increasingly harder.

Millions struggle to get by. Obama ignores America's most disadvantaged. Anti-populism defines him.

He's beholden to monied interests. Neoliberal harshness is official policy. Force-fed austerity reflects it. Safety net protections eroded on his watch. They're disappearing when most needed.

Obama wants social America destroyed. He cut many vital programs. He wants Medicare and Social Security privatized en route to eliminating them altogether.

He wants America's wealth shifted to its privileged class. Inequality today is unprecedented.

He wants Americans left on their own sink or swim. He pretends otherwise. His rhetoric belies his policies.

His first State of the Union address promised "slash(ed) tax breaks for companies that ship our jobs overseas." Corporate America got new ones instead.

He asked for "a jobs bill on my desk without delay." His plan involved corporate tax cuts. His 2009 $787 stimulus bill handed them $400 billion.

Doing so didn't create jobs. Through December 2010, more were lost than created. Rotten ones replaced good ones.

Bush and Obama are two sides of the same coin. Their policies benefitted corporations and super-rich elites hugely. They never had it better.

Obama heads a rogue administration. Bipartisan complicity created the greatest wealth disparity in US history.

Half or more of US households are impoverished or bordering it. Good jobs are disappearing in plain sight.

Nearly 50 million Americans need food stamps to eat. In November, $11 billion in SNAP benefits were cut through 2016.

Average households of three lost $29 a month. It's the equivalent of 16 monthly meals. SNAP aid is less than $1.40 per person per meal.

On Monday, bipartisan complicity agreed on $8.7 billion more SNAP cuts. Expect quick congressional passage. Expect Obama enacting greater harshness into law.

Feeding hungry Americans no longer matters. Before Obama leaves office, SNAP benefits may disappear altogether.

He demands gutting vital social programs. His rhetoric claims otherwise. It rings hollow.

His policies throughout five years in office reflects reality. He's no friend of ordinary Americans. He's mindless of those most disadvantaged.

Hard times are getting harder. Needy households are increasing exponentially. At the same time, corporate profits are higher than ever.

Obama's annual State of the Union addresses reflect an exercise in empty rhetoric. He's a fraud. He's a moral coward.

He's a serial liar. Nothing he says can believed. Americans are tired of broken promises.

Over 60% lack confidence in his intention to serve them responsibly. Over 80% distrust political Washington.

Obama's presidency reflects duplicity. It reflects promises made and broken. It reflects public betrayal.

Voter confidence in him is polar opposite from when he took office. He represented hope and change. He delivered business as usual.

His Tuesday night address was a litany of lies and false promises.

He lied calling "the state of our union strong." America is in protracted decline. It's losing its economic and political dominance. It's been this way for decades. It accelerated under Obama.

He lied claiming the "lowest unemployment rate in over five years." It's higher than when he took office.

He lied claiming "the United States is better-positioned for the 21st century than any other nation on earth."

China's growth rate heads toward overtaking America. Perhaps by 2020 or earlier. Other BRICS countries (Brazil, Russia, India and South Africa) are some of the world's fastest growing.

China is the world's largest exporter. India is an information technology powerhouse. Brazil is a dominant agricultural exporter.

Russia is oil and gas rich. South Africa holds resources worth an estimated $2.5 trillion. Other developing nations way outpace US growth.

Obama lied about being "committed to making Washington work better, and rebuilding the trust of the people who sent us here."

His agenda throughout five years in office destroyed it altogether. Political Washington is beyond fixing. Tinkering around the edges won't work. Nor rhetorical promises made to be broken.

Obama lied about "the budget compromise…leav(ing) us freer to focus on creating new jobs, not...new crises."

In December, bipartisan complicity struck a budget deal no responsible government would accept. Monied interests are served.

War profiteers benefit enormously. Cuts target vital social programs. They're too important to lose. Deficit reduction is too meager to matter.

Obama acknowledged inequality. He stopped short of accepting responsibility for accelerating America's unprecedented wealth disparity. A race to the bottom continues.

He lied saying "(o)ur job is to reverse these trends." He's gone all out to sustain them. He's destroying middle America.

He lied about "build(ing) new ladders of opportunity into the middle class." He'll act unilaterally if Congress won't, he claimed.

"(T)hat's what I'm going to do," he said. He's done nothing throughout five years. Expect pathetically little ahead. Expect same old, same old.

He lied about wanting to close "wasteful, complicated (tax) loopholes." They benefit monied interests he supports.

