By بواسطة MARK SHERMAN علامة شيرمان | The Supreme Court ruled Thursday that foreign terrorism suspects held at Guantanamo Bay have rights under the Constitution to challenge their detention in US civilian courts. | قضت المحكمه العليا يوم الخميس ان المشتبه فيهم الاجانب الارهاب الذي عقد فى خليج غوانتانامو وقد الانسان في اطار الدستور للطعن في احتجازهم امام محاكم مدنيه في الولايات المتحدة.
The justices handed the Bush administration its third setback at the high court since 2004 over its treatment of prisoners who are being held indefinitely and without charges at the US naval base in Cuba. القضاة سلم ادارة بوش الثالثة لنكسه في المحكمه العليا منذ عام 2004 على وضعه معاملة السجناء تجري من غير مسمى ودون توجيه تهم اليهم في القاعده البحرية الاميركية في كوبا. The vote was 5-4, with the court’s liberal justices in the majority. التصويت 5-4 ، مع الليبراليه قضاة المحكمه في الاغلبيه.
Justice Anthony Kennedy, writing for the court, said, “The laws and Constitution are designed to survive, and remain in force, in extraordinary times.” العدالة انطوني كينيدي ، لكتابة المحكمه ، وقال : "ان الدستور والقوانين مصممة للبقاء على قيد الحياة ، وتظل سارية المفعول ، في أوقات غير عادية".
It was not immediately clear whether this ruling, unlike the first two, would lead to prompt hearings for the detainees, some who have been held more than 6 years. انه ليس من الواضح على الفور ما اذا كان هذا الحكم ، على عكس الأولين ، من شأنه ان يؤدي الى جلسات الاستماع الفوري للمحتجزين ، وبعض من تم عقد اكثر من 6 سنوات. Roughly 270 men remain at the island prison, classified as enemy combatants and held on suspicion of terrorism or links to al-Qaida and the Taliban. حوالي 270 من الرجال ما زالوا في سجن جزيرة مصنفة المقاتلين الاعداء ، وعقد للاشتباه في الارهاب او وصلات لتنظيم القاعده وحركة طالبان.
The administration opened the detention facility at Guantanamo Bay shortly after the Sept. 11, 2001, terrorist attacks to hold enemy combatants, people suspected of ties to al-Qaida or the Taliban. فتحت ادارة مرفق الاحتجاز في خليج غوانتانامو بعد فترة وجيزة من ايلول / سبتمبر 11 ، 2001 ، والهجمات الارهابيه التي وقعت على عقد المقاتلين الاعداء ، للاشخاص الذين يشتبه في علاقتها بتنظيم القاعده او حركة طالبان.
The Guantanamo prison has been harshly criticized at home and abroad for the detentions themselves and the aggressive interrogations that were conducted there. سجن غوانتانامو وقد انتقد في الداخل والخارج لأنفسهم الاعتقالات والاستجوابات العدوانية التي كانت تجرى هناك.
