{"id":46263,"date":"2013-06-28T22:00:38","date_gmt":"2013-06-28T21:00:38","guid":{"rendered":"http:\/\/rinf.com\/alt-news\/breaking-news\/california-chalk-protester-hit-with-gag-order\/46263\/"},"modified":"2013-06-28T22:00:38","modified_gmt":"2013-06-28T21:00:38","slug":"california-chalk-protester-hit-with-gag-order","status":"publish","type":"post","link":"http:\/\/rinf.com\/alt-news\/breaking-news\/california-chalk-protester-hit-with-gag-order\/","title":{"rendered":"California chalk protester hit with gag-order"},"content":{"rendered":"<p>A California man facing more than a decade in prison for writing with chalk on public sidewalks has been told he\u2019s barred from discussing the details of his controversial case outside of court.<\/p>\n<p>\n  Judge Howard Shore issued a gag-order in a San Diego, California<br \/>\n  courtroom this week against Jeff Olson, a 40-year-old activist<br \/>\n  that used washable children\u2019s chalk to scribble anti-bank slogans<br \/>\n  in public space last year.\n<\/p>\n<p>\n  According to the San Diego Reader, the gag-order issued on Friday<br \/>\n  also applies to witnesses, members of the jury and potentially<br \/>\n  others, a measure that Truth-Out editor Mark Karlin said is<br \/>\n  \u201c<i>unprecedented<\/i>\u201d for a misdemeanor trial.\n<\/p>\n<p>\n  Olson has been charged with <a target=\"_blank\" href=\"http:\/\/rt.com\/usa\/california-man-13-prison-banks-237\/\">13 misdemeanor counts of vandalism<\/a> for chalking<br \/>\n  slogans such as \u201cNo Thanks, Big Banks&#8221; and &#8220;Shame on Bank of<br \/>\n  America&#8221; on the sidewalks outside of branches in the San Diego<br \/>\n  area throughout 2012. Now as the criminal trial against him wages<br \/>\n  on in Southern California, the defendant and anyone remotely<br \/>\n  involved in the case is reportedly muzzled by a ban that could<br \/>\n  bring media coverage of the case to a grinding halt.\n<\/p>\n<p>\n  The Reader reports that Judge Shore issued the gag-order during<br \/>\n  Friday\u2019s hearing after expressing her discontent with comments<br \/>\n  Olson made about his potential sentencing. According to the<br \/>\n  charge sheet filed by the city of San Diego, Olson could be<br \/>\n  subjected to $13,000 in fines and a maximum of 13 years in prison<br \/>\n  if convicted, prompting the defendant to make a myriad of remarks<br \/>\n  in recent weeks, including one to the U-T San Diego newspaper<br \/>\n  that called the prosecution, \u201c<i>an unconstitutional overreach<br \/>\n  and a total waste of taxpayer money<\/i>.\u201d\n<\/p>\n<p>\n  Commenting to reporters on Friday, Judge Shore said a decade<br \/>\n  behind bars was \u201c<i>not going to happen<\/i>\u201d and insisted she<br \/>\n  \u201c<i>would be surprised if it ever happened to any defendant with<br \/>\n  no criminal record<\/i>.&#8221;\n<\/p>\n<p>\n  Shortly after those remarks, OIson read a note to the court that<br \/>\n  said in part, &#8220;<i>This morning Judge Shore issued a gag order<br \/>\n  prohibiting all counsel and parties from commenting or expressing<br \/>\n  opinions on the case. All I am permitted to say is that I<br \/>\n  disagree<\/i>.&#8221;\n<\/p>\n<p>\n  As Karlin notes, Judge Shore\u2019s issuing of the gag-order came just<br \/>\n  days after Olson told reporters, \u201c<i>My chalk drawings are<br \/>\n  clearly free speech and protected by the First Amendment<\/i>.\u201d\n<\/p>\n<p>\n  Speaking to CBS News previously, Olson defended his act of<br \/>\n  protest:\n<\/p>\n<p>\n  &#8220;<i>Always on city sidewalks, washable chalk, never crude<br \/>\n  messages, never vulgar, clearly topical<\/i>,&#8221; he said.\n<\/p>\n<p>\n  Prosecutors in San Diego aren\u2019t amused with his work, however,<br \/>\n  and have discounted Olson\u2019s assertion that he was engaging in an<br \/>\n  act of free speech. Judge Shore said earlier in the week that<br \/>\n  Olson\u2019s attorney is prohibited from &#8220;<i>mentioning the First<br \/>\n  Amendment, free speech, free expression, public forum, expressive<br \/>\n  conduct or political speech during the trial<\/i>,\u201d but the<br \/>\n  issuing of a gag-order now limits much more than what was already<br \/>\n  decided.\n<\/p>\n<p>\n  Olson said that at the heart of his case is not the issue of<br \/>\n  vandalism, but an infringement on the right to free speech. He<br \/>\n  has accused San Diego City Attorney Jan Goldsmith is trying to<br \/>\n  stop him from talking because he has raked in heavy donations<br \/>\n  from the banks in the past, and is now reported to be eyeing a<br \/>\n  bid at the mayor\u2019s role in 2016.\n<\/p>\n<p>\n  \u201c<i>Jan Goldsmith has received campaign contributions from Bank<br \/>\n  Americorp and Merrill Lynch. I think this is mostly about<br \/>\n  Goldsmith for Mayor 2016<\/i>,\u201d Olson told San Diego 6 News.\n<\/p>\n<p>\n  &#8220;<i>If<\/i> <i>I had drawn a little girl&#8217;s hopscotch squares on<br \/>\n  the street, we wouldn&#8217;t be here today<\/i>,\u201d the activist added to<br \/>\n  KGTV News.\n<\/p>\n<p>\n  Bob Filner, the mayor of San Diego, issued a statement last week<br \/>\n  calling for the city to drop their case against Olson.\n<\/p>\n<p>\n  \u201c<i>This young man is being persecuted for thirteen counts of<br \/>\n  vandalism stemming from an expression of political protest that<br \/>\n  involved washable children&#8217;s chalk on a City sidewalk<\/i>,\u201d<br \/>\n  Filner wrote. \u201c<i>It is alleged that he has no previous criminal<br \/>\n  record. If these assertions are correct, I believe this is a<br \/>\n  misuse and waste of taxpayer money.
