The government’s own human rights watchdog threatened last night to launch a legal challenge to Labour’s plan to introduce a law that would let police detain terror suspects without charge for 42 days. الحكومة نفسها حارسا لحقوق الانسان للتهديد الليلة الماضية لاطلاق طعن قانوني في خطة العمل لادخال قانون من شأنه ان اسمحوا الشرطة احتجاز المشتبه فيهم دون توجيه تهمة الأرهاب 42 يوما.
The Equality and Human Rights Commission says the key part of the counter-terrorism bill goes against human rights law and may breach the Race Relations Act. والمساواة في لجنة حقوق الانسان يقول ان جزءا اساسيا من مشروع قانون مكافحة الارهاب يتعارض مع قانون حقوق الانسان وايار / مايو خرق قانون العلاقات العرقيه.
As the home secretary, Jacqui Smith, renewed her appeal to Labour backbenchers to support the measure - amid growing international criticism - the EHRC prepared to brief MPs before the bill’s second reading in the Commons tomorrow. كما جدد وزير الدولة ، jacqui سميث ، وتجدد نداءها الى العمل على دعم اعضاء البرلمان التدبير -- وسط تزايد الانتقادات الدولية ل-- ehrc على استعداد لاطلاع النواب مشروع القانون قبل القراءة الثانية في المشاعات غدا. The commission makes clear it will mount a legal challenge if the 42-day limit wins parliamentary backing. وتقدم اللجنة واضحة وسوف جبل طعن قانوني اذا كانت 42 يوما وينز البرلمانيه المسانده.
“If adopted, we may seek to use our legal powers to challenge the lawfulness of the provisions and to establish clear legal principles on the use of pre-trial detention,” it says in a briefing note to MPs. "اذا اعتمد ، ونحن قد تسعى الى استخدام قدراتنا على صلاحيات قانونيه والطعن في مشروعية الاحكام واقامة صلات واضحة للمبادئ القانونية بشأن استخدام الاحتجاز السابق للمحاكمة ،" جاء في مذكرة اعلاميه على النواب.
The threat of a legal challenge from the EHRC, which has powers to take judicial review on legislation it considers may be in breach of the European Convention on Human Rights, is another setback to a government determined to increase the time terrorism suspects can be held without charge from 28 to 42 days. خطر طعن قانوني من ehrc ، التي تتخذ السلطات الى المراجعه القضاءيه على التشريع وترى انه قد يكون في انتهاك للاتفاقيه الاوروبية لحقوق الانسان ، هي نكسه اخرى لحكومة مصممة على زيادة الوقت الذي يمكن ان الارهاب المشتبه فيهم بدون عقد المسؤول عن الفترة من 28 الى 42 يوما.
Archbishop Desmond Tutu, Noam Chomsky and the American Civil Liberties Union have led an international outcry against the plan, which is opposed at home by the Tories and Liberal Democrats. رئيس الاساقفه ديسموند توتو ، ناعوم تشومسكي والاتحاد الامريكى للحريات المدنيه قد ادى احتجاج دولي ضد الخطة ، التي تعارض في الداخل من قبل المحافظون والليبرالي الديموقراطي.
The government receives a further blow today when Lord Dear, the former chief inspector of constabulary, says a change in law would be a “propaganda coup” for al-Qaida. الحكومة تتلقى ضربة اخرى اليوم عندما ايها الرب ، رئيس المفتشين السابق للشرطة المنطقة ، ويقول تغيير في القانون من شأنه ان يكون "دعايه الانقلاب" لتنظيم القاعده. In a Guardian article, Dear writes that every chief constable he has spoken to regards the change as unnecessary. ولي في هذه المادة ، ان يكتب كل عزيزي رئيس الشرطة وقال انه تحدث الى تغيير بالنسبة لانها غير ضروريه.
Dear writes: “Make no mistake, extending pre-charge detention would most certainly be a propaganda coup for al-Qaida and its ilk. عزيزي كتب ما يلي : "علينا الا نخطئ ، المسؤول السابق للتمديد الاحتجاز من شأنه بكل تأكيد ان يكون الانقلاب والدعايه لتنظيم القاعده والجنس. When I was an undergraduate reading law at university in the 60s, every self-respecting student had a poster of Che Guevara on their wall and knew something of the writings of [Herbert] Marcuse. عندما كنت الجامعي في القانون في جامعة القراءة في الستينيات ، كل تحترم نفسها قد طالب ملصق لتشي غيفارا وعلى الجدار ويعرف شيئا من كتابات [هربرت] marcuse. Both of those terrorist luminaries said repeatedly that the best course for a terrorist was to provoke a government to overreact to a threat by eroding civil liberties, increasing executive powers and diminishing due process by the denial of justice.” كل من هذه النجوم الارهابيه مرارا وتكرارا وقال ان افضل سبيل لارهابي كان لاثارة مفرطه للحكومة لتهديد الحريات المدنيه عن طريق اضعاف ، وزيادة السلطات التنفيذية وتقليص الاجراءات القانونية من جانب الحرمان من العدالة ".