He lied about "transition(ing) to tax reform to create jobs rebuilding our roads, upgrading our ports, unclogging our commutes..."

Finance reform masqueraded as change. It was business as usual. Wall Street crooks wrote the legislation. Their interests are well served. Ordinary Americans got scammed.

He lied about his energy policy "creating jobs and leading to a cleaner, safer planet." He's beholden to Big Oil.

He supports dangerous nuclear power. He largely ignores clean energy.

He lied claiming "new partnerships in trade with Europe and the Asia-Pacific will help create more jobs."

The so-called Trans-Pacific Partnership (TPP) is a secretive, multi-nation agreement. It's a jobs destroyer. It force-feeds corporate intellectual property rules.

It supranational. It tramples on national sovereignty. It destroys privacy and other personal freedoms. The Trans-Atlantic Free Trade Agreement (TAFTA) is its US/European equivalent.

Obama lied about "fix(ing) our broken immigration system." Throughout his tenure, he waged war on undocumented immigrants. His policy is racist.

He deported more migrants than any previous administration. He exceeded the worst of George Bush.

He inflicts harshness indiscriminately. His policies are irresponsible. Militarizing Mexico's border is prioritized. So is increasing Border Patrol staff by thousands.

Obama's pathway to citizenship excludes most immigrants. Qualifying means waiting 13 years or longer. Hurdles imposed are enormous.

Immigration reform reflects business as usual. Comprehensive reform is a convenient illusion. "(L)et's get immigration reform done this year," said Obama.

He lied claiming "ideas (he) outlined can speed up growth and create more jobs." They haven't so far. They won't going forward.

He lied about wanting to restore benefits 1.3 million jobless workers lost the week before Christmas. In 2014, millions more will lose theirs. Rhetorically he opposes it. He proposed nothing to prevent it.

He lied about wanting "every child (to have) access to a world-class education." Throughout his tenure, he waged war on public education.

He wants it privatized. He wants it made another business profit center. He cut Pell Grants. He supports America's student loan racket.

His so-called Race to the Top sacrifices quality education. It mandates marketplace rules. It lets Washington bureaucrats decide what's best for children. It's another black mark on his legacy.

His American dream promise is empty. He lied saying "hard work pays off for every American." They're worse off today than in modern memory.

"In the coming weeks, I will issue an Executive Order requiring federal contractors to pay their federally-funded employees a fair wage of at least $10.10 an hour - because if you cook our troops' meals or wash their dishes, you shouldn't have to live in poverty," he said.

Note: $10.10 x 40 hours a week x 52 weeks = $21,000. The federal poverty level for a family of four is $23,500.

It's woefully below reality. It's based on a decades old guideline. Households need at least double that amount to avoid poverty.

They don't need minimum wage protection. They need guaranteed living wages. Enough to cover all essential expenses. Enough to live like most working Americans did decades ago.

Obama's plan is deplorable. Whether or not it becomes policy doesn't matter.

What about all public employees. What about state and local ones. What about private sector workers. What about restoring lost benefits.

"Give America a raise," said Obama. His rhetoric rings hollow. Working American wages eroded for decades. Inflation adjusted, they decline annually. Real inflation is multiples higher than fake numbers.

Obama touted his Affordable Care Act. "That's what (healthcare) reform is all about," he claimed.

ACA is a healthcare rationing scheme. It enriches insurers, drug companies and large hospital chains.

It scams millions of Americans. It's polar opposite what's needed. Obama's agenda abhors fairness.

He ignored his multiple war crimes. He lied about exiting Afghanistan. America came to stay. Permanent occupation is planned. So is his war on peace, stability and security.

He lied about terrorist threats. "(T)hat danger remains," he claimed. "We have to remain vigilant."

"We must fight the battles that need to be fought."

Hegemons operate this way. America's only threats are ones it invents.

Permanent war is official policy. Unchallenged global dominance is sought. Obama didn't explain. His rap sheet is blood-drenched.

He's waging war on Syria. He's destroying another country. He's doing it lawlessly.

He lied about "preventing Iran from obtaining a nuclear weapon." No program exists to do so.

Whether or not he lied about vetoing possible legislation imposing new sanctions remains to be seen. Earlier promised vetoes were hollow.

He lied about Hezbollah "threaten(ing) our allies." Israel is the region's only existential threat.

He lied about "the ideals we stand for and the burdens we bear to advance them."

