{"id":14904,"date":"2012-08-16T01:02:25","date_gmt":"2012-08-16T00:02:25","guid":{"rendered":"http:\/\/rinf.com\/alt-news\/?p=14904"},"modified":"2012-08-17T14:33:29","modified_gmt":"2012-08-17T13:33:29","slug":"facebook-biometric-profiling-could-be-illegal","status":"publish","type":"post","link":"http:\/\/rinf.com\/alt-news\/latest-news\/facebook-biometric-profiling-could-be-illegal\/","title":{"rendered":"Facebook biometric profiling could be illegal"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-14980\" title=\"fb\" src=\"http:\/\/rinf.com\/alt-news\/wp-content\/uploads\/2012\/08\/fb.jpg\" alt=\"\" width=\"580\" height=\"280\" srcset=\"http:\/\/rinf.com\/alt-news\/wp-content\/uploads\/2012\/08\/fb.jpg 580w, http:\/\/rinf.com\/alt-news\/wp-content\/uploads\/2012\/08\/fb-75x36.jpg 75w, http:\/\/rinf.com\/alt-news\/wp-content\/uploads\/2012\/08\/fb-150x72.jpg 150w, http:\/\/rinf.com\/alt-news\/wp-content\/uploads\/2012\/08\/fb-383x185.jpg 383w\" sizes=\"auto, (max-width: 580px) 100vw, 580px\" \/><\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p><strong><a href=\"http:\/\/www.rinf.com\">Mick Meaney<\/a>\u00a0&#8211; RINF News |<\/strong><\/p>\n<p>Facebook has come under fire again for refusing to delete\u00a0biometric profiles of its users, with the German office for data protection calling the practice illegal.<\/p>\n<p>Johannes Caspar, head of the Hamburg office for data protection, has\u00a0criticized Facebook for storing users biometric data without consent, claiming the social network is in breach of European privacy regulations.<\/p>\n<p>Today talks between Caspar and Facebook have failed, which centered around the websites &#8216;Photo Tag Suggest&#8217;\u00a0feature that allows Facebook to automatically identify users\u00a0unique facial characteristics.<\/p>\n<p>Mr Caspar,\u00a0who led the German investigation into\u00a0Google\u2019s illegal collection of personal data during its controversial Street View project,\u00a0has requested that Facebook give members the choice of opting in to the service, rather than opting out.<\/p>\n<p>Mr Caspar wants the website to come into line with\u00a0\u00a0European Union privacy rules, saying:\u00a0\u201cFacebook will be obliged to delete this data unless it obtains approval by all concerned users,\u201d he said, adding that \u201cdue to the immense potential of misuses of biometric data the explicit consent is a legal requirement for the collecting and processing of biometric data.\u201d<\/p>\n<p>Facebook deny any wrong doing, claiming the service\u00a0\u201cis fully compliant with EU data protection laws.\u201d<\/p>\n<p>&#8220;During our continuous dialogue with our supervisory authority in Europe, the Office of the Irish Data Protection Commissioner, we agreed to develop a best practice solution to notify people on Facebook about Photo Tag Suggest.&#8221;<\/p>\n<p>The &#8216;Photo Tag Suggest&#8217; feature had been suspended for new European users, as of 1 July 2012, while Facebook discus the issue with authorities.<\/p>\n<p>Mr Caspar welcomed the decision but noted:\u00a0\u00a0&#8220;Facebook clearly recognises that the process of collecting biometric data is at least not in accordance with data protection law in Europe. But Facebook can&#8217;t just stay halfway there.&#8221;<\/p>\n<p>Facebook could be fined a paltry 25,000 euros ($31,000) if it refuses to change its consent practices and\u00a0remove the biometric database.<\/p>\n<p>The social giant is showing no signs of slowing down its data collection plans, and is about to build a\u00a062,000-square-foot data center in additional to its two existing data centers, at its\u00a0Prineville facility in\u00a0\u00a0Oregon.<\/p>\n<p><a href=\"http:\/\/www.flickr.com\/photos\/thos003\/\" target=\"_blank\">Image credit<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>&nbsp; &nbsp; Mick Meaney\u00a0&#8211; RINF News | Facebook has come under fire again for refusing to delete\u00a0biometric profiles of its users, with the German office for data protection calling the practice illegal.
