President Obama <a href=\"http:\/\/www.npr.org\/2013\/08\/09\/210574114\/transcript-president-obamas-news-conference\" target=\"_blank\">recited<\/a> this talking point just last week, saying: \u201cas President, I\u2019ve taken steps to make sure they have strong oversight by all three branches of government and clear safeguards to prevent abuse and protect the rights of the American people.\u201d With these three pillars of oversight in place, the argument goes, how could the activities possibly be illegal or invasive of our privacy?<\/p>\n<p>Today, <a href=\"http:\/\/www.washingtonpost.com\/world\/national-security\/nsa-broke-privacy-rules-thousands-of-times-per-year-audit-finds\/2013\/08\/15\/3310e554-05ca-11e3-a07f-49ddc7417125_print.html\" target=\"_blank\">the <i>Washington Post<\/i> confirmed<\/a> that two of those oversight pillars\u2013the Executive branch and the court overseeing the spying, the Foreign Intelligence Surveillance Court (FISA court)\u2013don\u2019t really exist. The third pillar came down slowly over the last few weeks, with Congressional revelations about the limitations on its oversight, including what Representative Sensennbrenner called \u201crope a dope\u201d classified briefings. With this, the house of government trust has fallen, and it\u2019s time to act. <a href=\"https:\/\/optin.stopwatching.us\/\" target=\"_blank\">Join the over 500,000 people<\/a> demanding an end to the unconstitutional NSA spying.<\/p>\n<p><strong>First, the Executive. <\/strong>After a review of internal NSA audits of the spying programs provided by Edward Snowden, the <i>Post<\/i> <a href=\"http:\/\/www.washingtonpost.com\/world\/national-security\/nsa-broke-privacy-rules-thousands-of-times-per-year-audit-finds\/2013\/08\/15\/3310e554-05ca-11e3-a07f-49ddc7417125_print.html\" target=\"_blank\">lays out<\/a>\u2013in stark detail\u2013that the claims of oversight inside the Executive Branch are empty. The article reveals that an internal NSA audit <i>not shown to Congress, the President, or the FISA Court<\/i> detailed thousands of violations where the NSA <i>collected, stored, and accessed American\u2019s communications content and other information<\/i>. In one story, NSA analysts searched for all communications containing the Swedish manufacturer Ericsson and \u201cradio\u201d or \u201cradar.\u201d What\u2019s worse: the thousands of violations only include the NSA\u2019s main office in Maryland\u2013not the other\u2013potentially hundreds\u2013of other NSA offices across the country. And even more importantly, the documents published by the <i>Post<\/i> reveal violations increasing every year. The news reports and documents are in direct contrast to the <a href=\"http:\/\/www.forbes.com\/sites\/andygreenberg\/2013\/06\/06\/watch-top-u-s-intelligence-officials-repeatedly-deny-nsa-spying-on-americans-over-the-last-year-videos\/\" target=\"_blank\">repeated assertions<\/a> by <a href=\"http:\/\/www.youtube.com\/watch?v=rENTl5JKzlQ\" target=\"_blank\">President Obama<\/a> (video), <a href=\"http:\/\/www.theguardian.com\/world\/video\/2013\/jun\/07\/privacy-wyden-clapper-nsa-video\" target=\"_blank\">General James Clapper<\/a> (video), and <a href=\"http:\/\/www.youtube.com\/watch?v=tz0ejKersnM\" target=\"_blank\">General Keith Alexander<\/a> (video) that the US government does not listen to or look at Americans\u2019 phone calls or emails. So much for official pronouncements that oversight by the Executive was \u201c<a href=\"http:\/\/www.dni.gov\/index.php\/newsroom\/speeches-and-interviews\/195-speeches-interviews-2013\/896-privacy,-technology-and-national-security-an-overview-of-intelligence-collection\" target=\"_blank\">extensive<\/a>\u201d and \u201c<a href=\"http:\/\/www.buzzfeed.com\/buzzfeedpolitics\/president-obama-defends-nsa-spying\" target=\"_blank\">robust.<\/a>\u201d<\/p>\n<p><strong>Second, the FISA Court.<\/strong> The <i>Post<\/i> presents a <a href=\"http:\/\/www.washingtonpost.com\/politics\/court-ability-to-police-us-spying-program-limited\/2013\/08\/15\/4a8c8c44-05cd-11e3-a07f-49ddc7417125_print.html\" target=\"_blank\">second article<\/a> in which the Chief Judge of the FISA Court admits that the court is unable to act as a watchdog or stop the NSA\u2019s abuses: \u201cThe FISC is forced to rely upon the accuracy of the information that is provided to the Court,\u201d its chief, US District <a href=\"http:\/\/www.dcd.uscourts.gov\/dcd\/walton\" target=\"_blank\">Judge Reggie B. Walton<\/a>, said in a written statement. \u201cThe FISC does not have the capacity to investigate issues of noncompliance.