{"id":286621,"date":"2016-12-21T14:34:53","date_gmt":"2016-12-21T13:34:53","guid":{"rendered":"https:\/\/rinf.com\/alt-news\/newswire\/europes-highest-court-declares-uk-snooper-charter-illegal\/"},"modified":"2016-12-21T22:42:18","modified_gmt":"2016-12-21T21:42:18","slug":"europes-highest-court-declares-uk-snooper-charter-illegal","status":"publish","type":"post","link":"http:\/\/rinf.com\/alt-news\/latest-news\/europes-highest-court-declares-uk-snooper-charter-illegal\/","title":{"rendered":"Europe\u2019s highest court declares UK \u2018snooper charter\u2019 illegal"},"content":{"rendered":"<p>Britain\u2019s controversial \u2018snooper\u2019s charter\u2019 has been delivered a blow from the EU with its highest court ruling that the government\u2019s \u201cindiscriminate retention\u201d of emails is illegal.<\/p>\n<div>\n<p>The ruling could trigger challenges against the UK\u2019s new Investigatory Powers Act, passed into law in November, which allows for the sweeping collection and storage of people\u2019s emails, text messages and internet data.<\/p>\n<p>According to a long-awaited decision by the European Court of Justice (ECJ) in Luxembourg, only targeted interception of traffic and location data in order to combat serious crime is justified.<\/p>\n<p>The finding came in response to a legal challenge initially brought by the Brexit secretary, David Davis, before he got the role of helping Britain leave the bloc, and Tom Watson, Labour\u2019s deputy leader.<\/p>\n<p>They are concerned over the legality of cyber-spies at GCHQ bulk intercepting call records and online messages.<\/p>\n<p><em>\u201cThis ruling shows it is counter-productive to push new laws through parliament without proper scrutiny,\u201d<\/em> Watson told the Independent.<\/p>\n<p><em>\u201cAt a time when we face a real and ever-present terrorist threat, the security forces may require access to personal information none of us would normally hand over.<\/em><\/p>\n<p><em>\u201cThat\u2019s why it\u2019s absolutely vital that proper safeguards are put in place to ensure this power is now abused, as it has been in the recent past.<\/em><\/p>\n<p><em>\u201cMost of us can accept that our privacy may occasionally be compromised in the interests of keeping us safe, but no one would consent to giving the police or the government the power to arbitrarily seize our phone records or emails as they see fit.<\/em><\/p>\n<p><em>\u201cIt\u2019s for judges, not ministers, to oversee these powers. I\u2019m pleased the court has upheld the earlier decision of the UK courts,\u201d<\/em> Watson told the paper.<\/p>\n<p><iframe loading=\"lazy\" src=\"https:\/\/www.youtube.com\/embed\/b36co0WUOWM\" width=\"900\" height=\"506\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<p>Davis and Watson had already won a high court victory on the issue, but the government appealed and the case was referred to the ECJ.<\/p>\n<p>Martha Spurrier, the director of Liberty, which supports the MPs in bringing the case, said the judgment <em>\u201cupholds the rights of ordinary British people not to have their personal lives spied on without good reason or an independent warrant,\u201d<\/em> the Independent reported.<\/p>\n<div class=\"arcticle__read-more read-more\">\n<p><a class=\"read-more__link\" href=\"http:\/\/www.rt.com\/uk\/368592-investigatory-powers-surveillance-snoopers\/\" target=\"_blank\"><br \/>\n<img decoding=\"async\" class=\"read-more__cover\" src=\"https:\/\/img.rt.com\/files\/2016.11\/thumbnail\/583dab2cc3618888568b45c0.jpg\" alt=\"\u00a9 Aly Song\" \/><br \/>\n<\/a><\/p>\n<\/div>\n<p><em>\u201cThe government must now make urgent changes to the Investigatory Powers Act to comply with this.<\/em><\/p>\n<p><em>\u201cThis is the first serious post-referendum test for our government&#8217;s commitment to protecting human rights and the rule of law.<\/em><\/p>\n<p><em>\u201cThe UK may have voted to leave the EU \u2013 but we didn\u2019t vote to abandon our rights and freedoms.\u201d<\/em><\/p>\n<p>The government says it will appeal against the decision. A Home Office spokesperson said, <em>\u201cWe are disappointed with the judgment from the European Court of Justice and will be considering its potential implications.<\/em><\/p>\n<p><em>\u201cIt will now be for the Court of Appeal to determine the case.