Imperial lawless reflects official US policy. Obama's police state apparatus targets homeland resisters.

Mass surveillance watches everyone. Whistleblowers and activists are considered existential threats.

America's state of the union is deplorable. Obama's entire address reflected empty rhetoric. It's an annual duplicitous exercise. Expect business as usual to continue.

NAFTA’s Deplorable Legacy

NAFTA's Deplorable Legacy

by Stephen Lendman

Wall Street Journal columnist Mary O'Grady reinvents history. She does it her way. It's the wrong way. She turns truth on its head.

Her commentaries read like bad fiction. They substitute misinformation for indisputable facts. Responsible editors wouldn't touch her rubbish. Journal editors embrace it.

NAFTA was hugely destructive trade policy. It's opposite of what's needed. More on why below.

Not according to O'Grady. On January 5, she headlined "Nafta at 20: A Model for Trade Policy." It's a model for the wrongheaded kind.

O'Grady claims otherwise. She does so her way. Why anyone reads her rubbish, they'll have to explain. Journal editors feature it.

"Those who predicted that Nafta would lead to joblessness and poverty have been proven definitively wrong," claims O'Grady.

Hundreds of thousands of impoverished jobless workers explain otherwise. More on this below.

"Freedom to trade with the neighbors (Canada, Mexico and the US) has instead created wealth and opportunity and made the continent more globally competitive," she says.

Indeed so for corporate predators and rich elites. They profited hugely. They did the old-fashioned way. They benefitted on backs of exploited people.

O'Grady supports more of the same. She's for greater "North American integration." In other words, greater corporate favoritism. Fewer worker rights. More job losses. Lower pay and benefits. Profits at the expense of people.

"(E)xpanding economic freedom in North America requires a commitment to the cause," she claims.

She's on the wrong side of history. Anti-labor, anti-environment, anti-consumer and anti-democratic measures harm millions. One-sided "free trade" isn't fair.

NAFTA proponents promised tens of thousands of newly created jobs. Small farmers would export their way to wealth.

Mexican living standards would rise. Economic opportunities would reduce regional immigration to America.

Promises made never materialized. Reality disproved hype. It does it every time. Ideologues like O'Grady are exposed.

They're frauds. They're defrocked. They're discredited liars. She's paid to lie. She's one of the worst.

A decade post-NAFTA, about a million US jobs were lost. America's Mexican trade deficit alone cost around 700,000 jobs by 2010.

Government data show nearly five million US manufacturing disappeared since 1994.

NAFTA alone wasn't responsible. Losing them reflected broken promises, lost futures, and other trade deals from hell to follow. The Trans-Pacific Partnership (TPP) and Trans-Atlantic Free Trade Agreement (TAFTA) stand out.

Public Citizen's new report is titled "NAFTA at 20: One Million US Jobs Lost, Mass Displacement and Instability in Mexico, Record Income Inequality, Scores of Corporate Attacks on Environmental and Health Laws."

Lori Wallach heads Public Citizen's Global Trade Watch. Ralph Nader calls her "the Trade Debate's Guerrilla Warrior."

Public Citizen calls her "a relentless campaigner." She's been so for 20 years. She's a Harvard Law School trained lawyer. In 1993, she founded Citizens Trade Campaign.

It's a national coalition of consumer, labor, environmental, family farm, religious, and civil rights groups. They represent over 11 million Americans. According to Wallach:

"NAFTA's actual outcomes prove how damaging this type of agreement is for most people, that it should be renegotiated and why we cannot have any more such deals that include job-offshoring incentives, requirements that we import food that doesn’t meet our safety standards or new rights for firms to get taxpayer compensation before foreign tribunals over laws they don’t like."

NAFTA remains hugely destructive. It's "equal parts disgusting and infuriating," says Wallach. Obama joined "the corporate Pinocchios."

They lie about NAFTA. They've done so from inception. They're doing it again now. They selling similar Trans-Pacific Partnership (TPP) snake oil. It's NAFTA on steroids.

Public Citizen's study discusses promises made and broken. Post-NAFTA trade and investments contributed to huge job losses, pay cuts and lost futures. Income inequality keeps growing.

America's trade deficit with Mexico and Canada is 45% higher than with countries not party to US trade agreements.

US manufacturing and services exports to NAFTA partners grew at less than half their pre-NAFTA rate. Polls show more than half of Americans want NAFTA renegotiated or abandoned.

Few want US membership continued. Opposition cuts across parties, income classes and educational levels.

