However, TSA personnel do not fall into this category, the 3rd US Circuit Court of Appeals <a href=\"http:\/\/www2.ca3.uscourts.gov\/opinarch\/153047p.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">ruled on Wednesday<\/a> in a 2-1 verdict.<\/p>\n<p><em>\u201cTSA employees typically are not law enforcement officers and do not act as such,\u201d<\/em> but rather carry out <em>\u201cadministrative searches and contact local law enforcement if they encounter situations requiring action beyond their limited though important responsibilities,\u201d<\/em> the majority explained.<\/p>\n<div class=\"arcticle__read-more read-more\">\n<p>Read more<\/p>\n<p>    <a class=\"read-more__link\" href=\"http:\/\/www.rt.com\/usa\/377252-tsa-cocaine-smuggling-tons\/\" target=\"_blank\"><br \/>\n                    <img decoding=\"async\" class=\"read-more__cover\" src=\"https:\/\/cdni.rt.com\/files\/2017.02\/thumbnail\/58a256bdc36188aa6d8b461d.jpg\" alt=\"\u00a9 Mario Anzuoni \"\/><br \/>\n    <\/a>\n<\/div>\n<p>The court was <em>\u201csympathetic\u201d<\/em> to concerns that this would leave travelers with <em>\u201cvery limited legal redress\u201d<\/em> in case they encounter aggressive or overzealous TSA screeners, but expanding the liability would be <em>\u201csquarely in the realm\u201d<\/em> of Congress, Circuit Judge Cheryl Ann Krause wrote in the 53-page majority opinion. Judge Thomas L. Ambro disagreed, appending a 58-page dissent.<\/p>\n<p>Nadine Pellegrino, a consultant from Boca Raton, Florida, had filed the lawsuit for false arrest, false imprisonment and malicious prosecution over a 2006 incident at the Philadelphia International Airport. Pellegrino and her husband were jailed for 18 hours and charged with 10 criminal counts over a confrontation with several TSA agents, including assault and making terrorist threats. They were acquitted in 2008.<\/p>\n<p>The 3rd Circuit ruling comes a day after New York Giants footballer A.J. Francis slammed the agency on Twitter for spilling his mother\u2019s ashes during a baggage search.
