Yahoo! ياهو! sued for divulging data دعوى لافشاء البيانات
A Chinese couple backed by a rights group has sued Yahoo! أ الصينية زوجين تدعمها المجموعة الانسان قد رفع دعوى ضد ياهو! for divulging information that helped the Chinese government prosecute the man for his internet writings. من اجل الكشف عن المعلومات التي ساعدت الحكومة الصينية لمقاضاة رجل له كتابات الانترنت.
Wang Xiaoning was jailed for 10 years last year for “incitement to subvert state power” after he sent out emails advocating democratic reform and a multi-party system. وانغ xiaoning سجن لمدة 10 سنوات في العام الماضي من اجل "التحريض على الاطاحة بسلطه الدولة" بعد ان ارسلت رسائل الكترونيه الدعوة الى الاصلاح الديمقراطي ، واقامة نظام متعدد الاحزاب.
In the complaint filed in the US district court for Northern California, Wang and his wife Yu Ling alleged that Yahoo! في شكوى فى الولايات المتحدة محكمة المقاطعه الشمالية لكاليفورنيا ، وزوجته وانغ يو لينغ وادعى ان ياهو! and its Chinese affiliates turned over details to prosecutors that helped identify him to the authorities. وفروع الشركات الصينية على انظار النيابة العامة الى التفاصيل التي ساعدت على تحديد له الى السلطات.
“While in custody, plaintiffs were subjected to torture and cruel, inhuman or degrading treatment, including arbitrary, prolonged and indefinite detention, for expressing their free speech rights and for using the internet to communicate about democracy and human rights matters,” the complaint said. "اثناء احتجازه ، والمدعين قد تعرضوا للتعذيب والمعامله القاسيه او اللاانسانيه او المهينه ، بما في التعسفي ، والاحتجاز لاجل غير مسمى المطول ، يعربان فيه عن حرية التعبير والحقوق لاستخدام الانترنت للإتصال عن الديموقراطية وحقوق الإنسان الأمور ،" قال الشكوى .
Financial benefit فوائد مالية
The suit, backed by the World Organisation for Human Rights USA, is seeking unspecified damages and wants Yahoo! الدعوى ، تدعمها المنظمه العالمية لحقوق الانسان الولايات المتحدة الأمريكية ، تسعى أضرار غير محددة وتريد ياهو! to actively secure the release of any detainees. بنشاط لتأمين الافراج عن اي من المعتقلين.
The Washington DC-based group said Yahoo! واشنطن العاصمة مقرا قالت المجموعة ياهو! benefited financially by working with Chinese authorities. استفاد ماليا من خلال العمل مع السلطات الصينية.
“Defendants had every reason to know and understand that the electronic communication user information they provided to authorities could well be used to assist in the infliction of such abuses as arbitrary arrest, torture, cruel, inhuman or other degrading threat and prolonged detention and/or forced labour,” it said. "كل المتهمين كان السبب في معرفة وفهم ان الاتصالات الالكترونيه مستخدم المعلومات التي قدماها الى السلطات من الممكن جدا ان تستخدم للمساعدة في إنزال مثل هذه الاساءات كما الاعتقال التعسفي ، والتعذيب أو المعامله القاسيه او اللاانسانيه او المهينه الاخرى والتهديد والاحتجاز المطول و / او السخره ، "قالت.
China is the world’s second largest internet market. والصين هي الدولة الثانية في العالم اكبر سوق الانترنت.
Morton Sklar, the group’s executive director, said businesses “should not be participating actively in promoting and encouraging major human rights abuses”. مورتن سكلار ، المدير التنفيذي للمجموعة ، قال الاعمال "لا ينبغى ان تشارك بفعاليه فى تعزيز وتشجيع الرئيسية انتهاكات حقوق الانسان".
Company’s response شركة رد
Yahoo! ياهو! has acknowledged turning over data on its users but has said it is legally compelled to do so. وقد اعترف بتسليم بيانات عن مستخدميه ولكن قد قالت انه لا يمكن قانونا يجبر على القيام بذلك.
It said it was distressed that Chinese citizens had been sent to prison for expressing their views on the internet, but “companies doing business in China must comply with Chinese law or its local employees could be faced with civil and criminal penalties”. وقال انه كان يؤلمها ان المواطنين الصينيين قد ارسل الى السجن لتعبيرهم عن آرائهم على شبكة الانترنت ، ولكن "الشركات المتعامله في الصين يجب أن تمتثل للقانون الصيني أو موظفين محليين يمكن ان تواجه عقوبات مدنيه وجناءيه".
Yahoo! ياهو! said the US government should seek to lobby for political prisoners in China. وقالت حكومة الولايات المتحدة ان تسعى الى الضغط من اجل السجناء السياسيين في الصين.
The suit names Yahoo!, its Hong Kong subsidiary and Alibaba.com, China’s largest e-commerce firm partly owned by Yahoo!, as defendants. الدعوى اسماء ياهو! ، وهونغ كونغ والفرعية alibaba.com ، الصين وهى اكبر شركة التجارة الالكترونيه التي لا تزال مملوكة جزئيا ياهو! ، كما المتهمين.
