Justice Department faulty torture justification exposed وزارة العدل خاطءه مبرر تعرض للتعذيب

According to Tamanaha , the trick used by DoJ is to find an obscure court decision and use a distorted representation of what it says to make a claim completely incompatible with that source. ووفقا لtamanaha ، والحيله التي تستخدمها وزارة العدل هو العثور على قرار المحكمه غامضة واستخدام مشوه تمثيل ما يقول لتقديم مطالبة تتنافى تماما مع هذا المصدر. DoJ attempted to demonstrate in their letter that whether interrogation behavior violates the Geneva Conventions ban on “ outrage upon personal dignity” depends partly upon why the interrogator is engaging in the behavior. وزارة العدل محاولة لاثبات ذلك في كتاب ان الاستجواب ما اذا كان سلوك ينتهك اتفاقيات جنيف لفرض حظر على "الاعتداء على الكرامة الشخصيه" لماذا يتوقف جزئيا على المستجوب هو الانخراط في السلوك. Thus, actions intended to prevent terrorism are subject to a higher threshold before becoming violations than are those for lesser reasons. وهكذا ، يعتزم اتخاذ اجراءات لمنع الارهاب وتخضع لعتبة أعلى مما كانت قبل ان تصبح هي تلك الانتهاكات لأقل الاسباب.
Accordingly, it might not be an “outrage upon the personal dignity” of a prisoner—for example, subjected to extreme cold, extreme periods of standing, or water boarding—when we have an urgent need for the information, while those same actions might well be a violation if we don’t have an urgent need for the information. وبناء على ذلك ، قد لا تكون "الاعتداء على الكرامة الشخصيه" للسجين - على سبيل المثال ، تعرض لأقصى الباردة ، اقصى فترات الداءمه ، او الماء والطعام - عندما تكون لدينا حاجة ماسة الى المعلومات ، في حين ان نفس هذه الاجراءات قد بالاضافة الى ان يشكل انتهاكا اذا لم يكن لدينا حاجة ماسة لهذه المعلومات.
The problem is, as Tamanaha demonstrates, the decision does not even remotely make the argument attributed to it. المشكلة هي ، كما يدل على tamanaha ، فان القرار لا ولو من بعيد جعل الحجه المنسوبة اليها. Here is the key section: وهنا هو مفتاح الباب :
Benczkowski is right that a judgment about the “degrading” nature of the treatment must take into consideration “all the circumstances of the case.” This is the key point in his argument. Benczkowski هو ان الحق في الحكم على "مهينه" للمعاملة يجب أن يأخذ في الاعتبار "جميع ظروف القضية." هذه هي النقطه الرئيسية في حجته. He asserts that the “reasonable observer…would take into account the circumstances surrounding the conduct, including what justifications might exist .” That final clause–what justifications might exist–is what makes the (claimed) urgent need for the information a relevant factor in evaluating the conduct. واكد ان "معقولة… المراقب من شانه ان ياخذ في الاعتبار الظروف المحيطة السلوك ، بما في ذلك ما قد يوجد من مبررات." ان الشرط الاخير - ما هي المبررات التي قد توجد - هو ما يجعل (المطالب) الحاجة الماسة الى المعلومات عاملا ذا صلة في تقييم سلوك.
Benczkowski cites Section 53 of the Court’s opinion for this proposition. Benczkowski للانقراض المادة 53 من فتوى المحكمه لهذا الاقتراح. Here is the entire paragraph 53, so judge for yourself: هنا هو 53 الفقره بكاملها ، حتى القاضي لنفسك :
“It is also instructive to recount the general definition of the term ‘inhuman treatment’ propounded by the ECHR, which to date is the only human rights monitoring body that defined the term: “ill-treatment must attain a minimum level of severity if it is to fall within the scope of Article 3 (ECHR). "كما انها مفيدة لاعادة التعريف العام للمصطلح' معاملة لا انسانية 'طرحت من قبل المحكمه الاوروبية لحقوق الانسان ، التي هي حتى الان سوى هيئة رصد حقوق الانسان ان يعرف مصطلح :" سوء المعامله يجب ان يبلغ مستوى ادنى من شدة اذا هو تدخل في نطاق المادة 3 (الاتفاقية الاوروبية لحقوق الانسان). The assessment of this minimum is, in the nature of things, relative: it depends upon all the circumstances of the case, such as the duration of the treatment, its physical or mental effects and, in some cases, the sex, age, and state of the heath of the victim, etc. The test offered by this definition is the level of suffering endured by the victim.” تقييم هذا هو الحد الادنى ، في طبيعه الاشياء ، النسبيه : انه يتوقف على جميع ظروف القضية ، مثل مدة المعامله ، والآثار الجسديه او العقليه ، وفي بعض الحالات ، او الجنس ، او السن ، و الدولة من الصحة للضحيه ، وما التجارب التي يتيحها هذا التعريف هو مستوى المعاناة التي تحملها الضحيه ".
The court makes it absolutely clear that the phrase “all the circumstances” relates entirely to (and is bounded by) the “level of suffering endured by the victim.” المحكمه يجعل من الواضح تماما ان عبارة "كل الظروف" يتصل بالكامل (ويحدها من قبل) "مستوى من المعاناة التي تحملها الضحيه".
For Benczkowski to claim that this language in any way includes consideration of “what justifications might exist” for the ill-treatment is an outrageous distortion. لbenczkowski الادعاء بأن هذه اللغة بأي شكل من الاشكال ويشمل ذلك النظر في "ما هي المبررات التي قد توجد" لسوء المعامله هو تشويه فاضح.
Tamanaha concludes: ويخلص tamanaha :
It is disgraceful that Justice Department lawyers would supply such deceptive legal analysis to a Senator. ومن المخزي ان وزارة العدل والمحامين من شأنه ان توريد هذه المخادعه والتحليل القانوني لعضو في مجلس الشيوخ.
The bottom line: whether an act is “torture” or an “outrage on personal dignity” has nothing to do with (is not in the least diminished by) how urgently we feel we need the information. خلاصة القول : ما اذا كان الفعل هو "التعذيب" او "الاعتداء على الكرامة الشخصيه" لا علاقة له (ليس في اقل من جانب تضاؤل) على وجه السرعه ونحن نرى كيف اننا بحاجة الى هذه المعلومات.
We non-lawyers are left to wonder if the legal profession has any sanctions for such egregious malpractice in a matter of such great importance. نحن غير المحامين الى التساؤل اذا كان ترك مهنة المحاماة اي عقوبات لمثل هذه الممارسات السيءه الفظيعه في مسألة على هذا القدر من الاهميه.
