A slave is somebody compelled to provide service to another.\u00a0Elane Huguenin<\/a>, a wedding photographer from New Mexico, was arraigned before that state\u2019s \u201chuman rights\u201d soviet for politely declining to provide her services to a lesbian couple planning a \u201ccommitment ceremony\u201d (the state doesn\u2019t recognize same-sex marriage).<\/p>\n

The couple had no difficulty finding another photographer willing to accept payment for that service, and thanks to their punitive impulses \u2014 and the totalitarian \u201cpublic accommodations\u201d law in that state \u2014 they were able to use money extracted from Huguenin in the form of fines in order to pay for their photographs.<\/p>\n

In declining the couple\u2019s business, Elane Huguenin did not injure or defraud anybody. The same is true of Antonio Darden, a gay hairdresser from Santa Fe who earned nation-wide publicity a couple of years ago when he\u00a0announced that he would not accept business from New Mexico Governor Susana Martinez because she is an opponent of same-sex marriage. Both Huguenin and Darden sought to exercise their property rights by declining proposed business transactions. Only Darden was permitted to do so, because he \u2014 unlike Huguenin \u2014 belongs to a \u201cspecially protected\u201d class.<\/p>\n

In its ruling upholding the actions of New Mexico\u2019s \u201chuman rights\u201d soviet<\/a>, the State Supreme Court claimed that the lesbian couple had a right \u201cto obtain goods and services from a public accommodation without discrimination on the basis of \u2026 sexual orientation.\u201d This assumes that business owners like Huguenin have a duty to provide such services \u2014 and no right to decline participation in that transaction. In other words, involuntary servitude \u2014 despite being explicitly banned by the 13th Amendment \u2014 is justified in the service of \u201canti-discrimination\u201d policy.<\/p>\n

Attorneys on behalf of Huguenin appealed that ruling to the US Supreme Court, contending that it violated the free speech and religious liberty \u201cguarantees\u201d of the First Amendment \u2014 which it manifestly did. Huguenin\u2019s legal counsel could have argued that the state\u2019s Human Rights Act \u2013 which was amended in 2003 to include \u201csexual orientation\u201d within the protected categories \u2013 represents a wholesale violation of property rights. This argument would only find traction, unfortunately, in a society where property rights are properly understood.<\/p>\n

Huguenin\u2019s counsel could have pointed out that the preferential treatment of property owners such as Mr. Darden \u2014 who is allowed to discriminate against some customers on ideological grounds \u2014 violates the principle of equal protection under the law. But such preferential treatment is the entire point of \u201ccivil rights\u201d enactments.<\/p>\n

The US Supreme Court has declined Hugeunin\u2019s appeal,<\/a>\u00a0tacitly ratifying the state supreme court\u2019s endorsement of involuntary servitude in the name of \u201ctolerance.\u201d<\/p>\n
