Forced arbitration &#8212; called a &#8220;contract gotcha&#8221; by the CFPB &#8212; had been banned in the mortgage industry by Dodd-Frank.\u00a0The law also specifically instructed the agency to study the practice throughout the financial sector.<\/p>\n<p>Last March, the CFPB released a <a href=\"https:\/\/www.districtsentinel.com\/tens-of-millions-unknowingly-waive-right-to-band-together-to-sue-banks-cfpb-finds\/\" data-slimstat-async=\"false\" data-slimstat-callback=\"false\" data-slimstat-tracking=\"false\" data-slimstat-type=\"2\" data-slimstat-clicked=\"false\">report<\/a>, which found that\u00a0three-out-of-four Americans were unaware that their credit card or bank account contracts contain hidden forced-arbitration language.<\/p>\n<p>If the rule is finalized following a 90-day public comment period, it will apply only to financial firms regulated by the consumer watchdog. Other businesses, including telecoms and healthcare providers, have also increasingly relied on forced arbitration clauses &#8212; upheld as legal in 2011 by the Supreme Court.<\/p>\n<p>Wall Street is expected to vigorously oppose the rule, since it could open them up to billions of dollars in claims, while forcing\u00a0them to change\u00a0business practices. The US Chamber of Commerce wasted no time in <a href=\"http:\/\/mobile.nytimes.com\/2016\/05\/05\/business\/dealbook\/consumer-agency-moves-to-assert-bank-customers-right-to-sue.html?_r=0&amp;referer\" data-slimstat-async=\"false\" data-slimstat-callback=\"true\" data-slimstat-tracking=\"true\" data-slimstat-type=\"0\" data-slimstat-clicked=\"false\">claiming<\/a> that the regulation was a &#8220;wolf in sheep&#8217;s clothing,&#8221; that will harm consumers.<\/p>\n<p>The CFPB&#8217;s findings, however, call that claim into disrepute.
