May 5 also happens to<br \/>\n  be Cinco de Mayo, an annual celebration of Mexican heritage. The<br \/>\n  holiday is popular throughout the US, particularly in the<br \/>\n  southwestern states, and is related to the anniversary of<br \/>\n  a historical battle against French forces observed in the<br \/>\n  Mexican state of Puebla.\n<\/p>\n<p>\n  Administrators said they told the students to hide their clothing<br \/>\n  because of heightened stress and shouting matches between<br \/>\n  students on Cinco de Mayo in 2009 at the school, which is located<br \/>\n  approximately 20 miles from San Jose in central California. The<br \/>\n  students claim there was no evidence that their clothing had<br \/>\n  incited any tension and that &ldquo;<i>American schools cannot<br \/>\n  logically ban the American flag for any duration or reason<\/i>.&rdquo;\n<\/p>\n<p>\n  Mexican students told KSBW.com that they felt disrespected by the<br \/>\n  students&#8217; clear decision to coordinate their outfits. &ldquo;<i>We<br \/>\n  would never do that on the Fourth of July<\/i>,&rdquo; one student said.\n<\/p>\n<p>\n  &ldquo;<i>I did nothing wrong<\/i>,&rdquo; student Daniel Galli said in 2010.<br \/>\n  &ldquo;<i>I&#8217;m American and I&#8217;m proud to be American, so that&#8217;s why I<br \/>\n  wore it<\/i>.&rdquo;\n<\/p>\n<p>\n  Kevin Paulson, former editor in chief of USA Today and the<br \/>\n  current president of the First Amendment Center, told the<br \/>\n  Christian Science Monitor that the court case that followed<br \/>\n  touches on so-called the &ldquo;<i>viewpoint neutrality<\/i>.&rdquo; A speaker<br \/>\n  in public, for example, is permitted to espouse any belief in<br \/>\n  public, even ones that might be offensive. Students have not<br \/>\n  traditionally shared the same privilege.\n<\/p>\n<p>\n  &ldquo;The real oddity is that students wearing the same T-shirt on<br \/>\n  Memorial Day would be applauded, which makes it pretty tough on<br \/>\n  administrators to [define] whether an American flag T-shirt is<br \/>\n  subversive or patriotic,&rdquo; Paulson said.\n<\/p>\n<p>\n  The now-retired Chief Justice Hames Ware tossed the case from<br \/>\n  court in 2011, ruling that school administrators have a<br \/>\n  responsibility to eliminate even the &ldquo;perceived threat&rdquo; of<br \/>\n  violence. He wrote that &ldquo;<i>our Constitution grants public school<br \/>\n  children only First Amendment rights when they enter the<br \/>\n  schoolhouse gates<\/i>.&rdquo;\n<\/p>\n<p>\n  Each student&#8217;s lawyer is affiliated with a non-profit firm tied<br \/>\n  to conservative political causes. William Becker Jr., a counselor<br \/>\n  at the newly formed Freedom X in Los Angeles, said Ware was<br \/>\n  &ldquo;<i>unfortunately too wrapped up in political correctness<\/i>&rdquo; in<br \/>\n  his ruling.\n<\/p>\n<p>\n  They appealed Ware&#8217;s decision and the case was heard on Thursday<br \/>\n  in the 9th US Circuit Court of Appeals. The three-judge panel is<br \/>\n  not expected to rule Thursday.\n<\/p>\n<p>\n  Ninth Circuit Judge Sidney Thomas noted the First Amendment<br \/>\n  implications that the court&#8217;s ruling could have.\n<\/p>\n<p>\n  &ldquo;<i>If you have tolerance days, you have to endure the views of<br \/>\n  anti-tolerance<\/i>,&rdquo; Thomas told the school district&#8217;s lawyer, as<br \/>\n  quoted by the San Jose Mercury News.\n<\/p>\n<p>\n  But other judges mentioned how school leaders are now forced to<br \/>\n  cope with everyday intimidation to the possibility of serious<br \/>\n  violence on school grounds. How free speech fits into that puzzle<br \/>\n  remains unclear.\n<\/p>\n<p>\n  &ldquo;<i>Here, the school is saying on this day, in these<br \/>\n  circumstances, with racism floating around&hellip;we&#8217;re not going to<br \/>\n  risk having a blowup here.