Subsidized US corn exports to Mexico increased. Doing so destroyed the livelihoods of over one million Mexican small farmers.

Another 1.5 million agriculture-dependent Mexican workers lost jobs. Doing so doubled Mexican immigration to America. Most are undocumented. Desperate poor people come north for jobs.

They're still coming. Doing so increases competition for scarce service sector ones. Government data show the destructive effects of offshoring.

Affected workers lost 20% of their income on average. They did so compared to non-offshorable jobs gotten.

NAFTA damaged millions of lives. It doesn't matter. Obama wants TPP fast-tracked. He wants TAFTA legislation passed.

He wants millions more US workers displaced. He wants others rehired for less pay. He wants them consigned to poverty. He wants corporate predators profiting at their expense.

According to Wallach, NAFTA-type trade agreements are "corporate Christmas" presents year-round. Big business loves them.

They "jack up medicine prices with patent extensions for Big Pharma," says Wallach.

"Big Content loves them because (of) SOPA-type copyright rules. Chemical and pharmaceutical companies love them because" they're freed from regulations and inspections.

Big "oil and gas companies love them because they (get) absolute rights to natural resources."

"Chronic job offshoring companies love them because (they get) new investor protections" abroad.

They're win-win for corporate predators. Workers, America's unemployed and underemployed lose out big time.

Fast-tracking got NAFTA passed. It's an arcane Nixon-era procedure. It lets executive branch officials write legislation.

Corporate lobbyists do it for them. They stuff everything in measures corporations love.

Congress is denied debate. No amendments are allowed. Up or down voting alone follows.

Fast-tracking is a way of railroading legislation through Congress. It does so against enormous public opposition.

Anti-NAFTA sentiment before passage added more corporate sweeteners than originally planned.

NAFTA "established a radically new 'trade' agreement model," said Public Citizen. It differed from earlier trade deals. It's "only partially about trade."

It "created new privileges and protections for foreign investors.." It incentivized offshore investments and jobs. It did so by "eliminating many of the risks normally associated with moving production to low-wage countries."

NAFTA lets foreign companies and investors challenge domestic laws, regulations and standards. They can demand compensation for alleged lost profits.

Regulation of trucking, banking and other services is restricted. Medicine patent monopolies are extended.

Food and product safety standards are limited. So are domestic procurement preferences like "Buy American."

Pre-NAFTA enactment debate sold empty promises. It's record 20 years later proves otherwise. It's responsible for hundreds of thousands of lost jobs, lower wages, and grim futures for millions.

According to the Bureau of Labor Statistics, two-thirds of NAFTA-displaced manufacturing workers able to find jobs lost 20% or more of their former wages.

NAFTA's deplorable record reflects race to the bottom reality. It includes unemployment, underemployment, low pay, poor benefits, and lost futures for millions.

According to Public Citizen, "a 188 percent rise in food imports from Canada and Mexico" had no impact on containing prices. They "jumped 65 percent since" NAFTA's implementation.

Scores of US companies promised to create specific numbers of jobs if NAFTA passed. They cut them hugely instead.

General Electric cut nearly 5,000 jobs. Chrysler eliminated over 7,700. Nearly 600 Caterpillar workers lost out. Many other companies betrayed their workforces and communities the same way.

Since NAFTA's implementation, the income of America's richest 10% rose 24%. For its top 1%, it was 58%. "NAFTA-style trade helps explain the soaring inequality," says Public Citizen.

"NAFTA has placed downward pressure on wages for the middle and lower economic classes by forcing decently-paid US manufacturing workers to compete with imports made by poorly-paid workers abroad."

"The resulting displacement of those decently-paid US workers has further depressed middle class wages by adding to the surplus of workers seeking lower-paying service sector jobs."

NAFTA contributes hugely to growing inequality. It gives companies enormous leverage. They can pay domestic workers less. They can offshore for greater savings.

Since NAFTA's implementation, over 60,000 US manufacturing facilities closed. WTO and other factors share responsibility. "After two decades of NAFTA, the evidence is clear," says Public Citizen.

"(T)he vaunted deal failed at its promises of job creation and better living standards while contributing to mass job losses, soaring income inequality, agricultural instability, corporate attacks on domestic health and environmental safeguards, and mass displacement and volatility in Mexico."

Obama wants more of the same. Whether he'll get it remains to be seen. TPP opposition is significant. Ordinary Americans and policymakers comprise it.

