O Senate passa a conta espiando Unconstitutional e concede Immunity arrebatador às companhias do telefone

Hoje, em um assalto blatant em cima das liberdades civis e da direita à privacidade, o Senate passou uma conta espiando doméstica unconstitutional que violates a quarta emenda e eliminasse todo o papel significativo para o oversight judicial do surveillance do governo. O ato das emendas de FISA de 2008 foi aprovado por um voto de 69 a 28 e espera-se ser assinado logo na lei pelo presidente Bush. Esta conta legaliza essencialmente o programa warrantless ilegal do wiretapping do presidente revelado em dezembro 2005 pelos tempos de New York.

“Uma vez outra vez, o Congress piscou e succumbed ao medo-mongering do presidente. Com voto de hoje, o governo foi dado uma luz verde para expandir seu poder espiar em americanos e para funcionar roughshod sobre o Constitution,” disse Anthony D. Romero, diretor executivo da união americana das liberdades civis. “Esta legislação dará o acesso unfettered e unchecked do governo comunicações internacionais aos americanos inocentes' sem uma autorização. Isto é não somente unconstitutional, mas absolutamente un-Americano.”

As emendas de FISA agem eviscerates quase o oversight do surveillance do governo permitindo que a corte do Surveillance da inteligência extrangeira (FISC) rev somente procedimentos gerais para espiar melhor que autorizações individuais. The test for the companies’ right to immunity is not whether the government certifications they acted on were actually legal – only whether they were issued. This means Americans may never learn the truth about what the companies and the government did with our private communications. 

“With one vote, Congress has strengthened the executive branch, weakened the judiciary and rendered itself irrelevant,” said Caroline Fredrickson, Director of the ACLU Washington Legislative Office. “This bill – soon to be law – is a constitutional nightmare. Americans should know that if this legislation is enacted and upheld, what they say on international phone calls or emails is no longer private. The government can listen in without having a specific reason to do so. Our rights as Americans have been curtailed and our privacy can no longer be assumed.”

In advance of the president’s signature, the ACLU announced its plan to challenge the new law in court.

“This fight is not over. We intend to challenge this bill as soon as President Bush signs it into law,” said Jameel Jaffer, Director of the ACLU National Security Project. “The bill allows the warrantless and dragnet surveillance of Americans’ international telephone and email communications. It plainly violates the Fourth Amendment.”
