By بواسطة Alan Travis ألن ترافيس and و Patrick Wintour باتريك wintour | Europe’s human rights commissioner is to write to Gordon Brown this week warning him that the proposal to detain terror suspects for up to 42 days without charge is an “excessive” measure that will put Britain “way out of line” with the rest of Europe and will prove counter-productive. | اوروبا في مجال حقوق الانسان والمفوض ان يكتب الى غوردون براون هذا الاسبوع انذار له ان هذا الاقتراح الارهاب لاحتجاز المشتبه فيهم لمدة تصل الى 42 يوما دون توجيه تهم هي "مفرطه" تدبير من شأنه ان يضع بريطانيا "للمخرج اون لاين" مع بقية من اوروبا وستكون عكسيه.
The intervention from Europe’s human rights watchdog comes as the home secretary, Jacqui Smith, prepares to outline to Labour MPs tonight “concessions” designed to curb the scale of a backbench revolt a week on Wednesday, when the key vote is to be held. تدخل من اوروبا في مجال حقوق الانسان لرقابة وياتي وزير الداخلية ، jacqui سميث ، وتستعد للعمل على الخطوط العريضه النواب الليلة "تنازلات" تهدف للحد من حجم أ backbench التمرد في الاسبوع يوم الاربعاء ، عندما الرئيسية التصويت ومن المقرر ان تعقد .

They have been privately suggesting that the detention powers would be triggered only in defined “grave exceptional circumstances”, such as multiple plots by terrorists. وقد القطاع الخاص مما يشير الى ان سلطات الاعتقال من شانه ان تحركها فقط في تعريف "الظروف الاستثناءيه الخطيره" ، مثل قطع متعددة من قبل الارهابيين.
Parliament would get to vote on the decision to use the detention powers within seven to 10 days of the decision to do so, and it would also require renewal by parliament every 30 days. سوف تحصل على البرلمان للتصويت على قرار استخدام سلطات الاحتجاز في غضون سبعة الى 10 يوما من اتخاذ القرار على ان تفعل ذلك ، وانه يحتاج ايضا الى تجديد البرلمان كل 30 يوما.
But the joint select committee is expected to agree tonight that it would be better for the government simply to derogate temporarily from relevant articles of the European convention on human rights if the country was under that level of attack. ولكن اختيار لجنة مشتركة من المتوقع ان يوافق الليلة انه قد يكون من الافضل للحكومة مؤقتة لمجرد الخروج من المواد ذات الصلة من الاتفاقية الاوروبية لحقوق الانسان واذا كان البلد في ظل هذا المستوى من الهجوم.

Ministers have repeatedly cited the Italian “example” in an attempt to rubbish research by Liberty, the human rights organisation, showing that Britain’s existing 28-day limit is already longer than any comparable democracy. الوزراء مرارا وتكرارا واستشهد الايطاليه "مثلا" في محاولة لالقمامه البحث عن طريق الحرية ، وحقوق الانسان ومنظمة ، والتي تبين ان بريطانيا القائمة 28 يوما هو بالفعل اطول من اي مقارنة الديمقراطيه.
In his letter to Brown, Thomas Hammarberg, the Council of Europe’s human rights commissioner will say: “I am concerned by the British government’s suggestion to allow terrorism suspects to be detained for 42 days without charge. في رسالته الى براون ، توماس هامربيرغ ، التابع لمجلس اوروبا مفوض حقوق الانسان وسوف يقول : "انني قلق من جانب الحكومة البريطانية اقتراح لتسمح للارهاب ان يكون احتجاز المشتبه فيهم الى 42 يوما دون توجيه اتهام اليه.
“This would be way out of line with equivalent detention limits elsewhere in Europe. "وهذا من شأنه ان يكون مخرجا من خط الحدود مع يعادل الاحتجاز في اماكن اخرى في اوروبا. We need to be more restrictive with such measures. اننا بحاجة الى ان نكون اكثر صرامه مع مثل هذه التدابير. Keeping people detained for such long periods before prosecution is excessive and will prove counter-productive,” he says. حفظ الاشخاص المحتجزين لفترات طويلة قبل اجراء مثل هذه المحاكمه هو اكثر من اللازم وسوف تثبت نتائج عكسيه "، يقول. “I would urge members of the parliament to carefully review the government’s proposal.” "اود ان احث اعضاء البرلمان الى النظر بعناية في اقتراح الحكومة".
He is mandated to foster human rights standards across the 47 members of the Council of Europe and could have a role in any case at the European court of human rights testing the legality of 42-day detention. وقال انه كلف لتعزيز معايير حقوق الانسان عبر 47 عضوا من مجلس اوروبا ويمكن ان يكون لها اي دور في اي قضية في المحكمه الاوروبية لحقوق الانسان اختبار مشروعية الاحتجاز 42 يوما.
Shami Chakrabarti, the director of Liberty, said: “When the Council of Europe human rights commissioner has cause to intervene in Britain, we should all be truly ashamed. They’ve lost both the argument and the humility to admit it.” انهم لقد فقدت كل من حجة والتواضع لنعترف به ".
