The<br \/>\n  court previously ruled that Fung was responsible for<br \/>\n  &ldquo;<i>inducing<\/i>&rdquo; copyright infringement, meaning the jury trial<br \/>\n  scheduled to begin on November 5 would essentially have<br \/>\n  determined the size of his punishment.\n<\/p>\n<p>\n  IsoHunt did not host copyrighted files on its own, but did act as<br \/>\n  a search engine that pointed users to pirated videogames, music,<br \/>\n  movies, and computer software. Also closing are Fung&#8217;s TorrenTBox<br \/>\n  and Podtropolis.\n<\/p>\n<p>\n  The MPAA warned that its lawyers would have sought as much as<br \/>\n  $600 million in federal court, according to Ars Technica. The<br \/>\n  site is thought to have 44.2 million peer users and at least 13.7<br \/>\n  million active torrents.\n<\/p>\n<p>\n  &ldquo;<i>Today&#8217;s settlement is a major step forward in realizing the<br \/>\n  enormous potential of the internet as a platform for legitimate<br \/>\n  commerce and innovation<\/i>,&rdquo; Chris Dodd, the MPAA&#8217;s chairman,<br \/>\n  said in a statement. &ldquo;<i>It also sends a strong message that<br \/>\n  those who build businesses around encouraging, enabling, and<br \/>\n  helping others to commit copyright infringement are themselves<br \/>\n  infringers, and will be held accountable for their illegal<br \/>\n  actions<\/i>.&rdquo;\n<\/p>\n<p>\n  Fung&#8217;s defense hinged on the excuse that he had no knowledge of<br \/>\n  any copyrighted media on his site. Fung claimed it was the<br \/>\n  millions of isoHunt users who posted infringing material and said<br \/>\n  he frequently removed violations upon request.\n<\/p>\n<p>\n  A federal judge ruled to the contrary, asserting that Fung had<br \/>\n  &ldquo;red flag&rdquo; knowledge of such content and even promoted access to<br \/>\n  popular movies and TV shows in an attempt to earn more ad<br \/>\n  revenue. The court also noted that isoHunt advertised a list of<br \/>\n  the 20 highest-grossing movies in US theaters, pointing to a list<br \/>\n  of users who were hosting, or seeding, the desired files.\n<\/p>\n<p>\n  Fung defended his site during a prior question and answer session<br \/>\n  on the social news site Reddit. One of the main problems, he<br \/>\n  said, is how Google employs the Digital Millennium Copyright Act<br \/>\n  (DMCA).\n<\/p>\n<p>\n  &ldquo;<i>The problem with copyright on the internet is that sharing is<br \/>\n  too easy, and there&#8217;s no Big Database to know what file&#8217;s<br \/>\n  copyright belongs to who and what to do with it (take down,<br \/>\n  monetize, don&#8217;t care)<\/i>,&rdquo; Fung wrote. &ldquo;<i>And I reckon that<br \/>\n  similar to issue with orphaned works, which there is plenty of,<br \/>\n  that category of &lsquo;don&#8217;t care&#8217; is a very large category. Those<br \/>\n  that do care are loud, like Hollywood and the Canadian music<br \/>\n  industry that are suing us, are a minority among all the people<br \/>\n  on earth who &lsquo;create<\/i>.&#8217;\n<\/p>\n<p>\n  &ldquo;<i>And to others arguing that isoHunt can&#8217;t be compared to<br \/>\n  Google or Youtube, I beg to differ<\/i>,&rdquo; Fung continued. &ldquo;<i>We<br \/>\n  have a fully electronic DMCA notice and take down system, for<br \/>\n  years when Google was still requiring snail mail for take downs I<br \/>\n  might add. Hundreds if not thousands of copyright holders have<br \/>\n  notified us for take downs and we&#8217;ve complied with all, and some<br \/>\n  explicitly praised us for our speed (usually within the same or<br \/>\n  next day)<\/i>.&rdquo;\n<\/p>\n<p>\n  IsoHunt has become the latest casualty of devastating lawsuits<br \/>\n  levied by the MPAA and its counterpart the Recording Industry<br \/>\n  Association of America (RIAA). Peer-to-peer service shutdowns in<br \/>\n  the past include Napster, Grokster, KaZaa, and Limewire, while a<br \/>\n  long standing battle against The Pirate Bay still has yet to come<br \/>\n  to fruition for the entertainment lobby groups.\n<\/p>\n<p>\n  Fung described his current mindset in a blog post following the<br \/>\n  resolution.\n<\/p>\n<p>\n  &ldquo;<i>It&#8217;s sad to see my baby go. But I have fought the good fight,<br \/>\n  I have finished the race and I have remained faithful. 10.5 years<br \/>\n  of isoHunt has been a long journey by any business definition and<br \/>\n  forever in Internet startup time<\/i>.\n<\/p>\n<p>\n  &ldquo;<i>It started as a programming hobby in my university days that<br \/>\n  has become so, so much more. It&#8217;s been a learning experience<br \/>\n  beyond what I imagined.