Congress may block passage. In November, a bipartisan group of 178 House members expressed fast-tracking opposition. Other congressional members expressed concerns about TPP overall.

NAFTA's failure prevented Free Trade Areas of the Americas (FTAA) and Asia-Pacific Economic Cooperation (APEC) adoption.

It's "two-decade legacy of tumult and hardship for millions could" kill TPP and other destructive trade deals, says Public Citizen.

Doing so would be a step in the right direction. Much more needs to begun.

Reversing longstanding race to the bottom policy requires wholesale change. Evidence of it happening is nowhere in sight.

World Citizen: Garry Davis vs. National Borders

In September 1948, when delegates to the young United Nations met at the grand Palais de Chailot in Paris, a twenty-something American wearing the flak jacket of a bomber pilot pitched a tent on the Palais steps. Guards descended and angrily ordered him to leave, but he politely declined. I’m no longer in France, the man explained, eyes twinkling. I’m standing on “international territory.”
As a crowd gathered, so did the world press. With days the name of this pilot-turned-peacenik, Garry Davis, was known around the world. Newsreels captured a mounting drama that featured curious crowds, inspired celebrities and perplexed authorities.
When a reporter asked Davis what he was about, he replied, “I’m a world citizen.” With that simple assertion a global movement was born.
Garry Davis, who died on July 24, 2013 just shy of 92 years old, was part rebel, part performer and completely original, a world-class Don Quixote who for more than half a century jousted at the biggest windmill of all – nationalism. It was a wild ride that took him around the world, in and out of 34 jails, and across countless frontiers.
After renouncing his US citizenship as an anti-war protest, camping out in Paris, and crashing a UN session to deliver a speech, Davis launched his first major organizing project, a registry for world citizens. More than a million people responded to the call. Forced out of France, he next went on tour, stateless and without documents. This time thousands of people turned out to meet him and local governments passed supportive resolutions.  Yet, over the next few years he was also repeatedly thrown in jail and deported.
In 1953, for example, while he was appearing as an actor in a London stage production of Stalag 17, the show closed unexpectedly when the Queen died, and Davis found himself without a visa. A kindly magistrate gave him an idea: build a home on public property. But he was arrested anyway and taken to Brixton prison.
Officials there laughed at first when Davis wrote to the new Queen. But they had to eat some crow when she responded with a thank you note. She would not step in, Her Majesty explained, but she did appreciate his situation.
Three years later, wearing a homemade uniform and carrying a “World Passport” he had printed himself, Davis traveled to India. Necessity was helping him to become adept at intimidating low-level bureaucrats and exploiting the local media. His discussions with border officials were often hilarious, exposing the arbitrary rules and artificial boundaries of nations. But once inside country, he shifted focus to study with a Buddhist guru. The break also helped clarify his mission and prepare him for the next phase of the journey.
At this point, for Davis, world government already existed. After all, he had announced its formation in a 1953 declaration. Before a small audience in Ellsworth, Maine, he had called it the World Government of World Citizens, and explained that its legitimacy was based on three laws – one God, one world, and one humankind. And although he was only one person, all humans were potential world citizens. They just needed to “claim their rights and assume their responsibilities.”  Yet Davis also understood that many more people would have to reach the same awareness before things began to change.
In the early years, the tactics Davis used sometimes put not only his freedom but his life at risk. A year after his stay in India, for instance, Davis was almost shot before he could show his passport in Germany. It happened in Berlin after he left his bicycle near a barbed wire fence that separated East from West. Crawling under the wire in a pre-dawn mist, he was caught by several gun-toting police, arrested, interrogated, and ultimately put on a train to West Germany.
As the scenery passed he could not help but remember another view of the same countryside --- from the cockpit on his bomber during the war – and also what the experience had taught him. “We are born as citizens of the world,” he realized. “But we are also born into a divided world, a world of separate entities called nations. We may regard each other as friends, and yet we are separated by wide, artificial boundaries.”
