The high court has yet to decide on another challenge brought by the state of Hawaii, which has been upheld by the Ninth Circuit. <\/p>\n<div>\n<p>The legal challenge rejected by the Supreme Court on Tuesday originated in Maryland and involved a travel ban that has since been revised by the Trump administration.<\/p>\n<div class=\"arcticle__read-more read-more\">\n<p>Read more<\/p>\n<p>    <a class=\"read-more__link\" href=\"http:\/\/www.rt.com\/usa\/404563-us-supreme-court-travel-ban-briefing\/\" target=\"_blank\"><br \/>\n                    <img decoding=\"async\" class=\"read-more__cover\" src=\"https:\/\/cdni.rt.com\/files\/2017.09\/thumbnail\/59c944d7fc7e9388068b4567.jpg\" alt=\"The Supreme Court building at Capitol Hill in Washington D.C. \u00a9 Carlos Barria\"\/><br \/>\n    <\/a>\n<\/div>\n<p>The challenge still before the Supreme Court comes out of Hawaii and deals with the revised travel ban on six Muslim-majority countries as well as a separate ban on refugees.<\/p>\n<p>The refugee ban is not set to expire until October 24.<\/p>\n<p><strong><a href=\"https:\/\/www.rt.com\/usa\/403120-supreme-court-trump-travel-ban-restrictions\/\" target=\"_blank\" rel=\"noopener noreferrer\">READ MORE: SCOTUS restores Trump travel ban of refugees, blocking lower court<\/a><\/strong><\/p>\n<p>The high court <a href=\"http:\/\/www.scotusblog.com\/wp-content\/uploads\/2017\/10\/16-1436.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">ruled<\/a> Tuesday that because the provision in question expired by its own terms on September 24, the appeal <em>\u201cno longer presents a \u2018live case or controversy.\u2019\u201d<\/em> They vacated the case, which will be remanded to the Fourth Circuit with instructions to dismiss as moot the challenge to the March 6 executive order.<\/p>\n<p>Justice Sonia Sotomayor was the only dissenting opinion in the Tuesday decision. Sotomayor agreed that the Supreme Court should not hear the case, but argued that the ruling from the Fourth Circuit should have been kept in place.<\/p>\n<p>The previous order was <a href=\"https:\/\/ag.hawaii.gov\/wp-content\/uploads\/2017\/01\/News-Release-2017-67.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">challenged<\/a> by Hawaii as <em>\u201can unconstitutional effort by the President to fulfill his campaign promise to enact a Muslim ban.\u201d<\/em><\/p>\n<div class=\"rtcode\"><center><\/p>\n<blockquote class=\"twitter-tweet\" data-lang=\"en\">\n<p lang=\"en\" dir=\"ltr\">The facts speak for themselves:<\/p>\n<p>1) Trump admin issued third Muslim ban before Supreme Court could hear arguments.<\/p>\n<p>2) Courts repeatedly found ban to be illegal. SCOTUS did not say they were wrong.<\/p>\n<p>3) We&#8217;ll be in court Monday fighting to block Muslim Ban 3.0<a href=\"https:\/\/twitter.com\/hashtag\/NoMuslimBanEver?src=hash&amp;ref_src=twsrc%5Etfw\">#NoMuslimBanEver<\/a><\/p>\n<p>\u2014 ACLU (@ACLU) <a href=\"https:\/\/twitter.com\/ACLU\/status\/917913721506336769?ref_src=twsrc%5Etfw\">October 11, 2017<\/a><\/p><\/blockquote>\n<p><\/center><\/div>\n<p>Neal Katyal, a lawyer representing Hawaii, argued that the court should not overturn the lower court\u2019s ruling because of the Trump administration\u2019s<em> \u201cvoluntary actions.\u201d<\/em><\/p>\n<p><em>\u201cAny mootness would be entirely the consequence of the government\u2019s voluntary actions \u2014 in managing the timing of the bans, in declining to seek a swift hearing on the merits, and in rebottling its old ban in a new order,\u201d<\/em> Katyal said, according to the <a href=\"https:\/\/www.washingtonpost.com\/politics\/courts_law\/supreme-court-dismisses-case-against-trumps-expired-travel-ban\/2017\/10\/10\/2aef82d6-ad37-11e7-be94-fabb0f1e9ffb_story.html\" target=\"_blank\" rel=\"noopener noreferrer\">Washington Post<\/a>.<\/p>\n<p>However, Solicitor General Noel Francisco told the justices that since the travel ban was revised, the temporary measures under review would have been superseded.<\/p>\n<p><em>\u201cIf this court were to continue to hear these appeals, it would be asked to decide questions with no ongoing practical import,\u201d<\/em> Francisco said, according to the Post.<\/p>\n<p>A hearing on the third executive order, brought by the American Civil Liberties Union (ACLU), is scheduled for October 17.<\/p>\n<p>The court was due to hear arguments against the travel ban on Tuesday. However, in September the justices <a href=\"https:\/\/www.supremecourt.gov\/orders\/courtorders\/092517zr_jiel.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">ordered<\/a>\u00a0challenges to the March 6 executive order to be removed from the oral argument calendar.
