The Canadian Security Intelligence Service violated the constitutional rights of a citizen and strayed beyond its security mandate into the realm of law enforcement, says a federal watchdog. داءره الاستخبارات الامنية الكنديه ينتهك الحقوق الدستورية للمواطن ومتيه خارجة عن ارادتها ولاية الامن في مجال انفاذ القانون ، يقول احد كلب الحراسه الاتحادية.
In its annual report tabled late yesterday, the Security Intelligence Review Committee said Canada’s spy agency “arbitrarily detained” Mohammed Mansour Jabarah in contravention of the Charter of Rights. في تقريرها السنوي قدمت فى وقت متأخر امس ، واستعراض لجنة الاستخبارات الامنية في كندا وقالت وكالة التجسس "المعتقلين اعتباطا" محمد منصور jabarah يتعارض مع ميثاق الحقوق.
Jabarah, a Canadian citizen, is an admitted Al Qaeda member and leader of a terrorist cell that plotted to bomb the American and Israeli embassies in Singapore and Manila. Jabarah ، وهو مواطن كندي ، هو اعترف عضو في تنظيم القاعده وزعيم خلية ارهابية أن تآمر لتفجير السفارتين الامريكية والاسرائيلية في سنغافورة ومانيلا. He was apprehended in Oman in March 2002 after the plan was derailed. وتم القبض عليه في عمان في آذار / مارس 2002 بعد ان تم الانتهاء من وضع خطة تحيد عن مسارها.
“Jabarah is a terrorist but also a Canadian citizen, and no matter how despicable his actions, the Charter conferred on him certain fundamental rights,” the review committee says in the report to Parliament. "Jabarah هو ارهابي وانما ايضا مواطن كندي ، ومهما كانت افعاله الدنيءه ، وميثاق المسنده اليه من بعض الحقوق الاساسية" لجنة الاستعراض جاء في تقرير الى البرلمان.
CSIS officials travelled to Oman and arranged for Jabarah’s return to Canada and subsequent transfer to the United States on a government-owned aircraft, since he apparently could not be charged with a crime under Canadian law. الدائرة المسؤولين وسافر الى عمان لترتيب jabarah العودة الى كندا ونقله بعد ذلك الى الولايات المتحدة على الطائرات المملوكه للحكومة ، اذ يبدو انه لا يمكن ان يتهم بارتكاب جريمه بموجب القانون الكندي.
He pleaded guilty in the US to a number of terrorism-related offences. وقال انه اعترف بانه مذنب في الولايات المتحدة الى عدد من الجرائم ذات الصلة بالارهاب. Jabarah has not been sentenced and remains behind bars. Jabarah لم يكن المحكوم عليه لا يزال وراء القضبان.
The review committee, which reports to Parliament, examined CSIS’s investigation against service operational policy and procedures, ministerial direction and applicable Canadian law, including the CSIS Act and the Charter of Rights and Freedoms. لجنة الاستعراض ، التي تقدم تقاريرها الى البرلمان ، درست الدائرة ضد التحقيق الذي تجريه داءره السياسات والاجراءات التنفيذية ، الوزاري والتوجيه وينطبق القانون الكندي ، بما في هذه الدائرة ، وقانون ميثاق الحقوق والحريات.

The report found Jabarah’s decisions, made without the benefit of any independent legal advice, resulted in his self-incrimination and surrender to US authorities. وخلص التقرير الى jabarah قرارات ، ادلى دون الاستفادة من اي مشوره قانونيه مستقلة ، في بلدة أدى الى تجريم الذات والتقديم الى السلطات الامريكية.
“SIRC’s review raised questions regarding CSIS’s contention that Jabarah’s decisions were made freely and voluntarily.” "Sirc استعراض تساؤلات بشأن ادعاء ان هذه الدائرة jabarah قرارات بحرية وبمحض الاراده."
The committee said a court would also have considered various factors, including: Jabarah’s age, his emotional state, whether his fear of the alternatives influenced his return to Canada from Oman, the length of time he spent in the company of CSIS officials while in Canada, and the circumstances surrounding his decision to surrender himself to a foreign jurisdiction. وقالت اللجنة ان المحكمه قد نظرت ايضا عوامل مختلفة ، من بينها : jabarah عمر ، قال ان الدولة العاطفية ، ما اذا كان خوفه من ان البدائل التي اثرت عودته إلى كندا من عمان ، وطول الفترة الزمنية التي قضاها في الشركة من المسؤولين في حين ان داءره الاستخبارات الامنية وفي كندا ، والظروف التي تمر بها قراره بتسليم نفسه الى ولاية قضائية اجنبية.
A CSIS official told the committee Jabarah was not “read his rights” because CSIS isn’ta police service. أ الدائرة الرسمية قال للجنة jabarah لم يكن "اقرأ حق حقه" ، لأن هذه الدائرة isn'ta داءره الشرطة. “This response, subsequently confirmed in writing by the service, demonstrates a misunderstanding of the application of the Charter to government representatives carrying out their official duties.” "هذا وردا على ذلك ، وفي وقت لاحق اكدت خطيا من قبل الدائرة ، ويدل على سوء فهم للتطبيق الميثاق لممثلي الحكومة تنفيذ واجباتهم الرسمية."
The committee found Jabarah could not be prosecuted for any crime in Canada, since his terrorist activities pre-dated Canada’s Anti-terrorism Act. ووجدت اللجنة jabarah لا يمكن ملاحقة اي جريمه في كندا ، منذ ان الانشطه الارهابيه قبل مؤرخة في كندا قانون مكافحة الارهاب. Therefore neither CSIS nor the police had any right to detain him. ولذلك لا هذه الدائرة وكانت الشرطة ولا أي حق في احتجازه. Based on these and other circumstances, the committee concluded Jabarah was “arbitrarily detained” by CSIS in violation of the Charter. وبناء على هذه وغيرها من الظروف ، خلصت اللجنة الى jabarah "المعتقلين اعتباطا" من قبل داءره الاستخبارات الامنية في انتهاك للميثاق.
In addition, his rights to silence, to legal counsel and to remain in Canada were breached, the report says. وبالاضافة الى ذلك ، حق حقه في التزام الصمت ، والى المستشار القانوني في البقاء في كندا وقد اخل به ، حسبما ورد في التقرير.

A spokesperson for Public Safety Minister Stockwell Day said the government fully accepts the review committee’s findings. وافاد ناطق باسم وزير السلامة العامة Stockwell اليوم ان الحكومة تقبل تماما استعراض النتائج التي توصلت اليها اللجنة.
