{"id":64345,"date":"2013-08-30T21:30:04","date_gmt":"2013-08-30T20:30:04","guid":{"rendered":"http:\/\/rinf.com\/alt-news\/breaking-news\/legally-blind-man-files-first-stop-and-frisk-lawsuit\/64345\/"},"modified":"2013-08-30T22:50:25","modified_gmt":"2013-08-30T21:50:25","slug":"legally-blind-man-files-first-stop-and-frisk-lawsuit","status":"publish","type":"post","link":"http:\/\/rinf.com\/alt-news\/latest-news\/legally-blind-man-files-first-stop-and-frisk-lawsuit\/","title":{"rendered":"Legally blind man files first \u2018stop-and-frisk\u2019 lawsuit"},"content":{"rendered":"<p>A legally blind African-American man has filed a lawsuit against the New York Police Department, claiming he was falsely arrested under the department\u2019s controversial stop-and-frisk program.<\/p>\n<p>Allen Moye, a 54-year-old man from Jamaica, Queens, is the first<br \/>\nperson to file a lawsuit against the NYPD since a federal court<br \/>\n<a href=\"http:\/\/rt.com\/usa\/police-search-violates-minorities-399\/\" target=\"_blank\">ruled<\/a><br \/>\nagainst the stop-and-frisk program earlier this month. In the<br \/>\nsuit, Moye says that police illegally came after him and violated<br \/>\nhis civil rights.<\/p>\n<p>He says he was arrested on false charges while he was waiting for<br \/>\na friend at a Harlem street corner in September 2010. Wearing<br \/>\nglasses and using a cane to get around, he was approached by a<br \/>\nhalf-dozen NYPD officers on W. 118<sup>th<\/sup>Street. Police<br \/>\nstopped and frisked him in a manner that Moye described as<br \/>\n\u201crough.\u201d<\/p>\n<p><i>\u201cAnd they didn\u2019t tell me what I did or nothing,\u201d<\/i> he told<br \/>\nthe New York Post. <i>\u201cThey just went through [my clothes] like I<br \/>\nwasn\u2019t even there, and told me, \u2018What are you doing here?\u2019 What<br \/>\ndo you mean, like I\u2019m from another planet? I thought this was a<br \/>\nfree country and you can go anywhere.\u201d<\/i><\/p>\n<p>Moye says that after he complained about the search, he was taken<br \/>\ninto custody for making the complaint.<\/p>\n<p><i>\u201cIt was racial profiling, what they did,\u201d<\/i> he told the New<br \/>\nYork Daily News. <i>\u201c\u2026It\u2019s a different Jim Crow. They try to put<br \/>\neverybody behind bars to do their work.\u201d<\/i><\/p>\n<p>Moye says he is traumatized by the incident and has not returned<br \/>\nto Harlem since the day he was arrested. He says the police there<br \/>\nare <i>\u201clike Nazis.\u201d<\/i><\/p>\n<p>In the lawsuit, Moye cites the <a href=\"http:\/\/rt.com\/usa\/nyc-stop-frisk-unconstitutional-600\/\" target=\"_blank\">decision<\/a><br \/>\nmade by US District Court Judge Shira Sheindlin, who issued an<br \/>\nopinion ruling that the NYPD violated the Fourth and Fourteenth<br \/>\nAmendments through the manner in which they conducted<br \/>\nstop-and-frisks.<\/p>\n<p>The Manhattan judge ordered the NYPD to end the policy, which is<br \/>\npart of the city\u2019s \u201cClean Halls\u201d program of stopping \u2018suspicious\u2019<br \/>\npeople outside of residential apartment blocks and subjecting<br \/>\nthem to random searches.<\/p>\n<p><i>\u201cWhile it may be difficult to say when precisely to draw the<br \/>\nline between constitutional and unconstitutional police<br \/>\nencounters, such a line exists, and the NYPD has systematically<br \/>\ncrossed it when making trespass stops outside buildings,\u201d<\/i><br \/>\nScheindlin\u2019s ruling reads.<\/p>\n<p>Moye is seeking monetary damages for the alleged trauma he<br \/>\nendured as a result of racial profiling.<\/p>\n<p>Although Moye\u2019s lawsuit is the first filed in wake of the federal<br \/>\nruling on stop-and-frisk, it is unlikely to be the last. Earlier<br \/>\nthis week, New York City lawyers predicted that a slew of<br \/>\nlawsuits would likely follow the decision made by Judge<br \/>\nScheindlin, with plaintiffs arguing that their civil rights were<br \/>\nviolated by the city.
