{"id":97599,"date":"2013-12-10T00:07:54","date_gmt":"2013-12-10T00:07:54","guid":{"rendered":"http:\/\/rinf.com\/alt-news\/breaking-news\/new-york-times-reporters-sue-dhs-over-foia-requests\/"},"modified":"2013-12-10T01:02:15","modified_gmt":"2013-12-10T01:02:15","slug":"new-york-times-reporters-sue-dhs-over-foia-requests","status":"publish","type":"post","link":"http:\/\/rinf.com\/alt-news\/breaking-news\/new-york-times-reporters-sue-dhs-over-foia-requests\/","title":{"rendered":"New York Times Reporters Sue DHS Over FOIA Requests"},"content":{"rendered":"<p>Reporters want to ensure they weren&#8217;t \u201chaving their activities monitored by the government\u201d<\/p>\n<p><strong>Adan Salazar<\/strong><\/p>\n<p>The Department of Homeland Security is being sued by two New York Times reporters who say the agency failed to respond to FOIA requests following enhanced interrogations at New York&#8217;s JFK airport.<\/p>\n<p>Times journalists Mac William Bishop and Christopher Chivers were on their way to Turkey to cover the Syrian civil war when they claim they were \u201csubject to segregated questioning by DHS employees at JFK on May 24, 2013,\u201d a lawsuit obtained by <a href=\"http:\/\/www.courthousenews.com\/2013\/12\/09\/63547.htm\" target=\"_blank\">Courthouse News<\/a> states.<\/p>\n<p>\u201cSubsequently, on June 6, 2013, Mr. Bishop was subjected to further segregated questioning by DHS employees at JFK as he returned to the United States.\u201d<\/p>\n<p>Bishop and Chivers both filed FOIA requests to determine why they were detained. The DHS responded claiming they sent the requests to both the Immigration &amp; Customs Enforcement agency and the TSA, however the reporters&#8217; lawsuit states they \u201chaven&#8217;t heard Word One,\u201d according to Courthouse News.<\/p>\n<p>Bishop, in an appeal letter sent to the TSA, said this was \u201cinconceivable\u201d due to the fact that he&#8217;s \u201ca frequent international traveler.\u201d<\/p>\n<p>In the same letter, Bishop also claimed he physically witnessed his information being entered into a computer \u201cin a private room at JFK,\u201d but TSA says they lost that letter. \u201cHe sent it a copy of the letter through counsel, but that didn&#8217;t work either,\u201d reported Courthouse News.<\/p>\n<p>David McCraw, one of the attorneys representing The New York Times Company, says the reporters just want to see the FOIA requests to ensure they weren&#8217;t \u201ctargeted by DHS for special scrutiny.\u201d<\/p>\n<p>\u201cWe want to be sure that our journalists are not being targeted by DHS for special scrutiny or having their activities monitored by the government when they are engaged in reporting,\u201d McCraw said in a statement to <a href=\"http:\/\/www.politico.com\/blogs\/media\/2013\/12\/new-york-times-reporters-sue-dhs-179190.html\" target=\"_blank\">Politico<\/a>. \u201cDHS has failed to provide adequate responses to our FOIA requests seeking whatever information DHS employees were working from in initiating the questioning and whatever information they gathered in the questioning.
