The Attorney-General\u2019s Office (AGO) will not request a prison sentence for a \u201cchild migrant\u201d who raped a 5 year-old boy in late 2015, Breitbart London<\/em> has established.<\/p>\n

The migrant, who told <\/a>the boy he would \u201cbreak him into pieces\u201d if he told anyone about the attack, was handed a non-custodial, three-year rehabilitation order by Judge\u00a0Jonathan Bennett<\/a>.\u00a0Defence lawyer Alwyn Jones<\/a> welcomed the ruling, saying he hoped it would \u201caddress the underlying issues this young man has.\u201d<\/p>\n

Any member of the public can request that the Law Officers of England and Wales appeal sentences of this nature under the Unduly Lenient Sentence<\/a>\u00a0scheme. Breitbart London<\/em> reported<\/a> last November that\u00a0at least one unknown member of the public had done so in this case.<\/p>\n

However, the AGO has since told Breitbart London<\/em> that Tory MP\u00a0Robert Buckland<\/a>, the Solicitor-General, has \u201ccarefully reviewed the papers\u201d and \u201cconcluded that if the sentence imposed on the offender was referred to the Court of Appeal, the Court would not increase the sentence\u201d.<\/p>\n

It was on this basis that Buckland \u201cdecided not the refer the case\u201d. The AGO gave Breitbart London<\/em> no indication as to its own assessment of the sentence\u2019s suitability.<\/p>\n

The original sentence was just one of a series of rulings which have encouraged accusations that the judiciary are \u201cout of touch\u201d with the ordinary public, with some calling for judges to be subject to retention elections<\/a>, as in Japan and several American states.<\/p>\n
