{"id":127978,"date":"2014-07-04T16:11:53","date_gmt":"2014-07-04T16:11:53","guid":{"rendered":"http:\/\/rinf.com\/alt-news\/?p=127978"},"modified":"2014-07-04T16:11:53","modified_gmt":"2014-07-04T16:11:53","slug":"supreme-courts-women-scathing-dissent-contraception-ruling","status":"publish","type":"post","link":"http:\/\/rinf.com\/alt-news\/breaking-news\/supreme-courts-women-scathing-dissent-contraception-ruling\/","title":{"rendered":"Supreme Court&#8217;s Women in Scathing Dissent on Contraception Ruling"},"content":{"rendered":"<p class=\"subtitle\" style=\"color: #000000;\"><strong>High Court Blocks Obamacare&#8217;s Contraception Mandate for Christian College<\/strong><\/p>\n<p style=\"color: #121212;\">The US Supreme Court late Thursday handed religiously affiliated nonprofit groups a big victory in the ongoing battle between &#8216;religious freedom&#8217; and women\u2019s rights.<\/p>\n<p style=\"color: #121212;\">The unsigned, provisional ruling exempts Wheaton College in Illinois from the Obamacare contraceptive coverage requirement if the Christian school tells the Obama administration that it objects to providing birth control to its employees and students for religious reasons.<\/p>\n<p style=\"color: #121212;\">The court\u2019s order drew an unusually angry reaction from the 3 female Justices: Ruth Bader Ginsburg, Elena Kagan and Sonia Sotomayor. The three women issued\u00a0<a style=\"color: #005588;\" href=\"http:\/\/images.politico.com\/global\/2014\/07\/03\/13a1284.pdf\">a scathing 16-page dissent<\/a>\u00a0(.pdf) that sharply criticized the court majority for backtracking on its Hobby Lobby decision last Monday.<\/p>\n<p style=\"color: #121212;\">The court\u2019s 5-4 decision in Burwell v Hobby Lobby provided for-profit corporations with a similar exemption.<\/p>\n<p style=\"color: #121212;\">\u201cThose who are bound by our decisions usually believe they can take us at our word,\u201d Justice Sotomayor wrote. \u201cNot so today.\u201d<\/p>\n<p style=\"color: #121212;\">The court\u2019s action, she added, even \u201cundermines confidence in this institution.\u201d<\/p>\n<p style=\"color: #121212;\">\u201cAfter expressly relying on the availability of the religious-nonprofit accommodation to hold that the contraceptive coverage requirement violates [the Religious Freedom Restoration Act] as applied to closely held for-profit corporations, the Court now, as the dissent in Hobby Lobby feared it might, retreats from that position.\u201d<\/p>\n<p style=\"color: #121212;\">\u201cI do not doubt that Wheaton genuinely believes that signing the self-certification form is contrary to its religious beliefs,\u201d wrote Sotomayor. \u201cBut thinking one\u2019s religious beliefs are substantially burdened \u2014 no matter how sincere or genuine that belief may be \u2014 does not make it so.\u201d<\/p>\n<p style=\"color: #121212;\">\u201cThe issuance of an injunction in this case will presumably entitle hundreds or thousands of other objectors to the same remedy,\u201d she said.<\/p>\n<p style=\"color: #121212;\"><em><a href=\"https:\/\/www.commondreams.org\/headline\/2014\/07\/04-0\" target=\"_blank\">This piece<\/a> was reprinted by <a href=\"http:\/\/www.rinf.com\" target=\"_blank\">RINF Alternative News<\/a> with permission or license.<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>High Court Blocks Obamacare&#8217;s Contraception Mandate for Christian College The US Supreme Court late Thursday handed religiously affiliated nonprofit groups a big victory in the ongoing battle between &#8216;religious freedom&#8217; and women\u2019s rights.
