And <a target=\"_blank\" title=\"see this\" href=\"http:\/\/www.thedailybeast.com\/articles\/2013\/05\/14\/is-obama-worse-for-press-freedom-than-nixon.html\">see this<\/a>.<\/p>\n<p>Former constitutional lawyer Glenn Greenwald <a target=\"_blank\" title=\"noted\" href=\"http:\/\/www.salon.com\/2012\/03\/06\/attorney_general_holder_defends_execution_without_charges\/singleton\/\">noted<\/a> last year:<\/p>\n<blockquote>\n<p>We supposedly learned important lessons from the abuses of power of the Nixon administration, and then of the Bush administration: namely, that we don\u2019t trust government officials to exercise power in the dark, with no judicial oversight, with no obligation to prove their accusations. Yet now we hear exactly this same mentality issuing from Obama, his officials and defenders to justify a <strong>far more extreme power than either Nixon or Bush dreamed of asserting<\/strong>: he\u2019s only killing The Bad Citizens, so there\u2019s no reason to object!<\/p>\n<\/blockquote>\n<p>Jonathan Turley \u2014 perhaps the <a target=\"_blank\" title=\"top constitutional law expert\" href=\"http:\/\/www.law.gwu.edu\/faculty\/profile.aspx?id=1738\">top constitutional law expert<\/a> in the United States (and a liberal) \u2014 <a target=\"_blank\" title=\"writes\" href=\"http:\/\/www.usatoday.com\/story\/opinion\/2013\/03\/25\/nixon-has-won-watergate\/2019443\/\">writes<\/a>:<\/p>\n<blockquote>\n<p>The painful fact is that Barack Obama is the president that Nixon always wanted to be.<\/p>\n<p>Four decades ago, Nixon was halted in his determined effort to create an \u201cimperial presidency\u201d with unilateral powers and privileges. In 2013, Obama wields those very same powers openly and without serious opposition. The success of Obama in acquiring the long-denied powers of Nixon is one of his most remarkable, if ignoble, accomplishments. Consider a few examples:<\/p>\n<p><strong>Warrantless surveillance<\/strong><\/p>\n<p>Nixon\u2019s use of warrantless surveillance led to the creation of a special court called the <a target=\"_blank\" title=\"Foreign Intelligence Surveillance Court\" href=\"http:\/\/www.npr.org\/templates\/story\/story.php?storyId=5049679\">Foreign Intelligence Surveillance Court<\/a> (FISA). But the reform turned out to be more form than substance. The secret court turned \u201c<a target=\"_blank\" title=\"probable cause\" href=\"http:\/\/epic.org\/privacy\/terrorism\/fisa\/\">probable cause<\/a>\u201d into a meaningless standard, virtually guaranteeing <a target=\"_blank\" title=\"any surveillance the government wanted.\" href=\"http:\/\/www.wired.com\/dangerroom\/2012\/07\/surveillance-spirit-law\/\">any surveillance the government wanted.<\/a> After hundreds of thousands of applications over decades, <a target=\"_blank\" title=\"only a couple have ever been denied\" href=\"http:\/\/blog.independent.org\/2013\/02\/09\/the-fisa-model-for-summary-execution\/\">only a couple have ever been denied<\/a>.<\/p>\n<p>Last month, the Supreme Court crushed any remaining illusions regarding FISA when it <a target=\"_blank\" title=\"sided with the Obama administration in ruling\" href=\"http:\/\/www.npr.org\/2013\/02\/26\/172998760\/supreme-court-makes-it-harder-to-challenge-foreign-intelligence-surveillance-act\">sided with the Obama administration in ruling<\/a> that potential targets of such spying had to have proof they were spied upon before filing lawsuits, even if the government has declared such evidence to be secret. That\u2019s only the latest among <a target=\"_blank\" title=\"dozens\" href=\"http:\/\/ccrjustice.org\/CCR-v-Obama\">dozens<\/a> of lawsuits the administration has blocked while surveillance <a target=\"_blank\" title=\"expands exponentially\" href=\"http:\/\/www.huffingtonpost.com\/2012\/09\/28\/warrantless-electronic-surveillance-obama_n_1924508.html\">expands exponentially<\/a>.