Garry Davis spent the rest of his life trying to change that. One of his main strategies was to develop and issue documents, including the extraordinary World Passport. Recognized on a case-by-case basis by more than 100 countries – and officially by a handful – the passport has evolved into a convincing document in seven languages, issued to at least a million people over the years. Davis often argued that the right to travel, outlined in the passport, was grounded in the Universal Declaration of Human Rights.
Just as important as the fundamental right involved, however, was knowing how to use tools like the passport and other identity documents. As explained in Passport to Freedom, a book we co-authored in 1991, many nations have accepted World Passports and other documents issued by the World Service Authority, the non-profit organization Davis founded. But step one in effectively using them is to know what you are talking about. “The official, as part of the machine, knows little more than his narrow function and the regulations on which it is based. When you ask questions, you shift the burden of responsibility.”
Other steps include remaining cool, going to the top of the chain of command as soon as possible, always assuming you are right, keeping track on your paperwork, choosing the right words, looking good, and remaining firm. It’s basic but solid advice for anyone who has to deal with arbitrary authority. That said, over the years Davis refined the approach into a long-running piece of political performance art that he repeatedly took around the world.
In April 1984, for example, he arrived at Tokyo’s Narita Airport. At this point Davis was already in his 60s and could look like an elder statesman if he wished. Determined as ever, he was nevertheless detained after a mind-boggling exchange and told he could not enter the country. The next night, however, when the authorities attempted to put him on a return flight, he protested so effectively that the captain threw him off the plane.
A day later he escaped from detention and went downtown for public interviews at a daily newspaper.
When he was caught, the Japanese put Davis in detention, then on a plane for Seattle. There he was told that he would be placed on trial for entering the US illegally. He was now classified as an “excludable alien,” the officials claimed. It was beginning to look like he was trapped in a Kafka-like tale.
Two weeks after setting out for Japan, Davis stood before a US immigration judge. Both governments were refusing to admit him. ‘Quite a dilemma,” mused Judge Jones. But before he could decide how to handle the convoluted case, a telex arrived from Washington, DC. The news was almost inconceivable: Davis’ entire file had somehow been “lost.”
As a result the Seattle case was closed and the world citizen was free to go.
Five years later Davis was back in Japan. This time he opened an office in Tokyo and helped many undocumented workers and Chinese students who were fleeing repression. For them the World Passport and other documents meant proof of identity, access to a job, or a way to get from one place to another.
During this extended visit, Davis met the Japanese Prime Minister and had a private, personal talk with Andrei Sakharov. The Cold War was winding down then, and the Soviet Union would soon dissolve. Like Davis, Sakharov had reached the conclusion that it was time to move beyond nationalism and create a democratic world government.
After more than a year of looking the other way, however, Japanese Immigration eventually decided to pounce and had Davis arrested in July 1990. He was jailed for several weeks and questioned each day by the same immigration official who had handled his original case more than five years earlier. Gradually, Davis managed to convince this man his claim to world citizenship made sense. The Japanese deported him anyway.
When Davis landed in Los Angeles in August 1990, he fully expected to be arrested again. This time he was handled a letter instead. It announced that the Secretary of State had unilaterally decided to classify him as a “parolee in the public interest” and let him go.
During this period Davis moved to Vermont, a safe haven that remained his home for the rest of his life. However, he never stopped fighting for his vision for a world without borders. In July 2013, just a week before he died, Davis was still finding ways to spread the word. At this point NSA whistleblower Edward Snowden was trapped in a Moscow airport after his US passport was revoked. For Davis the response was obvious: the World Service Authority would issue him one.
The World Passport did not reach Snowden, but Davis made his point one last time. “All we're doing is conforming to the idea that human rights must be protected by law," he told reporters. "The world passport opens the door. Anyone can get it; everyone is a human being, everyone has a right to travel.'"
Greg Guma knew Garry Davis for more than 20 years, co-authoring and editing two of his books, Passport to Freedom: A Guide for World Citizens and Dear World: A Global Odyssey. A memorial service for Davis will be held at Burlington City Arts in Burlington, Vermont on January 5, 2014 at 3 p.m.

