Anecdotal reports from labor lawyers and a few polls show that most Americans believe their bosses must have a good reason to kick them to the curb. We labor under the illusion of what Harvard labor economist Richard Freeman calls, \u201cthere\u2019s-got-to-be-a-law syndrome.\u201d We don\u2019t want to believe someone can be fired because her boss finds her <a target=_blank  href=\"http:\/\/redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&#038;u=http%3A%2F%2Fnews.yahoo.com%2Fcourt-irresistible-workers-fired-203924415--abc-news-topstories.html\">sexually irresistible<\/a>. In every other industrialized democracy, that couldn\u2019t legally happen, but in 49 of the 50 states there is no law requiring a just or reasonable cause for employee termination.<\/p>\n<p dir=\"ltr\">Most Americans can be legally fired for almost any reason. Private sector workplace relationships tend to operate under the standard of employment-at-will, which means you can be fired for the <a target=_blank  href=\"http:\/\/redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&#038;u=http%3A%2F%2Fwww.alternet.org%2Fstory%2F154825%2Ffired_for_wearing_the_wrong_color_shirt%253A_the_scary_truth_about_our_lack_of_workplace_protections\">color of your shirt<\/a>, your <a target=_blank  href=\"http:\/\/redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&#038;u=http%3A%2F%2Fwww.slate.com%2Farticles%2Fnews_and_politics%2Fchatterbox%2F2004%2F09%2Fbumper_sticker_insubordination.html\">political views<\/a>, supporting your favorite <a target=_blank  href=\"http:\/\/redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&#038;u=http%3A%2F%2Fwww.suntimes.com%2Fnews%2Fmetro%2F3488244-418%2Fstone-packers-wearing-bears-fired.html\">sports team<\/a> or for <a target=_blank  href=\"http:\/\/redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&#038;u=http%3A%2F%2Fwww.nytimes.com%2F2011%2F04%2F27%2Fopinion%2F27peril.html%3F_r%3D0\">refusing<\/a> to fetch your boss a cup of coffee. The Bill of Rights does not apply to your office. \u00a0\u00a0<\/p>\n<p dir=\"ltr\">The protections in place are limited. Title VII of the Civil Rights Act <a target=_blank  href=\"http:\/\/redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&#038;u=http%3A%2F%2Fwww.eeoc.gov%2Flaws%2Fstatutes%2Ftitlevii.cfm\">prohibits<\/a> \u201cemployment discrimination based on race, color, religion, sex and national origin.\u201d (But not sexual orientation: while 21 states have anti-discrimination laws on their books, it is legal under federal law to be <a target=_blank  href=\"http:\/\/redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&#038;u=http%3A%2F%2Fwww.hrc.org%2Flaws-and-legislation%2Ffederal-legislation%2Femployment-non-discrimination-act\">fired for your sexual preferences<\/a> or gender identity.) The National Labor Relations Act theoretically <a target=_blank  href=\"http:\/\/redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&#038;u=http%3A%2F%2Fwww.nlrb.gov%2Fnational-labor-relations-act\">protects<\/a> workers trying to form a union or engage in \u201cother concerted activities for the purpose of\u2026mutual aid or protection,\u201d <a target=_blank  href=\"http:\/\/redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&#038;u=http%3A%2F%2Fwww.alternet.org%2Fstory%2F154485%2Fshould_joining_a_union_be_a_civil_right\">but the law is notoriously weak<\/a>\u00a0and its sanctions rarely deter employers. Any union contract worthy of the name will include a just-cause clause, protecting workers from arbitrary termination while leaving room for management to act in case of economic necessity or poor job performance. But <a target=_blank  href=\"http:\/\/redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&#038;u=http%3A%2F%2Fwww.bls.gov%2Fnews.release%2Funion2.nr0.htm\">93.4 percent of private sector workers<\/a> don\u2019t have a union, and serve at the whim of their employers.<\/p>\n<p dir=\"ltr\">Unless they live in Montana.<\/p>\n<p dir=\"ltr\">In 1987 the legislature passed the Montana Wrongful Discharge Act, which states that (after a six-month probationary period) a worker can <a target=_blank  href=\"http:\/\/redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&#038;u=http%3A%2F%2Fwww.casefilemethod.com%2FStatutes%2FMontana.pdf\">only be fired for a good reason<\/a>, like \u201cfailure to satisfactorily perform job duties, disruption of the employer&#8217;s operation, or other legitimate business reason.\u201d That\u2019s awfully similar to the laws protecting the workers of almost every other industrially developed democratic nation on the planet (as this management-side <a target=_blank  href=\"http:\/\/redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&#038;u=http%3A%2F%2Fwww.hsp.com%2Fhsp-in-action%2Fevents%2Fbeyond-will-international-employment-best-practices\">presentation<\/a> warns); protections enjoyed by nations like the Netherlands &#8212; where a McDonalds employee can <a target=_blank  href=\"http:\/\/redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&#038;u=http%3A%2F%2Fwww.telegraph.co.uk%2Ffoodanddrink%2Ffoodanddrinknews%2F7080767%2FMcDonalds-wrong-to-fire-worker-over-cheese-slice.html\">win back pay<\/a> after being fired for giving an off-duty co-worker an extra slice of cheese with her burger (the company was required to cover court costs, too). \u00a0\u00a0<\/p>\n<p dir=\"ltr\">How did Montana become a socialist hellscape? The same way most laws are passed: With the backing of the organized business community. In early 1982 the Montana Supreme Court decided that an implied covenant of \u201cgood faith and fair dealing\u201d exists when an employer hires someone. Later rulings determined if an employer disregarded that tacit agreement, the spurned worker can sue to recover lost wages and benefits, along with compensatory and punitive damages. The court, in effect, killed employment-at-will in all but name, and workers started suing the hell out of the bosses. (Much of the historical and legal background on the law is found in Barry Roseman\u2019s American Constitutional Society\u2019s <a target=_blank  href=\"http:\/\/redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&#038;u=http%3A%2F%2Fbrief_0.pdf\">legal paper<\/a> on the law and its effects on employment in Montana.)<\/p>\n<p dir=\"ltr\">\u201cOne of the reasons why the bill was necessary is that we did not have employment-at-will in Montana, even though the law said we did,\u201d says Gary Spaeth, former Democratic legislator and lead sponsor of the 1987 law. \u201cThere were some outstanding judgments in the neighborhood of $200,000 to $400,000 that were passed down by juries.
