I am writing to you in respect of the current Automatic Number Plate Recognition mass surveillance scheme, which was announced by Home Office Minister Tony McNulty on 17th July 2007, involving “real time” “bulk data transfers” between the London Congestion Charge system run by Transport for London and the Metropolitan Police Service. أكتب اليكم فيما يتعلق الحالية التلقائي لوحة عدد الاعتراف الجماعي مخطط المراقبة ، والتي أعلنت من جانب وزارة الداخلية على وزير توني مسنولتي 17th يوليو / تموز 2007 ، التي تنطوي على "الوقت الحقيقي" "معظم عمليات نقل البيانات" بين لندن نظام رسم الازدحام التي تديرها ونقل الى لندن لداءره شرطة العاصمة.

” The Minister of State, Home Department (Mr. Tony McNulty) : I would like to inform the House that my right hon. Friend the Home Secretary has signed a certificate to exempt Transport for London (TfL) and the Metropolitan Police Service (MPS) from certain provisions of the Data Protection Act 1998 to facilitate the bulk transfer of Automatic Number Plate Recognition (ANPR) data from TfL to the MPS. صديق وزير الداخلية قد وقعت شهادة اعفاء النقل الى لندن (tfl) ، وداءره شرطة العاصمة (النواب) من بعض احكام قانون حمايه البيانات لعام 1998 لتسهيل نقل الجزء الاكبر من عدد التلقائي لوحة الاعتراف (anpr) لبيانات من tfl وأشار النواب. The Commissioner of the Metropolitan Police believes that it is necessary due to the enduring, vehicle-borne terrorist threat to London. مفوض شرطة العاصمة وتعتقد انه من الضروري نظرا لبقاء ، وسيلة تنقلها الى لندن لتهديد ارهابي. The MPS requires bulk ANPR data from TfL’s camera network in London specifically for terrorism intelligence purposes and to prevent and investigate such offences. النواب يتطلب anpr الجزء الاكبر من البيانات tfl كاميرا الشبكه في لندن على وجه التحديد لاغراض الاستخبارات والارهاب لمنع هذه الجرائم والتحقيق فيها. The infrastructure will allow the realtime flow of data between TfL and the MPS.As one of the conditions of this certificate, the MPS will provide an annual report to the Information Commissioner so that he can satisfy himself that the personal data processed under the certificate is required for the purposes of safeguarding national security, and that any processing that is undertaken other than under an exemption set out in the certificate is carried out in compliance with the Data Protection Act 1998. البنية التحتية سيسمح الحقيقي تدفق البيانات بين tfl mps.as وشرط من شروط هذه الشهاده ، والنواب ستقدم تقريرا سنويا الى مفوض المعلومات ليستطيع ان يرضى لنفسه ان البيانات الشخصيه المجهزة بموجب الشهاده لازمة لاغراض حمايه الأمن الوطني ، وان اي معالجة اخرى ان يجري في اطار من الاعفاء المنصوص عليه في الشهاده تتم وفقا للقانون حمايه البيانات لعام 1998.

Friend the Home Secretary will review the operation of the certificate in three months time when the Commissioner of the Metropolitan Police provides her with a separate, interim report so that she can be personally satisfied that the certificate is being operated in accordance with the agreement and that the privacy of individuals is protected. صديق وزير الداخلية وسوف يستعرض العملية للشهادة ثلاثة اشهر في وقت كانت فيه مفوض شرطة العاصمة وتوفر لها مع مستقل ، حتى أن التقرير المؤقت وقالت انها يمكن ان تكون شخصيا مقتنع بأن شهادة يجري تشغيله وفقا للاتفاق الذي وان الحياة الخاصة للافراد محميه. In the coming months, proposals will be developed and discussed across Government to ensure that bulk ANPR data-sharing with the police is subject to a robust regulatory regime which ensures reasonable transparency and scrutiny.” وفي الأشهر المقبلة ، وسوف يتم وضع مقترحات وتناقش عبر الحكومة على ضمان ان معظم anpr لتبادل البيانات مع الشرطة يخضع لقوى النظام الرقابي الذي يضمن الشفافيه والتدقيق معقولة ".

