Tuesday, June 24th, 2008 الثلاثاء ، يونيو 24th ، 2008 Hearings for terrorism suspects before US military tribunals in Guantanamo Bay are going ahead despite a Supreme Court ruling that affirmed the detainees have a right to challenge their detention in a civilian court. جلسات استماع للالارهاب المشتبه بهم قبل المحاكم العسكرية الامريكية فى خليج غوانتانامو ماضية قدما على الرغم من قرار المحكمه العليا اكدت ان المعتقلين لديها الحق في الطعن في احتجازهم في محكمة مدنيه.
Legal experts had described the high court’s decision as the death knell of the special tribunals created by President George W Bush and his Republican allies in Congress to try “war on terror” suspects. الخبراء القانونيين ووصف قرار المحكمه العليا كما وفاة دقة النعي من المحاكم الخاصة التي انشأها الرئيس جورج دبليو بوش والجمهوري في الكونغرس والحلفاء لمحاكمة "الحرب على الارهاب" المشتبه فيهم.
But Justice Department chief Michael Mukasey said the controversial tribunals at the US naval base in Guantanamo Bay, Cuba, would continue their work and last week, two preliminary hearings were held as scheduled. ولكن رئيس ادارة العدل وقال مايكل mukasey للجدل المحاكم في القاعده البحرية الامريكية فى خليج غوانتانامو ، كوبا ، وستواصل عملها والاسبوع الماضي ، وهما الاولى وعقدت جلسات كما كان مقررا.
The hearings focused on Omar Khadr and Mohammed Jawad, a Canadian and Afghan both detained in Afghanistan for having allegedly thrown grenades when they were still teenagers. جلسات الاستماع التي تركز على عمر خضر ومحمد جواد ، والكنديه والافغانيه على حد سواء لالمحتجزين في افغانستان بعد ان زعم ان قنبلة يدوية القيت عندما كانت لا تزال في سن المراهقه.
The new judge overseeing the Canadian’s case, Colonel Patrick Parrish, who replaced another military judge who was forced to step down, announced that the trial for Khadr would start on October 8. الجديد القاضي الكندي الاشراف على حاله ، والعقيد باتريك تقريبا سلمون صغير ، من آخر محل القاضي العسكري من واضطرت الى تقديم استقالتها ، واعلن ان المحاكمه ستبدأ لخضر 8 تشرين الاول / اكتوبر.
Jawad reportedly used his hearing to denounce his treatment, alleging during a two-week period US guards changed his cell every two hours to prevent him from sleeping, a technique dubbed the “frequent flyer program.” جواد استخدمت بلدة جلسة للتنديد علاجه ، زاعمه خلال فترة اسبوعين من دولارات الولايات المتحدة تغيير حراس زنزانته كل ساعتين لمنعه من النوم ، وهي تقنيه اطلق عليها اسم "برنامج المسافر الدائم".
Meanwhile a three-judge panel in federal court on Friday declined to intervene in the Khadr case in an appeal that focused on a procedural dispute. وفي غضون ثلاثة قضاة في المحكمه الاتحادية ليوم الجمعة ورفض التدخل في القضية خضر في الاستئناف ان تركز على النزاع الاجراءيه.
The decision though does not preclude federal judges from wading directly into the tribunal trials in Guantanamo in the aftermath of the Supreme Court’s ruling, which rejected the government’s assertion that the detainees lack habeas corpus rights. رغم ان القرار لا يمنع القضاة الاتحاديين من الخوض مباشرة الى المحكمه المحاكمات في غوانتانامو في اعقاب قرار المحكمه العليا الذي رفض تأكيد الحكومة بأن عدم وجود معتقلين الحق في المثول امام القضاء الانسان.
The US Court of Appeals for the US capital on Monday ruled that Chinese prisoner Huzaifa Parhat, of the Chinese Muslim Uighur minority, is not an enemy combatant and has the right to seek his release from custody at Guantanamo. الولايات المتحدة لمحكمة الاستئناف في العاصمة الأميركية يوم الاثنين حكمت بأن السجين huzaifa parhat الصينية ، والصينية من الاقليه المسلمه الاويغوريه ، وليس المحارب العدو ولها الحق في السعي الى اطلاق سراحه من السجن في غوانتانامو.
