Dictatorial Power on War and Treaties على السلطة الديكتاتوريه والحرب والمعاهدات

Hornberger جاكوب hornberger غ. | If anyone still has any doubts about whether President Bush is exercising powers that any self-respecting dictator would relish, all he has to do is consider the military pact that Bush is entering into with Iraq. | اذا كان اي شخص لا يزال أي شكوك بشأن ما اذا كان الرئيس بوش ممارسة الصلاحيات التي تحترم نفسها أي دكتاتور من شأنه ان المذاق ، واضاف ان كل ما فعله هو ان تنظر في حلف عسكري ان بوش هو الدخول مع العراق. The pact involves the continued US military occupation of Iraq as well as a date on which US military forces will be expected to exit the country. الميثاق ينطوي على استمرار الاحتلال العسكرى الامريكى للعراق فضلا عن التاريخ الذي القوات العسكرية الامريكية ومن المتوقع ان الخروج من البلاد.
Let’s first place things in the context of the US Constitution, the higher law that the American people have enacted that controls the conduct of federal officials, including the president. دعنا اولا الأمور في سياق دستور الولايات المتحدة ، القانون الاعلى ان الشعب الامريكى قد سنت الذي يتحكم في سلوك المسؤولين الاتحاديين ، بمن فيهم الرئيس.
One provision of the Constitution requires the president to secure a declaration of war from Congress prior to waging war against another nation. حكم واحد من الدستور على رئيس لتأمين اعلان حرب من الكونغرس قبل شن الحرب ضد دولة أخرى. With respect to Iraq, everyone knows that Bush refused to do that. وفيما يتعلق بالعراق ، ويعلم الجميع ان بوش رفض ان يفعل ذلك. After unsuccessfully exploring the possibility of securing UN approval for his war (which is not in the Constitution), Bush unilaterally decided to wage war on Iraq without first securing the constitutionally required congressional declaration of war. بعد نجاح استكشاف امكانيه الحصول على موافقة الامم المتحدة لحربة (وهي ليست في الدستور) ، من جانب واحد قرر بوش شن حرب على العراق دون الحصول اولا المطلوبة دستوريا الكونغرس إعلان الحرب.
The Constitution also provides that the president shall have the “Power and with the Advice and Consent of the Senate, to make Treaties, provided two thirds of the Senators present concur.” وينص الدستور ايضا على ان الرئيس يجب ان يكون "مع السلطة وبمشوره وموافقة مجلس الشيوخ ، لجعل المعاهدات ، وقدمت ثلثي اعضاء مجلس الشيوخ ان توافق على هذا."
So, is President Bush complying with that provision of the Constitution with respect to his military pact with Iraq? بذلك ، هو الرئيس بوش ان تمتثل لاحكام الدستور فيما يتعلق بلدة حلف عسكري مع العراق؟
Why should he? ولماذا عليه ان يكون؟ If the Congress and the American people don’t care that he violates one important provision of the Constitution, why should the president care whether he violates other important provisions? واذا كان الكونغرس والشعب الامريكى لا تهتم انه ينتهك احد اهم احكام الدستور ، لماذا ينبغي ان يكون الرئيس والرعايه ما إذا كان ينتهك احكام هامة اخرى؟
The president’s spokesman, Gordon Johndroe, set forth the president’s position at a recent press conference: “So it’s not a treaty, so it would not require Senate ratification or anything like that. وقال المتحدث باسم الرئيس ، غوردون johndroe ، المنصوص عليها موقع الرئيس مؤخرا في مؤتمر صحافي : "اذا ليست معاهدة ، لذلك فانه لا تحتاج الى تصديق مجلس الشيوخ او اي شيء من هذا القبيل. It’sa bilateral agreement that would provide the authorities for our troops to operate in Iraq.” It'sa الاتفاق الثنائي من شأنه ان يوفر للسلطات لقواتنا للعمل فى العراق. "
So, there you have it. ذلك ، هناك لديك. We now live in a country in which the ruler has the power to send the entire nation into war on his own initiative and then unilaterally bind the entire nation with a long-term military agreement with the conquered nation without any legislative approval. اننا نعيش الان فى البلد الذى الحاكم لديه القدرة على ارسال الامة بأسرها الى حرب بمبادره منه بعد ذلك من جانب واحد وتربط الامة كلها مع عسكريا طويل الامد لاتفاق مع فتح أمة دون اي موافقة تشريعيه.
If that’s not dictatorial power, what is? إذا كان هذا لا ديكتاتوريه السلطة ، ما هي؟
Oh, by the way the Iraqi president is submitting the proposed military agreement with Bush to the Iraqi Parliament, as required by Iraqi law. أوه ، بالمناسبه الرئيس العراقي هو تقديم المقترح للاتفاق العسكري مع بوش إلى البرلمان العراقي ، على النحو المطلوب بموجب القانون العراقي.
