Policía: Base de datos de la DNA lista desde el año próximo

Bermudas podían tener su propia base de datos de la DNA dentro de un par de años, para ayudar al policía en agrietar más crímenes. Las reformas del radical con el policía y el acto criminal de la evidencia (PASO) significan que más muestras, las huellas digitales y las fotografías de la DNA serán recogidas cuando toman la gente en custodia a partir de agosto este año.
Eventual, las muestras de la DNA formarán la parte de una base de datos nacional. Según la marca Crampton, un principal inspector BRITÁNICO anterior que pone las reformas en ejecución: “Nos están dando las herramientas para traer al policía de Bermudas servicio en el mundo del siglo XXI de la tecnología en técnicas forenses de la detección del crimen.”
Actualmente, las huellas digitales, las fotografías y las esponjas de la boca de la DNA se pueden tomar solamente con el consentimiento de la persona en custodia del policía - y esto generalmente se hace solamente cuando el policía va a cargarlos, él explicó.
A partir de este verano, pueden ser recogidos legalmente de todas las personas tomadas en la custodia para las “ofensas registrables” - los para las cuales podrían conseguir un término del encarcelamiento si estuvieron condenados - si consienten o no. Esto no incluye ésos arrestados en la autorización, que explica a alrededor 40 por ciento de detainees.
Darán derecho el policía también a tomar estas muestras de las personas después de que lo condenen por una ofensa registrable, si no tomadas ya.
Sr. Crampton dicho: “Bermudas no tienen una base de datos de la DNA en lugar todavía, pero estamos trabajando con el departamento de la salud para mirar que traen en una base de datos dentro del futuro próximo. El policía estaría mirando por lo menos para tomar las muestras y para almacenarlas, hasta que finalice la llegada de una base de datos el año próximo o el año después.”
La evidencia de la DNA se utiliza ya en las cortes de Bermudas para los crímenes serios - pero los expertos tienen que volar adentro de en ultramar a grande costa. Su evidencia está típicamente a lo largo de las líneas que las bases de datos para la población negra/blanca para Canadá/la demostración de los E.E.U.U. que solamente el número de X de personas en el número de X de mil millones tendría tal perfil de la DNA.
Este tipo de evidencia ha sido desafiado por los abogados defensores, que tienen estadística de ultramar dicha son inaplicables porque lazos más cercanos de la familia en la DNA mala de Bermudas podrían ser emparejados más de cerca.
Sr. Crampton reconoció que Bermudas tienen su propia infraestructura genética única. While it will be an expensive and complicated process to set up a DNA database, which will need hundreds of local samples before useful statistics on profiling can be gleaned, he has no doubt that it will be rewarding.
Having the Island’s own database would mean such evidence would be less open to challenge. It would also make it easier for DNA profiling to be used in everyday crimes rather than reserved for matters such as rape and murder, he said.
“DNA in my view is the best evidence to link someone to a crime. It puts them at a certain place, in contact with some property or a person that’s almost unquestionable. We’re trying to move Bermuda into that forensic capability to help solve crime. Our detection rate will improve, that’s what we’re aiming for.”
Reacting to the news, defence lawyer and Shadow Attorney General Mark Pettingill said: “It’s a potentially useful tool. For defendants that are innocent too — it can set you free.”
However, he cautioned: “DNA is circumstantial evidence that may tie a person in with a crime, but you’ve still got to have other evidence. There’s no doubt that DNA has changed the face of things but it’s also been a huge detriment to prosecutions. Jurors have all watched CSI and these days they want to know ‘where’s the hair fibres?’ If you don’t have it, they almost think you don’t have a case.
“It has to be looked at in a very narrow light. It’s not a panacea to solving crimes or getting conviction, but it’s a useful scientific tool to support a case in a circumstantial way. If we create a DNA database here we’ll still have to go through the same processes in the court for admissibility (of evidence). It’s not about the DNA, it’s about the gathering of the evidence and we’ve had times here where the evidence has been gathered appallingly.”
