UK court rules against gov’t in key Guantanamo case المملكه المتحدة ضد gov't من قواعد المحكمه في القضية الرئيسية غوانتانامو
Reuters - A British court ruled on Thursday that the government must disclose evidence to a defendant being held at Guantanamo Bay, a decision that carried with it implicit criticism of US government detention policies. رويترز -- حكمت محكمة بريطانيه يوم الخميس انه يجب على الحكومة ان تكشف عن أدلة لأحد المدعى عليهم محتجزين في خليج غوانتانامو ، وهو قرار يحمل معه ضمنا انتقاد سياسات الحكومة الامريكية الاحتجاز.
In its ruling, the High Court said Britain’s Foreign Office must provide Binyam Mohamed, a British resident detained in Pakistan in 2002 and now held at Guantanamo, with information relating to his time in detention. في حكمها ، وقالت المحكمه العليا في بريطانيا يجب ان تقدم وزارة الخارجية binyam محمد ، المقيم البريطاني الذي اعتقل في باكستان في عام 2002 وتعقد الان في غوانتانامو ، مع المعلومات ذات الصلة وقته في الاعتقال.
His lawyers say the material supports his claim to have been “extraordinarily rendered”, tortured and forced into a confession on terrorism charges. ويقول محاميه المواد يرى انه يؤيد زعمه قد "تقدم غير عادي" ، والتعذيب ، وارغامهن على اعتراف بتهم تتعلق بالارهاب.
Lord Justice Thomas and Lord Justice Lloyd Jones said the Foreign Office had a duty to “disclose in confidence” the information Mohamed was seeking in order for his lawyers to mount a proper defence of the charges against him. اللورد توماس العدل والعدالة اللورد لويد جونز وقالت وزارة الخارجية كان من واجب "تكشف عن الثقة في" المعلومات التي كانت تسعى لذلك في محمد من اجل لمحاميه الى جبل مناسب للدفاع عن التهم الموجهة اليه.
Mohamed’s legal team was buoyant after the ruling, calling it a “momentous decision” that showed the British legal system’s determination to stand up for human rights while condemning the US government’s detention procedures at Guantanamo. محمد القانوني للفريق كان مزدهرا وبعد صدور الحكم ، وهذه التسميه "القرار التاريخي" تبين ان النظام القانوني البريطاني عزم لندافع عن حقوق الانسان في الوقت الذي ندين فيه الحكومة الامريكية اجراءات الاحتجاز في غوانتانامو.
“Today’s judgment reflects the abhorrence of decent society at the methods employed by the United States’ government in the supposed ‘war on terror’,” said Richard Stein, a lawyer with Leigh Day & Co, the solicitors who brought the case. "حكم اليوم يعبر عن اشمئزازها من اللائق في المجتمع الاساليب المستخدمة من قبل الولايات المتحدة من المفترض ان الحكومة في' الحرب على الارهاب '" ، قال ريتشارد شتاين ، وهو محام مع لأي يوم & أول أكسيد الكربون ، والمحامون من اوصل القضية.
“We can only hope that the foreign secretary will now reflect on this judgment and provide direct assistance to Binyam’s defence team.” "ولا يسعنا الا ان نأمل ان وزير الخارجية الان ان نفكر في هذا الحكم وتقديم مساعدة مباشرة الى binyam للفريق الدفاع."
NATIONAL SECURITY الأمن الوطني
In a statement, the Foreign Office said it was considering the implications of the court’s rulings “very carefully” and said it had only not divulged the information so far because of national security reasons. في بيان وزارة الخارجية وقال انها تنظر في الآثار المترتبة على احكام المحكمه "بعناية فاءقه" ، وقال انه لا يكشف فقط المعلومات حتى الان نظرا لاسباب تتعلق بالامن القومي.
“We have never contested that Mr Mohamed’s defence lawyers should have access to information which would assist him in his defence in any trial at Guantanamo Bay,” the statement said. "ونحن لم جدال في ان السيد محمد محامي الدفاع ينبغي ان يكون الوصول إلى المعلومات التي من شأنها مساعدته في دفاعه في اي محاكمة في خليج غوانتانامو ،" وجاء في البيان.
“For strong reasons of national security, to which the court accepted we were entitled to give the highest weight, we could not agree to disclose this information voluntarily.” "لاسباب قوية للامن الوطنى ، التى قبلت المحكمه ونحن يحق لاعطاء وزن اكبر ، ونحن لا يمكن ان توافق على الكشف عن هذه المعلومات طواعيه."
Lawyers for Mohamed, an Ethiopian national, say the information relates to interrogations he was subjected to by Britain’s secret services while being held in Pakistan in 2002. محامو محمد ، واثيوبي وطنية ، تقول معلومات تتعلق الاستجوابات وقد تعرض لبريطانيا في حين ان الخدمات السرية التى تعقد فى باكستان فى عام 2002.
Following those interrogations, lawyers say Mohamed was flown by the CIA to Morocco in July 2002, where he was tortured, including having his penis cut with a razor. وعقب تلك الاستجوابات ، ويقول وكلاء محمد جوا من قبل وكالة المخابرات المركزية الى المغرب في تموز / يولية 2002 ، حيث تعرض للتعذيب ، بما في بلده بعد ان قطع القضيب مع شفره. He was held there for 18 months, they say, and quizzed about information they argue could only have come from British questioning. وقد احتجز هناك لمدة 18 شهرا ، ويقولون ، وممتحن عن المعلومات ويقولون يمكن الا ان يكون البريطانية تأتي من الاستجواب.
In January 2004 Mohamed was flown to Kabul and then transferred to Bagram air base. في كانون الثاني / يناير 2004 محمد جوا الى كابول ثم نقل الى قاعدة باغرام الجوية. US authorities deny that Mohamed was extraordinarily rendered or tortured and have only provided details of his detention in Afghanistan. السلطات الامريكية ان ينكر ان محمد كان استثنائيا واصدرت للتعذيب او سوى تفاصيل احتجازه في افغانستان.
He is being tried before a US military commission on terrorism charges and faces the death penalty if found guilty. وهو الان يحاكم امام لجنة عسكرية من دولارات الولايات المتحدة بتهم تتعلق بالإرهاب ويواجه عقوبة الاعدام اذا ثبتت ادانتهم.
In its ruling, the High Court levelled implicit criticism at the US government’s judicial procedures and suggested that basic rights that the British have held essential since the 13th century were being overlooked or set aside. في حكمها ، على نحو ضمني المحكمه العليا في الولايات المتحدة انتقادات للحكومة والاجراءات القضاءيه والحقوق الاساسية واقترح ان من الضروري البريطانية قد عقدت منذ القرن الثالث عشر كان يجري تجاهله أو إهماله.
“It is a basic and long established value in any democracy that the location of those in custody is made known to the detainee’s family and those representing him,” the court said. "انه امر اساسي والطويل الأمد على قيمة الديمقراطيه في أي مكان إن في تلك الحضانه معروفة للاسرة المعتقل وتلك التي تمثل له :" وقالت المحكمه.
