This leaked draft is a treasure of information. هذا هو مشروع تسربت كنز من المعلومات. It’s the first time any document related to this topic is made public. انها المرة الاولى اي وثيقة من وثائق حول هذا الموضوع أتاحته لعامة الجمهور. There are many outrageous articles in the agreement that violates Iraq’s sovereignty and independence, and gives the US occupation authorities unprecedented rights and privileges, but what has draw my attention the most (so far) are three major points: وهناك العديد من المواد الفاحشه في الاتفاق الذي ينتهك سيادة العراق واستقلاله ، ويعطي سلطات الاحتلال الامريكية التى لم يسبق لها مثيل الحقوق والامتيازات ، ولكن ما استرعى انتباهي أكثر (حتى الآن) هي ثلاث نقاط رئيسية :
1- the agreement does not discuss anything about a complete US withdrawal from Iraq. 1 -- الاتفاق لا يناقش اي شيء عن انسحاب كامل من دولارات الولايات المتحدة من العراق. Instead, it talks about withdrawing “combat troops” without defining what is the difference between combat troops and other troops. وبدلا من ذلك ، يتحدث عن انسحاب "القوات القتاليه" دون تحديد ما هو الفرق بين القوات القتاليه وقوات اخرى. 2- the agreement goes into effect when the two executive branches exchange “memos”, instead of waiting for Iraqi parliament’s ratification. 2 -- الاتفاق حيز النفاذ عندما يذهب البلدين التنفيذية في تبادل "المذكرات" ، بدلا من انتظار تصديق البرلمان العراقي. Foreword المقدمة
Both sides affirm that this cooperation is based on mutual respect of both sides’ sovereignty in accordance with the United Nations’ goals and principles. كلا الجانبين التأكيد على ان يقوم هذا التعاون على اساس الاحترام المتبادل من كلا الجانبين فى السياده وفقا للامم المتحدة الأهداف والمبادئ.
Both sides want to achieve mutual understanding to support their collaboration, without jeopardizing Iraq’s sovereignty over its land, water, and sky, and based on the mutual guarantees given as equal and independent sovereign partners. نريد ان كلا الجانبين لتحقيق التفاهم المشترك لدعم التعاون بينهما ، دون ان تعرض للخطر سيادة العراق على أراضيه ، والمياه ، والسماء ، وعلى أساس الضمانات المتبادله ونظرا لقدم المساواة في السياده والاستقلال.

Article One المادة الاولى
Scope and goal ونطاقها والهدف
This agreement specifies the rules and basic needs that regulate the temporary presence and activities of the US troops and its withdrawal from Iraq. هذا الاتفاق حدد قواعد والاحتياجات الأساسية التي تنظم انشطه وجود مؤقت للقوات الامريكية وانسحابها من العراق.
Article Two المادة الثانية
Definitions التعاريف
1- “Installations and areas agreed upon” are the installations and areas agreed upon owned by the Iraqi government and used by the US forces from the date this agreement goes into effect. 1 -- "والمنشآت والمناطق المتفق عليها" هي المنشآت والمناطق المتفق عليها والمملوكه من الحكومة العراقية والتي تستخدمها القوات الامريكية من تاريخ هذا الاتفاق حيز النفاذ وغنى. Such installations and areas agreed upon will be decided in a list provided by the US forces and reviewed by both sides. مثل هذه المنشآت والمناطق المتفق عليها وتقرر ايضا ان يتم فى القائمة التى قدمتها القوات الامريكية واعادة النظر من قبل الطرفين. Such “installations and areas agreed upon” include those provided to the US forces during the time of this agreement after the approval of both sides. هذه "المنشآت والمناطق المتفق عليها" تشمل تلك التي قدمت الى القوات الامريكية خلال فترة هذا الاتفاق بعد موافقة كلا الطرفين.
Iraqi suggestion: The Iraqi delegation has asked the US delegation to submit a list of structures and areas requested to be discussed and agreed upon and add it to the agreement as an appendix. الاقتراح العراقي : ان الوفد العراقي قد طلب من الوفد الأمريكى ان يقدم قائمة من الهياكل والمناطق التي طلبت ان يكون لمناقشتها والاتفاق عليها واضافتها الى اتفاق كتذييل.
2- “US forces” is the entity that includes the members of the armed forces, civilian members, and all the equipments and materials owned by the US forces in Iraq. 2 -- "ان القوات الامريكية" هي الكيان الذي يضم اعضاء من القوات المسلحه ، واعضاء المدنيه ، وجميع الاجهزه والمواد التي تملكها القوات الامريكية فى العراق.
