UK must pursue war crimes investigations يجب ان تسعى المملكه المتحدة لجرائم الحرب التحقيقات
Amnesty International UK today expressed disappointment that despite six months of investigation, the United Kingdom authorities have not been able to amass sufficient evidence to determine whether it is possible to mount a successful prosecution of a Sri Lankan commander suspected of torture, hostage taking and war crimes. Vinavaamoorthi Muraliitharan, commonly known as Colonel Karuna, is suspected of abducting hundreds of teenagers to serve as child soldiers, and of having tortured, taken as hostage and killed hundreds of civilians in Sri Lanka. منظمة العفو الدولية في المملكه المتحدة اليوم عن خيبة امله انه على الرغم من ستة اشهر من التحقيق ، فان سلطات المملكه المتحدة لم تتمكن من حشد ما يكفي من الادله لتحديد ما اذا كان من الممكن لجبل لمحاكمة ناجحه من سري لانكا قائد يشتبه في التعذيب واحتجاز الرهائن وجرائم الحرب . Vinavaamoorthi muraliitharan ، المعروف باسم العقيد karuna ، يشتبه باختطاف مئات من المراهقين لتكون بمثابة الجنود الأطفال ، وبعد تعذيب ، واتخاذ رهائن وقتل المئات من المدنيين فى سرى لانكا.
Colonel Karuna was a prominent leader of the Liberation Tigers of Tamil Eelam (LTTE), an armed opposition group fighting for an independent Tamil homeland in Sri Lanka. وكان العقيد karuna قيادي بارز من جبهة تحرير نمور التاميل ايلام (جبهة نمور تحرير تاميل ايلام) ، وهي جماعة معارضة مسلحه تقاتل من أجل وطن مستقل التاميليه في سري لانكا. He left the LTTE to set up his own splinter group, the Tamileel Makkal Viduthalai Pulikal, or People’s Liberation Tigers of Tamil Eelam (TMVP), which also has a political wing. غادر نمور تحرير تاميل ايلام لإقامة مجموعة منشقه عن بلده ، tamileel makkal viduthalai pulikal ، او الشعبية لتحرير نمور تاميل ايلام للtmvp) ، الذي يمتلك ايضا الجناح السياسي. Since March 2004, the group appears to have been operating with the support of the Sri Lankan Army to challenge the LTTE in eastern Sri Lanka. ومنذ اذار / مارس 2004 ، ويبدو ان المجموعة كانت تعمل مع وبدعم من جيش سري لانكا للطعن في جبهة نمور تحرير تاميل ايلام في شرق سري لانكا.
Colonel Karuna was residing in the United Kingdom when he was taken into custody by British authorities in November last year on charges of immigration offences. العقيد karuna كان يقيم في المملكه المتحدة عندما كان في الاحتجاز من قبل السلطات البريطانية في تشرين الثاني / نوفمبر من العام الماضي بتهمة جرائم الهجره.
According to reports, Colonel Karuna was released from prison and transferred to an immigration detention centre late last night pending possible deportation. ووفقا للتقارير ، كان العقيد karuna اطلق سراحه من السجن ونقل الى مركز احتجاز المهاجرين فى وقت متأخر الليلة الماضية ممكن في انتظار ترحيلهم.
Under international law, the UK must conduct prompt, thorough, independent and impartial investigations of allegations of torture, hostage taking and war crimes, including child recruitment and the use of child soldiers. وبموجب القانون الدولى ، يجب ان المملكه المتحدة اجراء فوري وشامل ومستقلة وحياديه التحقيقات في ادعاءات التعذيب واحتجاز الرهائن ، وجرائم الحرب ، بما فيها تجنيد الاطفال واستخدام الجنود الاطفال.
However, Amnesty International understands that the fact that the UK does have jurisdiction over war crimes and crimes against humanity was not made clear to victims and prospective witnesses. بيد ان منظمة العفو الدولية ان تدرك حقيقة ان المملكه المتحدة لا تكون لها ولاية قضائية على جرائم الحرب والجرائم المرتكبه ضد الانسانيه لم يكن واضحا للضحايا والشهود المحتملين.
Kate Allen, Director of Amnesty International UK, said: كيت الين ، مديرة منظمة العفو الدولية في المملكه المتحدة ، وقال :
‘The police and the Crown Prosecution Service must make every effort to encourage anyone with information about any such crimes to come forward with evidence, by providing them with effective guarantees of their security. 'الشرطة والنيابة العامة يجب ان التاج بذل كل جهد ممكن لتشجيع أي شخص مع معلومات حول وقوع مثل هذه الجرائم الى ان تبادر بتقديم الادله ، من خلال تزويدها ضمانات فعالة لامنها.
‘Without such assurances witnesses may be reluctant to relay information about alleged crimes that the UK authorities are obliged to investigate.’ 'الشهود دون هذه الضمانات قد تحجم عن نقل المعلومات حول الجرائم المزعومه ان سلطات المملكه المتحدة ملزمة للتحقيق'.
Colonel Karuna, like anyone suspected of a criminal offence, is entitled to be presumed innocent, until and unless his guilt can be proved beyond reasonable doubt in a fair trial. العقيد karuna ، شأنها في ذلك شأن أي شخص يشتبه في جريمه جناءيه ، الحق في ان يعتبر بريئا ، وحتى انه مذنب ما لم يمكن اثبات لا يدع مجالا للشك في محاكمة عادلة. However, the organisation is aware of numerous allegations against him that merit thorough investigation. ومع ذلك ، فان المنظمه تدرك العديد من الادعاءات الموجهة اليه التي تستحق اجراء تحقيق شامل.
Amnesty International urges the authorities to investigate thoroughly, promptly, impartially and independently all allegations of crimes committed by Colonel Karuna and his forces including: منظمة العفو الدولية تحث السلطات على التحقيق بشكل دقيق ، على الفور ، نزيه ومستقل في جميع الادعاءات المتعلقة بالجرائم التي ارتكبها العقيد karuna وقواته بما في ذلك :
· Torture committed after March 2004 when Colonel Karuna is believed to have allied himself with the state armed forces التعذيب التي ارتكبت بعد آذار / مارس 2004 عندما karuna العقيد يعتقد ان التحالف نفسه مع القوات المسلحه للدولة
