Η χρήση του μυστικού νόμου κατασκόπων είναι διαδεδομένη
Από Michael Howie | Οι ΝΕΟΙ νόμοι κατασκόπων χρησιμοποιούνται από τα σκωτσέζικα συμβούλια στους ανθρώπους διαδρομής που υποψιάζονται της απάτης κατοικία-οφελών, που πωλούν τα τσιγάρα στα παιδιά και τις παραβάσεις περιβαλλοντικός-υγείας. Οι πραγματοποιούντες εκστρατεία απαιτούν τώρα μια «αναθεώρηση ρίζα-και-κλάδων» στον κανονισμό του διερευνητικού νόμου δυνάμεων (Ripa), αφότου αποκαλύφθηκε η κλίμακα της χρήσης της από τις τοπικές αρχές σε ολόκληρο το UK.
Το Ripa εισήχθη το 2000, δίνοντας πρώτιστα την αστυνομία, τις υπηρεσίες ασφάλειας και Α.Μ.
Ευρείες δυνάμεις εισοδήματος και τελωνείου να κατασκοπεύσει στους ανθρώπους και τις επικοινωνίες τους.
Οι κύριοι στόχοι του νόμου ήταν να βοηθήσουν στην πάλη ενάντια στο έγκλημα και την τρομοκρατία. Αλλά το 2002, οι δυνάμεις επεκτάθηκαν αμφιλεγόμενα στα συμβούλια, που προσφέρουν την ευκαιρία να πραγματοποιηθεί η επιτήρηση.
Μια έρευνα τώρα έχει αποκαλύψει ότι τα συμβούλια έχουν χρησιμοποιήσει ακόμη και το νόμο στα σκυλί-foulers διαδρομής και litterbugs, με μερικές τοπικές αρχές χρησιμοποιώντας τις δυνάμεις περισσότερες από 100 φορές στους τελευταίους 12 μήνες.
Μεταξύ των σκωτσέζικων τοπικών αρχών που επιβεβαίωσαν που χρησιμοποιούν Ripa στο προηγούμενο έτος ήταν το Συμβούλιο πόλεων του Αμπερντήν, το οποίο αναγνώρισε τη συγκεκαλυμμένη επιτήρηση σε οκτώ περιπτώσεις για να ερευνήσει την απάτη οφελών, την περιβαλλοντικός-υγεία και τα ζητήματα κάνω εμπόριο-προτύπων.
Το συμβούλιο δεν διευκρίνισε ποιες παραβάσεις περιβαλλοντικός-υγείας περιλήφθηκαν, αλλά αυτό μπορεί να περιλάβει, τη ρύπανση και τις θορυβώδης-κοντινές διαφωνίες.
Το Συμβούλιο πόλεων της Γλασκώβης πραγματοποίησε τη φυσική επιτήρηση 24 φορές στις έρευνες για τα διαπραχθέντα εγκλήματα, πέρα από τις παραβάσεις κάνω εμπόριο-προτύπων και τον παράνομο χρήμα-δανεισμό.
Δέκα τρία αιτήματα να προσεγγιστούν οι πληροφορίες τηλεφωνικής τιμολόγησης - μια άλλη δύναμη που χορηγείται στο πλαίσιο του νόμου - χρησιμοποιήθηκαν στις ίδιες έρευνες.
Στο Περθ, ο νόμος χρησιμοποιήθηκε για να ερευνήσει εάν τα τσιγάρα και τα πυροτεχνήματα πωλούνταν σε κάτω από-18s.
Νωρίτερα αυτό το μήνα, προέκυψε ότι μια οικογένεια σε Poole στο Dorset εήταν ακολουθημένη συγκεκαλυμμένα για σχεδόν τρεις εβδομάδες που ελέγχουν εάν έζησαν σε μια περιοχή σχολικής συλλογής.
Η έρευνα επίσης έχει αποκαλύψει ότι ο νόμος χρησιμοποιήθηκε σε τουλάχιστον επτά περιπτώσεις που ανακαλύπτουν για τους ανθρώπους που άφησαν τα σκυλιά τους να λερώσουν μια παραβίαση του προγραμματισμού του νόμου μια περίπτωση ζωικός-ευημερίας και μια περίπτωση ρύπανσης.
Τα συμπεράσματα έχουν τροφοδοτήσει τη συζήτηση σχετικά με τον πολιτισμό επιτήρησης στη Μεγάλη Βρετανία και εάν τα συμβούλια χρησιμοποιούν Ripa - που έχει μεταγλωττιστεί «τα snoopers» χάρτης» - αναλογικά.
Ο διεθνής διευθυντής Simon Davies μυστικότητας απαίτησε μια «αναθεώρηση και-κλάδων ρίζας» Ripa και εξέτασε το τεράστιο κόστος στο φορολογούμενο της επιτήρησης των συμβουλίων.
“There have to be hard limits on the scope of surveillance by local authorities who do not work within the spirit of the Act or indeed the letter,” he said.
“Ripa put physical surveillance on a legal basis but that doesn’t make it right or morally right – it just covers the backs of local authorities but at huge expense.
“Local authorities can be very petty and vindictive and they can become obsessed with issues like dog fouling and there can be a lack of judgment.
“There need to be measures in place to make sure they do not go overboard in regard to surveillance. In the case of dog-fouling, it’s almost morally justifiable to bring these people to book but you have to ask the question is the response an overkill?
“There are better ways to achieve the objectives without using counter-terrorism laws.
“Peer pressure to make such things unacceptable works but takes longer.”
Sir Simon Milton, chairman of the Local Government Association, called for a national debate to balance people’s worries about crime and antisocial behaviour with their privacy.
“Councils are committed to putting local people first and will use every weapon in their arsenal to catch the rogue traders, doorstep criminals and scam artists who cheat the taxpayer and prey on the vulnerable and the elderly,” he said.