Federal Judge Bombshell: Obama Admin Aids/Abets Human Traffickers (Video & Ruling Embedded)

By Susan Duclos

Judge Andrew S. Hanen of Brownsville, Texas dropped a massive bombshell on the Obama administration saying the admin's immigration policies are "completing the criminal mission" of human traffickers "who are violating the border security of the United States" and assisting a “criminal conspiracy in achieving its illegal goals."

Furthermore the judge called the Obama administration's actions "criminal and unconscionable."

Direct quotes from the ruling in U.S. v. Nava-Martinez, which will be embedded below, accusing the Obama administration of aiding and abetting human traffickers, includes:

"By fostering an atmosphere whereby illegal aliens are encouraged to pay human smugglers for further services, the Government is not only allowing then to fund the illegal and evil activities of these cartels, but is also inspiring them to do so."
[...]
"The DHS should enforce the laws of the United States -- not break them."

Below is the news report on this ruling and beneath that is the short ruling that should be read in full to see the extent of condemnation the judge delivered to the Obama administration policies.

Profile of a Racist Zionist State

Profile of a Racist Zionist State

by Stephen Lendman

Israel is no democracy. It deplores democratic values. It ignores rule of law principles. Non-Jews aren't wanted. Muslims are ruthlessly persecuted.

They're terrorized. Praying to the wrong God is criminalized. Last week was like all others. Israeli soldiers murdered 29-year old Odeh Jihad Hamad in cold blood.

He was well inside Israel's imposed border zone with Gaza. Soldiers shot him in the head.

They prevented ambulance help from arriving for around 90 minutes. They wanted to be sure he died. They wanted him to suffer if it took time.

In Jerusalem, Palestinian resident Hadassah Ein Karem was on his donkey. He was traveling along a bypass road. It's adjacent to al-Isawiya village.

He was in plain sight. A settler ran him over. He was critically injured. At Hadassah Ein Karem Hospital, he was pronounced dead.

In Jenin's refugee camp, Israeli soldiers fired on nonthreatening Palestinian civilians. One was killed. Another six were wounded.

Israeli naval forces opened fire on Palestinian fishermen. They were nonthreatening. They were in Gazan waters. It didn't matter.

These type incidents happen often. Sometimes Israel damages fishing vessels. Other times they're confiscated. This time fishing equipment was stolen.

Israel apparently considers fishing a crime. Harming Palestinian well-being goes unpunished. Impunity is rubber-stamp.

On Friday, Israeli soldiers attacked peaceful Palestinian protesters in Bilin, al-Masara and Nabi Saleh villages. They used rubber bullets, tear gas, and stun grenades. Dozens were injured.

Israel considers all protests illegal. Palestinians want occupation ended. They want stolen land returned.

They want Israel's apartheid wall demolished. They want the right to live free on their own land in their own country.

They want world community support. They want Israel held accountable for high crimes of war and against humanity. They want long denied justice.

Ta'Ayush is an Arab Jewish partnership. It seeks togetherness "to end the Israeli occupation and to achieve full civil equality through daily non-violent direct-action."

Ta'ayush is Arabic. It means living together. It's a grassroots movement. It was founded in fall 2000. Activist Arabs and Jews work cooperatively.

They're "surrounded by walls and barbed wire: the walls of segregation, racism, and  discrimination between Jews and Arabs within Israel; the walls of Apartheid, closure and siege encircling the Palestinians in the occupied West Bank and Gaza  Strip; and the wall of war surrounding all inhabitants of Israel, so long as Israel remains an armed fortress in the heart of the Middle East," says Ta'ayush.

Its members work actively against racism and segregation. They're building "a true Arab-Jewish partnership."

They "strive for a future of equality, justice and peace."

They do so "through concrete, daily, non-violent actions of solidarity to end the Israeli occupation of the Palestinian territories  and to achieve full civil equality for all."

The lives and well-being of millions of occupied Palestinians have been "subordinated to Israeli interests for more than 40 years."

On Sunday, Haaretz columnist Amira Hass headlined "IDF barred Israeli activists from West Bank."

Ta'ayush members came to protect Palestinian farmers. They've been doing it for 13 years. They accompany "dozens of (West Bank) Palestinian shepherds and farmers...every Saturday…"

They do it to protect them from extremist settlers. They attack Palestinian farmers in their fields. They destroy their crops.

They commit other forms of vandalism. They commit violence. They do so with virtual immunity. Israeli security forces do nothing to stop them.

On Saturday, soldiers "separated the cars of Ta'ayush members from the rest of the Israeli cars entering the West Bank through the checkpoint on the Tunnel Road (Route 60) and the Betar checkpoint," said Hass.

When they reached it south of Jerusalem, Border Police stopped them. They "showed them a military order."

It was "signed by the commandeer of the Etzion Regional Brigade, Col, Amit Yamin, restricting their movements."

Soldiers told Ta'ayush activists they were waiting for another military order to arrive. They ordered them to remain at Betar checkpoint until it did.

When it failed to come, activists "passed through the checkpoint on foot. Soldiers and police officers pursued them."

Some Ta'ayush members reached south Hebron Hills. They were shown documents declaring Palestinian land closed military zones.

Judea Brigade commander Col. Avi Balut signed them. His order read: "No person shall pass through the checkpoint except with permission given by me or a person authorized by me."