<\/p>\n<p><strong>Unilateral military action<\/strong><\/p>\n<p>Nixon\u2019s impeachment included the charge that he evaded Congress\u2019 <a target=\"_blank\" title=\"sole authority to declare war\" href=\"http:\/\/books.google.com\/books?id=BaVozO5RyNwC&amp;pg=PA257&amp;dq=nixon+impeachment+declare+war&amp;hl=en&amp;sa=X&amp;ei=UIJPUauKMo_l4AOX54GQDw&amp;ved=0CC0Q6AEwAA#v=onepage&amp;q=nixon%20impeachment%20declare%20war&amp;f=false\">sole authority to declare war<\/a> by invading Cambodia. In the <a target=\"_blank\" title=\"Libyan \u201cmission\" href=\"http:\/\/articles.washingtonpost.com\/2011-06-15\/politics\/35234248_1_libya-operation-libya-campaign-libya-action\">Libyan \u201cmission<\/a>,\u201d Obama announced that only he had the inherent authority to decide what is a \u201cwar\u201d and that so long as he called it something different, no congressional approval or even consultation was necessary. He proceeded to <a target=\"_blank\" title=\"bomb a nation\u2019s capital\" href=\"http:\/\/www.mcclatchydc.com\/2011\/03\/26\/111108\/aided-by-western-bombing-libyan.html\">bomb a nation\u2019s capital<\/a>, destroy military units and spend <a target=\"_blank\" title=\"more than a billion dollars\" href=\"http:\/\/www.cbsnews.com\/8301-503543_162-20123941-503543\/libya-mission-cost-u-s-more-than-1-billion\/\">more than a billion dollars<\/a> in support of one side in a civil war.<\/p>\n<p><strong>Kill lists<\/strong><\/p>\n<p>Nixon <a target=\"_blank\" title=\"ordered a burglary\" href=\"http:\/\/www.historycommons.org\/context.jsp?item=a080571ellsbergprobe#a080571ellsbergprobe\">ordered a burglary<\/a> to find evidence to use against Daniel Ellsberg, who <a target=\"_blank\" title=\"gave the famed Pentagon Papers\" href=\"http:\/\/usatoday30.usatoday.com\/news\/washington\/2011-06-13-pentagon-papers-released_n.htm\">gave the famed Pentagon Papers<\/a> to the press, and later tried to imprison him. Ellsberg was later told of a <a target=\"_blank\" title=\"secret plot\" href=\"http:\/\/books.google.com\/books?id=M75tlz704usC&amp;pg=PA124&amp;dq=ellsberg+whitehouse+plumbers+attack&amp;hl=en&amp;sa=X&amp;ei=hXpPUc-GEsTB4AO74YGwAw&amp;ved=0CDkQ6AEwAA#v=onepage&amp;q=ellsberg%20whitehouse%20plumbers%20attack&amp;f=false\">secret plot<\/a> by the White House \u201cplumbers\u201d to \u201cincapacitate\u201d him in a physical attack. It was a shocking revelation. That\u2019s nothing compared with Obama\u2019s assertion of the <a target=\"_blank\" title=\"right to kill any U.S. citizen\" href=\"http:\/\/www.usatoday.com\/story\/news\/politics\/2013\/02\/05\/drone-strikes-justice-department-memo-brennan\/1893581\/\">right to kill any U.S. citizen<\/a> without a charge, let alone conviction, based on his sole authority. A recently leaked memo argues that the president has a right to kill a citizen <a target=\"_blank\" title=\"even when he lacks\" href=\"http:\/\/openchannel.nbcnews.com\/_news\/2013\/02\/04\/16843014-justice-department-memo-reveals-legal-case-for-drone-strikes-on-americans?lite\">even when he lacks<\/a> \u201cclear evidence (of) a specific attack\u201d being planned.