Tuesday, July 1st, 2008 الثلاثاء ، اول يوليو ، 2008 Xinhua / شينخوا / | UN human rights expert Philip Alston on Monday called on the United States to take immediate steps to improve its system of military justice and to ensure that the death penalty is applied fairly and justly in states such as Alabama and Texas. | خبير فى حقوق الانسان التابعة للأمم المتحدة فيليب الستون يوم الاثنين ودعا الولايات المتحدة الى اتخاذ خطوات فورية لتحسين نظام القضاء العسكري والى ضمان ان عقوبة الاعدام تطبق بانصاف وبالعدل في ولايات مثل ألاباما وتكساس.
Alston, the special rapporteur on extra judicial, summary or arbitrary executions, had just concluded an official visit to the United States during which he met with federal and state officials, judges, and civil society groups in Washington DC, New York, Alabama, and Texas. الستون ، المقرر الخاص المعني خارج نطاق القضاء او باجراءات موجزة او تعسفا ، واختتم لتوه زيارة رسمية الى الولايات المتحدة التقى خلالها مع المسؤولين المستوى الاتحادي ومستوى الولايات ، والقضاة ، وجماعات المجتمع المدني في العاصمة واشنطن ، نيويورك ، ألاباما ، و ولاية تكساس.
In a preliminary statement after the visit, Alston noted that it was now widely acknowledged that innocent people are likely to have been executed in the past, and he was critical of how authorities in Alabama and Texas have responded to this fact. في البيان الاولي بعد الزيارة ، والستون لاحظ انه من الآن على نطاق واسع أن الأبرياء من المرجح ان يكون نفذ حكم الاعدام في الماضي ، وكان ينتقد كيفية السلطات في ولاية تكساس وألاباما ، ورد على هذه الحقيقة.
”When we are talking about a situation in which innocent people have probably been executed, you would expect a greater sense of urgency about reforming the criminal justice system,” Alston said. "عندما كنا نتحدث عن الحاله التي الابرياء أعدموا على الارجح ، وتتوقع ان زيادة الاحساس بالحاجه الملحه الى اصلاح نظام العدالة الجناءيه" ، وقال الستون.
Alston recommended that reconsideration be given to the system of electing judges in both states, that severe deficiencies in the right to counsel for capital defendants be addressed, and that each state undertake a systematic inquiry into the shortcomings ofits existing criminal justice system. الستون اوصي بالنظر في اعادة نظام انتخاب القضاة في كل من الدول ، ان اوجه القصور الشديدة في ذلك الحق في الاستعانة بمحام لرأس المال ان تعالج المدعى عليهم ، وعلى كل دولة ان تتعهد منهجيه التحقيق في أوجه القصور القائمة ofits نظام العدالة الجناءيه.
He also called on the US Congress to enact legislation that would permit federal courts to review all issues in state and federal death penalty cases on the merits. كما دعا الكونغرس الاميركي الى سن التشريعات التي من شأنها ان تتيح المحاكم الاتحادية لاعادة النظر في جميع القضايا والدولة الاتحادية في قضايا عقوبة الاعدام على اساس الوقائع.
Alston was especially critical of Texas for failing to review the cases of foreign nationals on its death row who had been deprived of the right to consular assistance from their home countries. الستون ومن الامور الحاسمه بصفة خاصة لعدم ولاية تكساس لاستعراض قضايا الرعايا الاجانب المحكوم عليهم بالاعدام على من حرموا من الحق في المساعدة القنصلية من بلدانهم الاصليه.
He noted that the United States had already formally recognized that there was a legal obligation to review these cases but that Texas had done nothing. واشار الى ان الولايات المتحدة قد اعترفت رسميا بأن هناك التزاما قانونيا على اعادة النظر في هذه الحالات ولاية تكساس ولكن ذلك لم تفعل شيئا.
”It would be very easy for Texas to follow the law in these cases, but it has so far refused to do so for no reason other than proving that it can defy the federal government and international law,” he said. "انه سيكون من السهل جدا لتكساس لمتابعة القانون في هذه الحالات ، ولكنها رفضت حتى الان ان تفعل ذلك بدون اي سبب آخر غير اثبات أنها يمكن أن تتحدى الحكومة الاتحادية والقانون الدولي".
In relation to prisoners in Guantanamo Bay, Alston called on the government to release the results of investigations and autopsies into the deaths of five prisoners who died in 2006 and 2007. بالنسبة الى السجناء في خليج غوانتانامو ، الستون ودعا الحكومة الى الافراج عن نتائج التحقيقات وعمليات التشريح في وفاة خمسة من السجناء لقوا حتفهم في عامي 2006 و 2007.
He condemned the unremitting failure to provide fair trial guarantees in the proceedings against six “alien enemy combatants” and concluded that any death sentence imposed on the basis of such trials would clearly be in violation of international law. وندد تني عدم توفير ضمانات المحاكمه العادله في الاجراءات الموجهة ضد ستة من "المقاتلين الاعداء الاجانب" ، وخلص الى ان اي حكم بالاعدام فرضت على أساس من الواضح ان تلك المحاولات لن يكون انتهاكا للقانون الدولي.
Alston also called on the government to publish information on civilian casualties in its operations in Afghanistan and Iraq and to make it possible for US citizens, as well as Afghans and Iraqis, to follow the workings of the military justice system. الستون كما دعا الحكومة الى نشر معلومات عن وقوع اصابات بين المدنيين في عملياتها في افغانستان والعراق ، والى ان يمكن لمواطني الولايات المتحدة ، فضلا عن الافغان والعراقيين ، لمتابعة اعمال نظام القضاء العسكري.
While some important steps have been taken to ensure the accountability for killings at the hands of private military contractors, more needs to be done, he said. وفي حين ان بعض الخطوات الهامة التى اتخذت لضمان مساءلة عن عمليات قتل على ايدي المقاولين العسكريين من القطاع الخاص ، هناك حاجة الى القيام بالمزيد ، كما قال.
Alston said that the US Department of Justice has so far failed miserably in carrying out its obligations to prosecute private contractors and others. الستون : قال ان وزارة العدل الامريكية قد فشلت فشلا ذريعا حتى الآن في تنفيذ التزاماتها لمحاكمة المتعاقدين من القطاع الخاص وغيرها.
”It’s the Department of Justice’s job to prosecute private security contractors who commit unlawful killings, but it has done next to nothing,” Alston said. "انه وزارة العدل وظيفة الأمن الخاصة لمحاكمة من المقاولين في ارتكاب اعمال القتل دون وجه حق ، ولكنه فعل القادم الى لا شيء ،" وقال الستون.
