{"id":132187,"date":"2014-07-21T18:06:45","date_gmt":"2014-07-21T18:06:45","guid":{"rendered":"http:\/\/rinf.com\/alt-news\/?p=132187"},"modified":"2014-07-21T18:06:45","modified_gmt":"2014-07-21T18:06:45","slug":"revealed-1000-complaints-nypd-chokeholds-recent-years","status":"publish","type":"post","link":"http:\/\/rinf.com\/alt-news\/breaking-news\/revealed-1000-complaints-nypd-chokeholds-recent-years\/","title":{"rendered":"Revealed: More than 1,000 complaints of NYPD chokeholds in recent years"},"content":{"rendered":"<p style=\"color: #000000;\">There have been over 1,000 complaints of New York City police misconduct in recent years regarding officers\u2019 use of chokeholds, a city agency that is investigating the incidents said days after a man put into hold by police died in Staten Island.<\/p>\n<p style=\"color: #000000;\">The Civilian Complaint Review Board has received charges of about 1,022 instances since 2009 in which New York Police Department (NYPD) officers were accused of using chokeholds. Use of such holds are prohibited by the NYPD\u2019s patrol guidelines, which outline a chokehold as a\u00a0<em>\u201cany pressure to the throat or windpipe, which may prevent or hinder breathing or reduce intake of air.\u201d<\/em><\/p>\n<p style=\"color: #000000;\">Richard Emery, the chairman of the complaint review board, said the agency was\u00a0<em>\u201cin the unique position of being able to look at the chokehold complaints it has received to attempt to discern why officers continue to use this forbidden practice.\u201d<\/em><\/p>\n<p style=\"color: #000000;\">In only nine of the 1,022 instances has the board gathered enough evidence to definitively say a chokehold had been used. In hundreds of other cases, the board did not have enough evidence to make a determination, or the investigations fell apart when the person lodging the allegation could not be reached or stopped cooperating.<\/p>\n<p style=\"color: #000000;\">The review board\u2019s study of the incidents was announced on Saturday, two days after Eric Garner, 43, died when officers\u00a0<a style=\"color: #044faa;\" href=\"http:\/\/rt.com\/usa\/173996-father-of-six-nypd-choking\/\" target=\"_blank\">appeared to use a chokehold<\/a>\u00a0&#8211; Police Commissioner Bill Bratton has confirmed &#8211; in the process of arresting him on a sidewalk in Staten Island.<\/p>\n<p style=\"color: #000000;\">Garner, father of six who suffered from health problems including severe asthma, argued with officers after they accused him of illegally selling untaxed cigarettes.<\/p>\n<p style=\"color: #000000;\">In the process of subduing Garner, an NYPD officer &#8211; Daniel Pantaleo, the New York Times\u00a0<a style=\"color: #044faa;\" href=\"http:\/\/www.nytimes.com\/2014\/07\/20\/nyregion\/thousands-police-chokehold-complaints-are-focus-of-new-york-study-after-man-dies-in-staten-island.html?_r=1\" target=\"_blank\">reported<\/a>\u00a0&#8211; threw his arm around Garner\u2019s neck, holding firmly for several seconds as the much-larger Garner fell to the ground. Several other officers arrived on the scene to put handcuffs on Garner, who can be heard in a recording of the incident repeatedly saying,\u00a0<em>\u201cI can\u2019t breathe.\u201d<\/em>\u00a0Shortly afterwards, Garner, reportedly in cardiac arrest, stopped moving or responding to police.<\/p>\n<p style=\"color: #000000;\">\n<div class=\"ration_16-9\"><iframe loading=\"lazy\" src=\"http:\/\/www.youtube.com\/embed\/vT66U_Ftdng?rel=0\" width=\"420\" height=\"315\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/div>\n<p>&nbsp;<\/p>\n<p style=\"color: #000000;\">The city\u2019s medical examiner\u2019s office has conducted an autopsy on Garner, which could determine whether the chokehold contributed to his death. Yet the office has yet to release the results.<\/p>\n<p style=\"color: #000000;\"><em>\u201cAt this time, no determination has been made by the Medical Examiner\u2019s office as to the cause and manner of death of Eric Garner,\u201d<\/em>\u00a0said Julie Bolcer, a spokeswoman for the medical examiner\u2019s office, in a statement.<\/p>\n<p style=\"color: #000000;\">Officer Pantaleo is an eight-year NYPD veteran who was assigned to a plainclothes unit in the 120th Precinct covering northern Staten Island. He is currently under investigation by the Staten Island district attorney\u2019s office and the NYPD\u2019s Internal Affairs Bureau. He has been assigned to desk duty since the incident, as the NYPD formally asked for his gun and badge on Saturday.<\/p>\n<p style=\"color: #000000;\">Pantaleo has not publicly commented on the incident thus far.<\/p>\n<p style=\"color: #000000;\">Patrick J. Lynch, president of the Patrolmen\u2019s Benevolent Association, which is representing Pantaleo, criticized the department\u2019s restrictions placed on accused officer.<\/p>\n<p style=\"color: #000000;\"><em>\u201cIt is a decision by the department that effectively prejudges this case and denies the officer the very benefit of a doubt that has long been part of the social contract that allows police officers to face the risks of this difficult and complex job,\u201d<\/em>\u00a0Lynch said, according to the Times.<\/p>\n<p style=\"color: #000000;\">Since 2013, Pantaleo has been sued for civil rights violations twice in federal court, the Times reported.<\/p>\n<p style=\"color: #000000;\">Mourning relatives and friends of Garner criticized NYPD aggression on Saturday at a rally held at a Staten Island church. Later, attendees marched to the spot where Garner died.<\/p>\n<p style=\"color: #000000;\"><em>\u201cHe didn\u2019t die because he stopped breathing on his own, somebody took his breath away,\u201d<\/em>\u00a0said Ellisha Flagg, Garner\u2019s sister.<\/p>\n<p style=\"color: #000000;\">She added that her brother did not deserve such treatment for the alleged crime of selling illegal cigarettes.<\/p>\n<p style=\"color: #000000;\"><em>\u201cA cigarette, are you serious?\u201d<\/em>\u00a0she said.<\/p>\n<p style=\"color: #000000;\">The original video recording of the incident was obtained\u00a0<a style=\"color: #044faa;\" href=\"http:\/\/www.nydailynews.com\/new-york\/staten-island-man-dies-puts-choke-hold-article-1.1871486\">exclusively<\/a>\u00a0by The New York Daily News.