The deep unease about the new measures was underlined by the EHRC. القلق العميق ازاء تدابير جديدة تم التأكيد من قبل ehrc. Set up last October under the chairman Trevor Phillips, it has specific power to take legal action over potential breaches of the Race Relations Act. انشاء تشرين الاول / اكتوبر الماضي في اطار الرئيس تريفور فيليبس ، وقد محددة السلطة الى اتخاذ الاجراءات القانونية المحتملة على مدى انتهاكات للقانون العلاقات العرقيه. The commission says it accepts that circumstances might arise which make an increase in the 28 day limit on pre-charge detention helpful to the police in obtaining evidence but this should not be at the expense of fundamental human rights. وتقول اللجنة انها تقبل ان قد تنشأ ظروف التي تجعل من زيادة في الحد الاقصى 28 يوما قبل المسؤول مفيدة لاحتجاز الشرطة في الحصول على الادله ولكن هذا لا ينبغي ان يكون على حساب حقوق الانسان الاساسية.
It has told the Home Office that a “positive and compelling case” must be made before the maximum limit on pre-charge detention is raised, given its potential impact on liberty, the likelihood of its disproportionate impact on the Muslim community, and the risk of operational error. وقد ابلغت وزارة الداخلية ان "ايجابي وحجة دامغه" يجب ان يكون قبل ان الحد الأقصى السابق هو المسؤول عن الاعتقال التي اثيرت ، نظرا لأثره المحتمل على الحرية ، فإن احتمال اثارها غير المتناسبه على المجتمع المسلم ، وخطر خطأ التنفيذية.
“We consider that despite being restricted to particular and specific contingencies, the provisions set out by the Home Office are unlikely to meet threshold tests of public interest, justification or fairness,” the commission adds. "ونحن نعتبر انه على الرغم من ان يقتصر على الحالات الطارئة وخاصة ومحددة ، فإن الاحكام التي حددتها وزارة الداخلية من غير المرجح ان تلبي الحد الادنى من التجارب المصلحه العامة ، مبرر أو الانصاف ،" ان لجنة العالميين.
It says the proposed safeguard of parliamentary scrutiny of each order will be meaningless without giving MPs detailed information on each suspect. وهي تقول المقترحة للحمايه البرلمانيه من اجل فحص كل ستكون بلا معنى من دون ان يعطي معلومات مفصلة عن بعض النواب في كل مشتبه فيه. Yet that would raise constitutional issues. ومع ذلك فان هذا من شأنه ان يثير القضايا الدستورية.
The commission says the proposed change also raises “very difficult issues” under race equality laws as it is being established to deal with a particular religious and racial minority. وتقول لجنة التغيير المقترح يثير ايضا "صعبة جدا" وذلك فى اطار سباق قوانين المساواة كما يجري حاليا انشاء لولا سيما في التعامل مع الاقليات الدينية والعرقيه. The EHRC believes it carries a high risk of damaging community relations, as Muslims are more likely to be regarded with suspicion. وقد ehrc يعتقد أنه يحمل خطرا كبيرا من الضرر والعلاقات المجتمعيه ، كما ان المسلمين هم أكثر احتمالا في ان ينظر بعين الريبه.
The government is expected to win a Commons majority tomorrow for the bill’s second reading. حكومة ومن المتوقع ان يفوز باغلبيه المشتركة غدا لمشروع القانون في القراءة الثانية. But Smith faces the prospect of defeat when detailed votes are held on the 42 days issue at the report stage in May after the local elections. ولكن سميث يواجه احتمال الهزيمة عندما مفصلة الاصوات التي اجريت بشأن هذه المساله خلال 42 يوما في مرحلة التقرير في ايار / مايو بعد انتخابات محلية.
She said yesterday she believed the 42-day extension would be passed. وقالت امس انها تعتقد ان تمديد 42 يوما من شأنه ان يتم اقراره بعد. But she told the BBC: “I hope parliamentarians will take their responsibility seriously to give those that we task with keeping us safe from terrorism the tools that we need to do it. ولكنها قالت اذاعة / بى بى سى : "آمل ان يتخذ البرلمانيون مسؤوليتها بجدية لاعطاء هذه المهمة ونحن مع ان حفظ لنا في مأمن من الارهاب الادوات التي نحن بحاجة الى القيام بذلك. I need to make the argument to parliament. انا بحاجة الى تقديم الحجه على البرلمان. As home secretary my responsibility is to do what I believe … it is necessary to protect this country from the serious, sustained, and in some ways growing threat from international terrorism.” كما جدد وزير مسؤوليتي هي ان تفعل ما… واعتقد انه من الضروري لحمايه هذا البلد من جدية ومستدامه ، وبعض الطرق في خطر متزايد من الارهاب الدولى. "
Smith stressed that the government was only taking a precautionary “reserve power” to increase the maximum period for detention without charge to be used in the exceptional circumstances of the country facing multiple terror plots. وشدد سميث على ان الحكومة تأخذ فقط وقائي "احتياطي الطاقة" لزيادة الحد الاقصى لفترة الاحتجاز دون تهمة لاستخدامها في ظل الظروف الاستثناءيه التي تواجه البلد من مؤامرات متعددة الارهاب.