Activists and Palestinian landowners were ordered out. An IDF spokesman said:

"The IDF is responsible for maintaining law and order in Judea and Samaria."

"Every week there are provocative gatherings in the area of Sussia and Mitzpe Yair, which have at times led to violent confrontations between residents of the area and even with the security forces."

"In accordance with the assessment and security considerations, it was decided not to allow free passage to all the buses, which, according to the assessment, were carrying people who were liable to disrupt public order, and to examine their entrance individually at a number of checkpoints in the southern area of Judea and Samaria."

Palestinians are barred from their own land. Activists trying to help them are blocked. Other times they're attacked.

Often they're injured, arrested, and detained. State terror is official Israeli policy. So is institutionalized racism.

Israel ruthlessly persecutes African migrants. They come seeking safe haven asylum. They fled repressive countries. Israel treats them like criminals.

International law protects refugees and asylum seekers. Article I of the 1951 UN Convention Relating to the Status of Refugees calls them:

"Person(s) who owning to a well-founded fear of being persecuted for reasons of race, religion, nationality, membership of a particular social group or political opinion, is outside the country of their nationality, and is unable to or, owing to such fear, is unwilling to avail him/herself of the protection of that country."

Post-WW II, the UN High Commissioner for Refugees (UNHCR) was established to help them.

To gain legal protection, they must:

  • be outside their country of origin;

  • fear persecution;

  • be harmed or fear harm by their government or others;

  • fear persecution for at least one of the above cited reasons; and

  • pose no danger to others.

Israel's 1950 Law of Return grants all Jews worldwide the right to emigrate to Israel. Non-Jews aren't wanted. No refugee law exists.

Israel rejects non-Jewish refugees. It scorns them. It persecutes those arriving. Their fundamental rights are denied.

They're summarily detained. They held for extended periods. It's under extremely harsh conditions.

International law legally and morally obligates Israel to treat refugees humanely. Official state policy brutalizes them.

Israel's Infiltration Law is draconian. It calls non-Jewish migrants and asylum seekers criminals. They face harsh detention without trials or deportation.

Anyone caught helping them is liable. They face up to 15 years imprisonment. They do so for being good samaritans.

The Association for Civil Rights in Israel calls its Infiltration Law brazenly undemocratic and shameful. It's "draconian and immoral." Its "entire purpose is to deter refugees from entering Israel."

It "blatantly disregards Israel's most basic commitments as a member of the community of nations and as a signatory to the Convention Relating to the Status of Refugees."

"The State of Israel has the right to protect its borders, but not by trampling human rights and ignoring democratic values."

Israel's longstanding inhospitable history is appalling. African migrants perhaps suffer most.

Even some Jewish ones are unwelcome. Israel wants white ones. Black ones are persecuted like Muslims.

On December  19, dozens of African migrants left Holot detention center. They marched toward Be'er Sheva. They did so in protest.

Immigration Authority officers arrested many. They returned them to detention. Others scattered into desert areas. Security forces are pursued them.

Migrants began marching after hundreds of other detainees did so toward Jerusalem. They did it to protest Israeli repression.

They didn't seek safe haven status to be persecuted. "Our stance is clear," said one migrant. "Either grant us asylum or give us to an international refugee agency."

Haaretz columnist Gideon Levy calls Israel's problem "racism." It's a separate, unequal society. It mocks fundamental human and civil rights.

It's one of the world's most repressive states. It considers Muslims existential threats. It treats African migrants the same way.

Netanyahu was never "caught expressing compassion," said Levy. Interior Minister Gideon Sa'ar "seems to enjoy being cruel."

He "project(s) the kind of attitude that in Europe comes (from) gangs of skinheads."

Israeli society "is so tainted by racism that the agitators of the extreme right reflect its spirit almost without question."

"Africans must be gotten rid of, in any way or by any means," they believe. They're not "really human beings." There's "no place for them here." They "bring us only crime and disease."

It's OK "to abuse them, humiliate them and increase their misery without limit." Rule of law principles don't matter.

Israel's problem isn't security. It's Zionist fanaticism. It's racism writ large. It's believing Jews alone have rights.

Others don't deserve them. Human dignity doesn't matter. Right-wing extremists govern Israel. They menace the entire region. They threaten world peace.

They're waging slow-motion genocide on Palestine. Crimes of war and against humanity continue unabated. Anyone not Jewish is fair game.