<\/p>\n<p><strong>Attacking whistle-blowers<\/strong><\/p>\n<p>Nixon was known for his <a target=\"_blank\" title=\"attacks\" href=\"http:\/\/www.ajr.org\/article.asp?id=3735\">attacks<\/a> on whistle-blowers. He used the <a target=\"_blank\" title=\"Espionage Act of 1917\" href=\"http:\/\/books.google.com\/books?id=Snia9Kt7rokC&amp;pg=PA513&amp;lpg=PA513&amp;dq=nixon+Espionage+Act+of+1917+ellsberg&amp;source=bl&amp;ots=aht7fOrd6_&amp;sig=0BEzVcfGE6vH3CO8mlsJFEHeWEY&amp;hl=en&amp;sa=X&amp;ei=v4VPUZq6BdK64AOpnYCADA&amp;ved=0CF0Q6AEwBg#v=onepage&amp;q=nixon%20Espionage%20Act%20of%201917%20ellsberg&amp;f=false\">Espionage Act of 1917<\/a> to bring a rare criminal case against Ellsberg. Nixon was vilified for the abuse of the law. Obama has <a target=\"_blank\" title=\"brought twice\" href=\"http:\/\/articles.cnn.com\/2012-06-07\/politics\/politics_obama-leaks-prosecutions_1_leaks-obama-administration-espionage-act?_s=PM:POLITICS\">brought twice<\/a> as many such prosecutions as all prior presidents combined [and <a target=\"_blank\" title=\"see this\" href=\"http:\/\/www.washingtonsblog.com\/2012\/04\/obama-has-prosecuted-more-whistleblowers-than-all-other-presidents-combined.html\">see this<\/a>]. While refusing to <a target=\"_blank\" title=\"prosecute anyone for actual torture\" href=\"http:\/\/www.guardian.co.uk\/commentisfree\/2012\/aug\/31\/obama-justice-department-immunity-bush-cia-torturer\">prosecute anyone for actual torture<\/a>, the Obama administration has prosecuted former CIA employee <a target=\"_blank\" title=\"John Kiriakou\" href=\"http:\/\/www.usatoday.com\/story\/news\/nation\/2013\/01\/25\/cia-leak-sentencing\/1863715\/\">John Kiriakou<\/a> for disclosing the torture program.<\/p>\n<p>Other Nixonesque areas include Obama\u2019s overuse of classification laws and withholding material from Congress. There are even missing tapes. In the torture scandal, <a target=\"_blank\" title=\"CIA officials admitted to destroying tapes\" href=\"http:\/\/www.nbcnews.com\/id\/29464930\/#.UVC7yxcp_0c\">CIA officials admitted to destroying tapes<\/a> that they feared could be used against them in criminal cases. Of course, Nixon had missing tapes, but <a target=\"_blank\" title=\"Rose Mary Woods claimed to have erased them by mistake\" href=\"http:\/\/www.washingtonpost.com\/wp-dyn\/articles\/A30678-2005Jan23.html\">Rose Mary Woods claimed to have erased them by mistake<\/a>, as opposed to current officials who openly admit to intentional destruction.<\/p>\n<p>Obama has not only openly asserted powers that were the grounds for Nixon\u2019s impeachment, but he has made many love him for it. More than any figure in history, Obama has been a disaster for the U.S. civil liberties movement. By coming out of the Democratic Party and assuming an iconic position, Obama has ripped the movement in half. Many Democrats and progressive activists find themselves unable to oppose Obama for the authoritarian powers he has assumed. It is not simply a case of personality trumping principle; it is a cult of personality.<\/p>\n<p>Long after Watergate, not only has the presidency changed. We have changed. We have become accustomed to elements of a security state such as massive surveillance and executive authority without judicial oversight. We have finally answered a question left by Benjamin Franklin in 1787, when a Mrs. Powel confronted him after the Constitutional Convention and asked, \u201cWell, Doctor, what have we got \u2013 a republic or a monarchy?\u201d His chilling response: \u201cA republic, if you can keep it.\u201d<\/p>\n<p>We appear to have grown weary of the republic and traded it for promises of security from a shining political personality. Somewhere, Nixon must be wondering how it could have been this easy.