3- “Members of the armed forces” include any member of the US army, navy, air force, marines or coast guard. 3 -- "افراد القوات المسلحه" تشمل اي عضو من اعضاء الجيش الامريكى والبحرية والقوات الجوية ومشاة البحرية او حرس السواحل.
4- “Civilian members” include any civilian working for the US Ministry of Defense, excluding those members who usually reside in Iraq. 4 -- "اعضاء المدنيه" تشمل اي عمل المدنيه بالنسبة للولايات المتحدة الامريكية وزارة الدفاع ، ما عدا من اعضاء يقيمون عادة في العراق.
5- “US contractors” or “workers hired by US contractors” include non Iraqi persons and entities and employees who are US or third country citizens and who are in Iraq to supply goods, services or security to the US forces or on behalf of it in accordance to a contract. 5 -- "المقاولين من دولارات الولايات المتحدة" او "العمال المتعاقدين الذين عينتهم الولايات المتحدة" غير وتشمل الأشخاص والكيانات العراقية والموظفين هم من الولايات المتحدة او في بلد ثالث والمواطنين من هم في العراق لتوريد السلع أو الخدمات أو الأمن الى القوات الامريكية ، او من ينوب عنه انه وفقا للعقد. This does not include Iraqi entities. وهذا لا يشمل الكيانات العراقية.
6- “Official vehicles”: commercial vehicles that may be modified for security reasons, and are designed originally to transport individuals on different terrains. 6 -- "المركبات الرسمية" : المركبات التجارية التي يمكن تعديلها لاسباب امنية ، ومصممة اصلا لنقل الافراد على مختلف الاراضي.
7- “Military vehicles”: include all vehicles used by the US armed forces, that were originally designed for combat operations, and have special numbers and signs in accordance to the regulations and laws of US armed forces. 7 -- "آليات عسكرية" : وتشمل جميع المركبات التي تستخدمها القوات المسلحه الاميركية ، التي كانت مصممة أصلا لعمليات القتال ، وخاصة الأرقام والعلامات وفقا لانظمة وقوانين القوات المسلحه الاميركية.
8- “defense equipment” include systems, weapons, ammunition, equipment, and materials used in conventional wars only, that the US forces need in accordance to this agreement, and that are not connected in any way to weapons of mass destruction (chemical weapons, nuclear weapons, radiological weapons, biological weapons, and waste related to such weapons). 8 -- "اجهزة الدفاع" ان يشمل نظم الاسلحة والذخائر والمعدات ، والمواد المستخدمة في الحروب التقليديه فقط ، بان القوات الامريكية وفقا للحاجة الى هذا الاتفاق ، والتي ليست مرتبطة باي شكل من الاشكال لاسلحه الدمار الشامل (الاسلحة الكيمياءيه ، الأسلحة النووية ، والاسلحة الاشعاعيه ، والأسلحة البيولوجية ، والنفايات ذات الصلة لهذه الاسلحة).
9- “storage”: keeping defense equipment needed by the US forces for activities agreed upon in this agreement. 9 -- "التخزين" : الدفاع حفظ المعدات التي تحتاج اليها القوات الاميركية للانشطه المتفق عليها في هذا الاتفاق.
10- “taxes and custom”: include all taxes, customs (including border customs), and any other tariffs enforced by the Iraqi government and its entities and provinces in accordance to Iraqi laws and regulations. 10 -- "الضرائب والجمارك" : وتشمل جميع الضرائب والجمارك (بما فيها الحدود والجمارك) ، وغيرها من التعريفات الجمركيه المطبقه من قبل الحكومة العراقية والكيانات في المحافظات وفقا للقوانين والانظمه العراقية. This does not include money paid for the Iraqi government in exchange for services required or used by the US forces. وهذا لا يشمل الاموال المدفوعه للحكومة العراقية في لقاء الخدمات المطلوبة او المستخدمة من قبل القوات الامريكية.
