A legally blind African-American man has filed a lawsuit against the New York Police Department, claiming he was falsely arrested under the department\u2019s controversial stop-and-frisk program.<\/p>\n

Allen Moye, a 54-year-old man from Jamaica, Queens, is the first
\nperson to file a lawsuit against the NYPD since a federal court
\nruled<\/a>
\nagainst the stop-and-frisk program earlier this month. In the
\nsuit, Moye says that police illegally came after him and violated
\nhis civil rights.<\/p>\n

He says he was arrested on false charges while he was waiting for
\na friend at a Harlem street corner in September 2010. Wearing
\nglasses and using a cane to get around, he was approached by a
\nhalf-dozen NYPD officers on W. 118th<\/sup>Street. Police
\nstopped and frisked him in a manner that Moye described as
\n\u201crough.\u201d<\/p>\n

\u201cAnd they didn\u2019t tell me what I did or nothing,\u201d<\/i> he told
\nthe New York Post. \u201cThey just went through [my clothes] like I
\nwasn\u2019t even there, and told me, \u2018What are you doing here?\u2019 What
\ndo you mean, like I\u2019m from another planet? I thought this was a
\nfree country and you can go anywhere.\u201d<\/i><\/p>\n

Moye says that after he complained about the search, he was taken
\ninto custody for making the complaint.<\/p>\n

\u201cIt was racial profiling, what they did,\u201d<\/i> he told the New
\nYork Daily News. \u201c\u2026It\u2019s a different Jim Crow. They try to put
\neverybody behind bars to do their work.\u201d<\/i><\/p>\n

Moye says he is traumatized by the incident and has not returned
\nto Harlem since the day he was arrested. He says the police there
\nare \u201clike Nazis.\u201d<\/i><\/p>\n

In the lawsuit, Moye cites the decision<\/a>
\nmade by US District Court Judge Shira Sheindlin, who issued an
\nopinion ruling that the NYPD violated the Fourth and Fourteenth
\nAmendments through the manner in which they conducted
\nstop-and-frisks.<\/p>\n

The Manhattan judge ordered the NYPD to end the policy, which is
\npart of the city\u2019s \u201cClean Halls\u201d program of stopping \u2018suspicious\u2019
\npeople outside of residential apartment blocks and subjecting
\nthem to random searches.<\/p>\n

\u201cWhile it may be difficult to say when precisely to draw the
\nline between constitutional and unconstitutional police
\nencounters, such a line exists, and the NYPD has systematically
\ncrossed it when making trespass stops outside buildings,\u201d<\/i>
\nScheindlin\u2019s ruling reads.<\/p>\n

Moye is seeking monetary damages for the alleged trauma he
\nendured as a result of racial profiling.<\/p>\n

Although Moye\u2019s lawsuit is the first filed in wake of the federal
\nruling on stop-and-frisk, it is unlikely to be the last. Earlier
\nthis week, New York City lawyers predicted that a slew of
\nlawsuits would likely follow the decision made by Judge
\nScheindlin, with plaintiffs arguing that their civil rights were
\nviolated by the city. The Bloomberg administration is still
\ntrying to appeal the decision, and city lawyers have asked
\nScheindlin to hold off on court-ordered reforms for the time
\nbeing.<\/p>\n

\u201cIndividuals who believe they are aggrieved during the
\npendency of the requested stay will still have full opportunity
\nto litigate any claims for money damages due to alleged
\nunconstitutional stop-and-frisk activity,\u201d<\/i> the lawyers
\nwrote.<\/p>\n
