Maha Elgizouli\u2019s application questions the legality of the Home Office\u2019s deal to provide evidence to US prosecutors.<\/p>\n<p><strong><a href=\"https:\/\/www.rt.com\/news\/440476-saudi-prince-reforms-civil-war\/\">READ MORE:\u00a0Saudi Arabia can survive \u20182,000 years\u2019 without US help &amp; not face civil war like America \u2013 MBS<\/a><\/strong><\/p>\n<p>Edward Fitzgerald QC, representing Elgizouli alleges that Sir Kim Darroch, the British Ambassador in Washington, had warned UK Home Secretary Javid that seeking assurances over the death penalty of the two suspects would only provoke <em>\u201csomething close to outrage\u201d<\/em> among US President Donald Trump\u2019s top aides, namely US Attorney General, Jeff Sessions, Mike Pompeo, the US secretary of state and James Mattis, the US defense secretary.<\/p>\n<p><iframe loading=\"lazy\" width=\"900\" height=\"506\" src=\"https:\/\/www.youtube.com\/embed\/4dcSQ59-myo\" frameborder=\"0\" allow=\"autoplay; encrypted-media\" allowfullscreen=\"\"><\/iframe><\/p>\n<p>Javid who at the time had been in his role for less than a month, had Darroch\u2019s concerns reaffirmed, on a visit to Washington. During a meeting with Sessions, Javid was left in no doubt that failure to fully cooperate with the US prosecution would have severe repercussions. The then foreign secretary, Boris Johnson, eventually agreed with him, the lawyer argued.<\/p>\n<p>Fitzgerald told the court that the UK were acting in defiance of advice from the Foreign Office and senior civil servants, as the President\u2019s aides<em> \u201cwill wind up the president and he will hold a grudge,\u201d<\/em> damaging UK-US relations.<\/p>\n<p>The court was also told that Javid didn\u2019t even take up earlier partial assurances the Americans had offered over not using British evidence in seeking the death penalty.<\/p>\n<p><strong><a href=\"https:\/\/www.rt.com\/uk\/434423-icymi-isis-beatles-death-penalty\/\">READ MORE:\u00a0#ICYMI: Save the ISIS Beatles! Britain against death penalty for terrorists, but will blow them up<\/a><\/strong><\/p>\n<p>Elsheikh and Kotey, who grew up in Britain, are alleged to have been part of the so-called \u2018Beatles\u2019 IS cell that is thought to have been responsible for carrying out 27 beheadings of UK and US nationals in IS-held territory. Victims included British aid workers David Haines and Alan Henning and American journalists Steven Sotloff and James Foley.<\/p>\n<p>The pair, who have had their British citizenship revoked, were captured by Syrian Kurdish fighters in February, prompting behind-the-scenes talks between the UK and the US governments over where they should be prosecuted.<\/p>\n<p>Elsheikh\u2019s mother, Maha, accepts he should be appropriately punished.<em> \u201cHer concern is the death penalty \u2026 It\u2019s relevant that the families of the victims have said they want justice but not the death penalty,\u201d<\/em> Fitzgerald told the court.<\/p>\n<p><strong><em>Think your friends would be interested?
