Even though the law<br \/>\n  allows insurers to charge smokers up to 50 percent higher<br \/>\n  premiums, the system glitch limits these penalties and<br \/>\n  particularly benefits older Americans who smoke.\n<\/p>\n<p>\n  <i>&#8220;Because of a system limitation &#8230; the system currently<br \/>\n  cannot process a premium for a 65-year-old smoker that is &#8230;<br \/>\n  more than three times the premium of a 21-year-old smoker,&#8221;<\/i><br \/>\n  the industry guidance said. If an insurance company tries to<br \/>\n  charge a smoker higher premiums, <i>\u201cthe submission of the<br \/>\n  (insurer) will be rejected by the system,\u201d\u00a0<\/i> the guidance<br \/>\n  added.\n<\/p>\n<p>\n  When President Obama&#8217;s signature Affordable Care Act is<br \/>\n  implemented in 2014, insurance companies will be required to<br \/>\n  accept all applicants, regardless of their medical history,<br \/>\n  lifestyle or any pre-existing conditions. A 64-year-old<br \/>\n  non-smoker would pay about $9,000 a year for a standard \u201csilver\u201d<br \/>\n  insurance plan. A 50 percent penalty on premiums would add more<br \/>\n  than $4,500 to their annual health insurance costs, bringing the<br \/>\n  total to nearly $13,600.\n<\/p>\n<p>\n  But the glitch prevents insurers from charging older customers<br \/>\n  more than three times what they charge the youngest. In order for<br \/>\n  the system to approve the insurance plans, a young smoker and an<br \/>\n  old smoker would have to be charged the same penalty.\n<\/p>\n<p>\n  Initially, health insurance experts predicted that companies<br \/>\n  would charge young smokers lower penalties and older smokers<br \/>\n  higher penalties.\n<\/p>\n<p>\n  <i>&#8220;Generally a 20-year-old who smokes probably doesn&#8217;t have much<br \/>\n  higher health costs than someone who doesn&#8217;t smoke in any given<br \/>\n  year,&#8221;<\/i> said Larry Levitt, an insurance market expert with the<br \/>\n  nonpartisan Kaiser Family Foundation. <i>&#8220;A 60-year-old is<br \/>\n  another story.&#8221;<\/i>\n<\/p>\n<p>\n  The Obama administration is now suggesting limits on penalties<br \/>\n  for smokers of all ages. The Department of Health and Human<br \/>\n  Services suggested a 20 percent penalty, which could be<br \/>\n  significantly less for older smokers who would have otherwise<br \/>\n  been forced to pay 50 percent.\n<\/p>\n<p>\n  A 64-year-old smoker with a 20 percent insurance penalty would be<br \/>\n  paying about $10,900 a year, rather than the $13,600 they would<br \/>\n  pay under a 50 percent penalty. Younger smokers, on the other<br \/>\n  hand, would most likely be paying more than they normally would.\n<\/p>\n<p>\n  <i>\u201cIt\u2019s going to throw cold water on efforts to get younger<br \/>\n  people to sign up,\u201d<\/i> Larry Levitt, an insurance market expert,<br \/>\n  told AP.\n<\/p>\n<p>\n  On July 2, the Obama administration unexpectedly announced a<br \/>\n  one-year delay of the provision that would mandate larger<br \/>\n  employers to provide coverage for their workers or pay hefty<br \/>\n  fines. The administration is preparing the launch of the health<br \/>\n  insurance marketplace on <span>October 1<\/span>, but news of<br \/>\n  delays and glitches has concerned health industry experts and<br \/>\n  consultants.\u00a0\n<\/p>\n<p>\n  In recent weeks, new data and reports have discovered that<br \/>\n  Obamacare would <a target=\"_blank\" href=\"http:\/\/rt.com\/usa\/healthcare-california-incrfease-premium-088\/\">increase<\/a><br \/>\n  healthcare premiums in California by up to 146 percent and<br \/>\n  <a target=\"_blank\" href=\"http:\/\/rt.com\/usa\/obamacare-native-american-insurance-333\/\">penalize<\/a><br \/>\n  nearly half a million Native Americans who would no longer be<br \/>\n  \u201cIndian enough\u201d for eligibility at federally-funded health<br \/>\n  clinics. And with younger smokers set to pay significantly more<br \/>\n  and older smokers able to get away paying less, flaws of<br \/>\n  Obamacare have once again been highlighted, just a few months<br \/>\n  before it goes into effect.\n<\/p>\n<p>\n  <i>&#8220;This was an administration that was telling us everything was<br \/>\n  under control,&#8221;<\/i> health care industry consultant Robert<br \/>\n  Laszewski told AP. <i>&#8220;Everything was going to be fine.