This is obviously far more than a simple Data Protection Act section 29 Notice request for details about a particular suspect vehicle. ومن الواضح ان هذا هو اكثر بكثير من مجرد قانون حمايه البيانات الباب 29 طلب مهلة للاطلاع على تفاصيل معينة عن المركبه المشبوهة. The use of Ministerial Certificates must mean Mass Surveillance, presumably on a 24/7 basis, outside of the normal Congestion Charge enforcement period ie also at night, at weekends and on public holidays, to cover what would otherwise be “excessive data processing” for a purpose other than which the data was originally collected, without explicit personal consent, thereby flouting the fundamental Principles of Data Protection. استخدام شهادات الوزاري يجب ان تعني الكتلة المراقبة ، ومن المفترض على 24 / 7 الاساس ، من خارج العاديه رسم الازدحام انفاذ اي فترة في الليل ايضا ، في عطلات نهاية الاسبوع والعطلات الرسمية ، لتغطية ما يمكن ان يكون خلاف ذلك "الافراط في معالجة البيانات" لل غرض غير البيانات التى تم جمعها فى الاصل ، دون موافقة صريحة الشخصيه ، وبالتالي خرق للمبادئ الاساسية لحمايه البيانات.

I note that there is no mention in the Ministerial Statement of the Regulation of Investigatory Powers Act 2000, which surely must also apply to this Mass Surveillance project, especially in the light of your comments on Automatic Number Plate Recognition in your first Annual Report, أود أن أشير إلى أن ليس هناك اي ذكر في البيان الوزاري من تنظيم لسلطات التحقيق لعام 2000 ، التي بالتأكيد يجب ان تنطبق ايضا على مراقبة هذا المشروع الجماعي ، لا سيما في ضوء تعليقاتكم على عدد التلقائي لوحة الاعتراف في التقرير السنوي الأول الخاص بك ،

“11.3 Improvements in technology continue to enhance the capability of those charged with the responsibility of tackling crime. "11،3 التحسينات فى التكنولوجيا من اجل تعزيز قدرة تلك المكلفه بمسؤولية التصدي للجريمه. Have you given your permission for this Mass Surveillance scheme to go ahead, which must catch vast numbers of innocent people and vehicle movements, contrary to the principle of narrowly targeted, proportionate, lawful surveillance under RIPA ? هل أذن منك ونظرا لهذا المخطط المراقبة الجماعية من اجل المضي قدما ، التي يجب ان الصيد اعداد كبيرة من الابرياء وتحركات المركبات ، خلافا لمبدأ ضيقة المستهدفة ، متناسبه ، المشروعة في اطار القانون المنظم لسلطات التحقيق والمراقبة؟

He notes your interest in these matters but does not think it appropriate to answer your questions. ويلاحظ اهتمامك في هذه الامور ولكن لا اعتقد انه من المناسب للإجابة على اسئلتكم.

How is this supposed to represent adequate or proper “independent scrutiny” of the vast powers, and function creep of secret state surveillance snooping, which is increasingly and wastefully being directed at millions of innocent people , rather than being targeted proportionately and narrowly at actual terrorist suspects or serious organised criminals ? كيف يتم هذا من المفترض ان تمثل الكافي أو المناسب "الفحص المستقل" للسلطات واسعة ، وتسلل من وظيفة الدولة المراقبة السرية التطفل ، والذي يزداد بشكل مبذر في توجه الملايين من الأبرياء ، بدلا من ان تكون موجهة في نطاق ضيق وبشكل متناسب الارهابيه الفعليه المنظمه الخطيره المشتبه فيهم او المجرمين؟

Is it any wonder that people are frustrated by, and resentful of, the people and systems which purport to “protect” the public, whilst maintaining their freedoms and liberties, but which do not do so in practice ? فهل من الغريب ان الناس يشعرون بالاحباط من جانب ، واستياء من مجلس الشعب والنظم التي تهدف الى "حمايه" للجمهور ، مع الحفاظ على حرياتهم والحريات ، ولكنها لا تفعل ذلك في الواقع؟