\u201d Civil liberties and privacy advocates have long said that the FISA Court is a <a href=\"https:\/\/www.eff.org\/deeplinks\/2013\/06\/president-obama-called-fisa-court-transparent-despite-it-being-shrouded-secrecy\" target=\"_blank\">rubber stamp<\/a> when it comes to the spying, but this is worse\u2013this is the Court admitting that it cannot conduct the oversight the President and others have claimed it is doing. So much for claims by officials from the <a href=\"http:\/\/www.charlierose.com\/watch\/60230424\" target=\"_blank\">White House<\/a> (video), <a href=\"http:\/\/blogs.wsj.com\/cio\/2013\/07\/31\/general-keith-alexander-speaks-about-prism-at-black-hat\/\" target=\"_blank\">NSA<\/a>, <a href=\"http:\/\/www.dni.gov\/index.php\/newsroom\/speeches-and-interviews\/195-speeches-interviews-2013\/896-privacy,-technology-and-national-security-an-overview-of-intelligence-collection\" target=\"_blank\">DOJ<\/a>, and <a href=\"http:\/\/politicalticker.blogs.cnn.com\/2013\/06\/16\/rogers-nsa-is-not-listening-to-americans-phone-calls\/?hpt=hp_t2\" target=\"_blank\">Intelligence Committee members of Congress<\/a> that the FISA Court is another <a href=\"http:\/\/www.dni.gov\/index.php\/newsroom\/speeches-and-interviews\/195-speeches-interviews-2013\/896-privacy,-technology-and-national-security-an-overview-of-intelligence-collection\" target=\"_blank\">strong pillar of oversight<\/a>.<\/p>\n<p><strong>Third, the Congress.<\/strong> Last week, Representative Sensenbrenner <a href=\"http:\/\/sensenbrenner.house.gov\/news\/documentsingle.aspx?DocumentID=342152\" target=\"_blank\">complained<\/a> that \u201cthe practice of classified briefings are a \u2018rope-a-dope operation\u2019 in which lawmakers are given information and then forbidden from speaking out about it.\u201d Members of Congress who do not serve on the Intelligence Committees in the both the House and Senate have had <a href=\"http:\/\/www.theguardian.com\/commentisfree\/2013\/aug\/04\/congress-nsa-denied-access\" target=\"_blank\">difficulty in obtaining<\/a> documents about the NSA spying. Last week, it was even uncovered that the Chairman of the House Intelligence Committee, Rep. Mike Rogers, <a href=\"http:\/\/thehill.com\/blogs\/hillicon-valley\/technology\/316707-amash-intelligence-committee-withheld-surveillance-document-from-house\" target=\"_blank\">failed to provide<\/a> freshmen members of Congress vital documents about the NSA\u2019s activities during a key vote to reapprove the spying. Senators Wyden and Udall have been desperately trying to tell the American people what is going on, but this year the House Intelligence committee\u2019s Subcommittee on Oversight <a href=\"https:\/\/intelligence.house.gov\/legislation?type=All&amp;tid=38&amp;tid_1=26&amp;__ncforminfo=SvCvleGkXnJ4rMox5shI4lDKZQ875tE63EU0J8ZdXi-K541oQwpq5AHMkZRXBQa1pe4fxRj-AkrdnvcF-Cjy7vjXX6ctaIP1RGgaEfEoA7niz0RFYArBz9a2sGuVXfo__EiM9ClHrea5F7mPz5pmzzqlnC82uJgmmtndFP5lNEmRmvqiGkLrS5qNnwpS-WDVa8-97hxSsg3nHzQ7mGKqPCeRm7mTNlLIIFK5lJzVNK0r2yLgUFeQSH9Lp0ylOkvL\" target=\"_blank\">has not met once<\/a> and the Senate Intelligence committee has met publicly only <a href=\"http:\/\/www.intelligence.senate.gov\/hearings.cfm?congress=113\" target=\"_blank\">twice<\/a>.<\/p>\n<p>One, two, three pillars of government, all cited repeatedly as the justification for our trust and all now obviously nonexistent or failing miserably. It\u2019s no surprise Americans are <a href=\"https:\/\/www.eff.org\/deeplinks\/2013\/06\/multiple-new-polls-show-americans-reject-wholesale-nsa-domestic-spying\" target=\"_blank\">turning against<\/a> the government\u2019s explanations.<\/p>\n<p>The pattern is now clear and it\u2019s getting old. With each new revelation the government comes out with a new story for why things are really just fine, only to have that assertion demolished by the next revelation. It\u2019s time for those in government who want to rebuild the trust of the American people and others all over the world to come clean and take some actual steps to rein in the NSA. And if they don\u2019t, the American people and the public, adversarial courts, must force change upon it.<\/p>\n<p>We still think the first step ought to be a truly <a href=\"https:\/\/www.eff.org\/deeplinks\/2013\/06\/why-special-congressional-committee-must-be-created-investigate-nsas\" target=\"_blank\">independent investigatory body <\/a>that is assigned to look into the unconstitutional spying. It must be empowered to search, read and compel documents and testimony, must be required to give a public report that only redacts sensitive operational details, and must suggest specific legislation and regulatory changes to fix the problem\u2013something like the <a href=\"http:\/\/en.wikipedia.org\/wiki\/Church_committee\" target=\"_blank\">Church Committee<\/a> or maybe even the <a href=\"http:\/\/en.wikipedia.org\/wiki\/9\/11_Commission\" target=\"_blank\">9\/11 Commission<\/a>. The President made a mockery of this idea recently, by initially handing control of the \u201c<a href=\"http:\/\/www.theregister.co.uk\/2013\/08\/13\/obama_appoints_intelligence_boss_to_run_independent_review_of_nsa\/\" target=\"_blank\">independent<\/a>\u201d investigation he announced in his press conference to the man who most famously <a href=\"http:\/\/www.washingtonpost.com\/blogs\/fact-checker\/post\/james-clappers-least-untruthful-statement-to-the-senate\/2013\/06\/11\/e50677a8-d2d8-11e2-a73e-826d299ff459_blog.html\" target=\"_blank\">lied<\/a> to Congress and the American people about the spying, the Director of National Intelligence James Clapper.<\/p>\n<p>The three pillars of American trust have fallen. It\u2019s time to get a full reckoning and build a new house from the wreckage, but it has to start with some honesty.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Cindy Cohn and Mark M.