<\/p>\n<\/blockquote>\n<p>Nixon\u2019s \u201cEnemies List\u201d is famous, and the former head of the National Security Agency\u2019s global digital data gathering program says that Obama also has an enemies list \u2026 which has been used to take down a wide variety of people, <a target=\"_blank\" title=\"including the head of the CIA\" href=\"http:\/\/www.washingtonsblog.com\/2012\/12\/top-nsa-spying-chief-if-you-ever-get-on-their-enemies-list-like-petraeus-did-then-you-can-be-drawn-into-that-surveillance.html\">including the head of the CIA<\/a>. The Washington Post\u2019s\u00a0Ed Rogers <a target=\"_blank\" title=\"notes\" href=\"http:\/\/www.washingtonpost.com\/blogs\/post-partisan\/wp\/2013\/05\/13\/the-insiders-the-obama-irs-nightmare-is-just-getting-started\/\">notes<\/a>:<\/p>\n<blockquote>\n<p>Obama doesn\u2019t need a traditional Nixonian enemies list. In the digital age, with the Obama machine\u2019s much-celebrated technological capabilities, the president can sort his enemies by keywords.<\/p>\n<\/blockquote>\n<p>You\u2019ve heard about the AP spying scandal, and the head of the Department of Justice implies that the government has <a target=\"_blank\" title=\"spied on many other reporters\" href=\"http:\/\/www.npr.org\/blogs\/thetwo-way\/2013\/05\/15\/184138253\/holder-isnt-sure-how-often-reporters-records-are-seized?ft=1&amp;f=1001\">spied on many other reporters<\/a>.<\/p>\n<p>Reporters who criticize those in power are being <a target=\"_blank\" title=\"smeared by the government\" href=\"http:\/\/www.washingtonsblog.com\/2012\/04\/pentagon-smears-usa-today-reporters-for-wait-for-it-investigating-illegal-pentagon-propaganda.html\">smeared by the government<\/a> and <a target=\"_blank\" title=\"targeted for arrest\" href=\"http:\/\/www.washingtonsblog.com\/2011\/11\/reporters-covering-occupy-wall-street-are-being-targeted-for-arrest-nationwide.html\">targeted for arrest<\/a> (and <a target=\"_blank\" title=\"see this\" href=\"http:\/\/www.washingtonsblog.com\/2009\/03\/real-journalism-versus-professional-journalism.html\">see this<\/a>).<\/p>\n<p>Indeed, the Obama administration is treating <a target=\"_blank\" title=\"treats real reporters as terrorists\" href=\"http:\/\/www.washingtonsblog.com\/2012\/09\/in-america-journalists-are-considered-terrorists.html\">real reporters as potential <em>terrorists<\/em><\/a>.<\/p>\n<p>After Pulitzer Prize winning journalist Chris Hedges, journalist Naomi Wolf, Pentagon Papers whistleblower Daniel Ellsberg and others sued the government to enjoin the NDAA\u2019s allowance of the indefinite detention of Americans \u2014 the judge asked the government attorneys <em>5 times<\/em> whether journalists like Hedges could be indefinitely detained simply for interviewing and then <em>writing about<\/em> bad guys. The government <a target=\"_blank\" title=\"refused to promise\" href=\"http:\/\/www.truthdig.com\/report\/item\/a_victory_for_all_of_us_20120518\/\"><strong><em>refused<\/em><\/strong> <em>to promise<\/em><\/a> that journalists like Hedges won\u2019t be thrown in a dungeon for the rest of their lives without any right to talk to a judge.<\/p>\n<p>Wikileaks\u2019 head Julian Assange <a target=\"_blank\" title=\"could face the death penalty\" href=\"http:\/\/rt.com\/usa\/news\/usa-assange-wikileaks-extradition-manning\/\">could face the death penalty<\/a> for his heinous crime of leaking whistleblower information which make those in power uncomfortable \u2026 i.e. <a target=\"_blank\" title=\"being a reporter\" href=\"http:\/\/dissenter.firedoglake.com\/2012\/06\/27\/julian-assange-pursued-for-the-crime-of-practicing-journalism\/\">being a reporter<\/a>.<\/p>\n<p>Daniel Ellsberg notes that Obama\u2019s claimed power to indefinitely detain people without charges or access to a lawyer or the courts is a power that even <a target=\"_blank\" title=\"King George didn\u2019t claim\" href=\"http:\/\/www.washingtonsblog.com\/2013\/02\/daniel-ellsberg-obama-bush-cheney-rumsfeld-and-senators-voting-for-indefinite-detention-are-enemies-of-the-constitution.html\">King George didn\u2019t claim<\/a>.