Parhat’s release, however, was not expected any time soon since the appeals court said the Pentagon could hold a new tribunal on his status, which observers deemed likely. Parhat الافراج ، ومع ذلك ، لم يكن من المتوقع فى اى وقت قريب حيث ان محكمة الاستئناف وقال البنتاجون الجديدة ويمكن ان تعقد المحكمه على وضعه ، والتي من المرجح ان يعتبر المراقبون.
Details of the decision were not immediately available because it involved classified information, according to the appeals court statement. تفاصيل القرار لم تكن متاحة على الفور لانها تنطوي على معلومات سرية ، وفقا لبيان ان محكمة الاستئناف.
‘More to come’ 'اكثر المقبلة'
Although no trial has begun in earnest at the Guantanamo naval base, 19 detainees have been charged and “there will be more coming in the not too distant future,” said Joe DellaVedova of the office of military commissions. وبالرغم من عدم وبدأت المحاكمه بشكل جاد في قاعدة غوانتانامو البحرية ، و 19 معتقلين وجهت تهمة "سيكون هناك مزيد القادمة في المستقبل غير البعيد ،" قال جو dellavedova من مكتب اللجان العسكرية.
“The military commissions process continues to move forward, in a fair, open and transparent manner,” he said. "لجان عسكرية لا تزال عملية للتحرك الى الأمام ، في ونزيهة ومفتوحة وشفافة".
Among those already charged are several suspects who allegedly planned the September 11 attacks, as well as Al Qaeda militants accused of having fired rockets in the vicinity of US troops in Afghanistan or having undergone training in the use of explosives. ومن بين تلك التي سبق ان اتهم العديد من المشتبه فيهم من يزعم المخططه اعتداءات 11 ايلول / سبتمبر ، وكذلك القاعده المسلحين اطلقوا النار بعد ان اتهم من الصواريخ على مقربة من القوات الامريكية فى افغانستان او تحولت الى التدريب على استخدام المتفجرات.
The first tribunal trial is scheduled to start on July 21 in a newly set up “portable” courtroom to try Salim Hamdan, a Yemeni who worked as a driver and bodyguard for Osama bin Laden. اول محاكمة في المحكمه ومن المقرر ان تبدأ في 21 تموز / يوليو حديثا انشاء "محمول" في قاعة المحكمه لمحاكمة سليم حمدان ، وهو يمني من يعمل سائقا والحرس الشخصي لاسامة بن لادن.
The judge in the case, Captain Keith Allred, has scheduled a hearing for July 14 that will likely offer a chance to assess the consequences of the landmark Supreme Court ruling for the tribunals. القاضي الذي ينظر في القضية ، الكابتن كيث allred ، من المقرر عقد جلسة استماع في 14 تموز / يوليو لانه من المرجح ان توفر فرصة لتقييم النتائج المترتبة على المعلم حكم المحكمه العليا للمحكمتين.
The fallout from the high court’s ruling is still unclear. من تداعيات الحكم الصادر عن المحكمه العليا ولا يزال غير واضح.
The justices concluded that the naval base in Guantanamo Bay, officially on Cuban territory, can be treated as US territory where rights enshrined in the US Constitution must be respected. وخلص القضاة الى ان قاعدة بحرية في خليج غوانتانامو ، رسميا على الاراضى الكوبية ، يمكن ان تعامل على انها الاراضي الاميركية حيث الحقوق المنصوص عليها في دستور الولايات المتحدة يجب ان تحترم.
But it remains an open question if inmates enjoy all rights named in the constitution or only certain fundamental rights. ولكن يبقى السؤال مطروحا اذا كان السجناء يتمتعون بجميع الحقوق المذكورة في الدستور او بعض الحقوق الاساسية فقط.