Article Three المادة الثالثة
Rule of Law سيادة القانون
All members of the US armed forces and civilian members must follow Iraqi laws, customs, traditions, and agreements while conducting military operations in accordance to this agreement. جميع اعضاء القوات المسلحه الاميركية واعضاء المدنيه العراقية يجب ان يتبع القوانين والعادات والتقاليد ، واتفاقات أثناء إجراء العمليات العسكرية وفقا لهذا الاتفاق. They must also avoid any activities that do not agree with the text and spirit of this agreement. ويجب عليها ايضا ان تجنب الانشطه التي لا تتفق مع نص وروح هذا الاتفاق. It is the responsibility of the US to take all necessary measures to insure this. وتقع على عاتق الولايات المتحدة على اتخاذ جميع التدابير اللازمة لضمان هذا.
Article Four المادة الرابعة
Responsibilities المسؤوليات
For the purpose of deterring external and/or internal threats against the Republic of Iraq, and to continue the collaboration to defeat Al-Qaeda in Iraq and other outlaw groups, temporarily, both sides have agreed on: لغرض ردع الخارجية و / او ضد التهديدات الداخلية لجمهورية العراق ، وعلى مواصلة التعاون لدحر القاعده في العراق والمجموعات الاخرى الخارجة ، مؤقتا ، اتفق الجانبان على ما يلي :
1- The Iraqi government asks for the temporary help of the US forces to support Iraq’s effort in maintaining security and stability of Iraq, including the collaboration in conducting operations against Al-Qaeda and other terrorist groups and outlaw groups, including the remains of the former regime. 1 -- يطالب الحكومة العراقية المؤقتة لمساعدة القوات الامريكية من العراق لدعم الجهود التي تبذلها في الحفاظ على أمن وإستقرار العراق ، بما فيها التعاون فى اجراء عمليات ضد القاعده وغيرها من الجماعات الارهابيه والجماعات الخارجة ، بما تبقى من النظام السابق.
2- Military operations that are conducted in accordance to this agreement with the approval of the Iraqi government and with full coordination with Iraqi authorities. 2 -- العمليات العسكرية التي تجري وفقا لهذا الاتفاق مع موافقة الحكومة العراقية وبالتنسيق الكامل مع السلطات العراقية. Coordinating such military operations will be supervised by a joint mobile operations command centers (JMOCC) created in accordance with this agreement. تنسيق هذه العمليات العسكرية سوف تكون تحت اشراف مشترك على مراكز قيادة العمليات المتنقله (jmocc) التي انشئت وفقا لهذا الاتفاق. Any military issues that are not resolved by these centers are submitted to a joint committee of ministries. اي ان المسائل العسكرية لا تحل عن طريق هذه المراكز تقدم الى لجنة مشتركة من الوزارات.
3- Operations must respect the Iraqi constitution and laws, and Iraqi sovereignty and national interests as defined by the Iraqi government. 3 -- العمليات يجب ان تحترم الدستور العراقي والقوانين العراقية والسياده والمصالح الوطنية على النحو المحدد من قبل الحكومة العراقية. The US forces must respect the Iraqi laws, traditions, and customs. القوات الامريكية يجب ان تحترم القوانين العراقية ، والتقاليد ، والعادات.
4- Both sides will continue their efforts in collaboration and improving Iraq’s security capacity, including training, supplying, supporting, founding, and upgrading administrative systems. 4 -- كلا الجانبين وسوف تواصل بذل جهودها فى التعاون وتحسين القدرة على امن العراق ، بما في ذلك التدريب ، وتوفير دعم ، تأسيس ، وتحسين مستوى النظم الاداريه.
5- There is nothing in this agreement that limits either sides’ rights of self defense. 5 -- وليس هناك شيء في هذا الاتفاق ان يحد من كلا الجانبين 'الانسان للدفاع عن النفس.
Article Five المادة الخامسة
Property Ownership الملكيه
1- Iraq owns all non-mobile buildings and structures that are built on the ground in the installations and areas agreed upon, including those built, used, enhanced, or changed by the US forces. 1 -- العراق يمتلك جميع المنظمات غير المتنقله المبانى والهياكل التي بنيت على ارض الواقع في المناطق والمنشآت المتفق عليها ، بما فيها تلك التي بنيت ، المستخدمة ، وتعزيز ، أو تغيير من قبل القوات الامريكية.
2- The US is responsible for all expenses of construction, remodeling, modification in installations and areas agreed upon used exclusively by the US. 2 -- الولايات المتحدة هي المسءوله عن جميع نفقات البناء ، واعادة عرض ، وتعديل المنشآت في المناطق المتفق عليها ويقتصر استخدامها من قبل الولايات المتحدة. The US forces will consult with the Iraqi authorities regarding the works of construction, remodeling, and modification. القوات الامريكية وسوف تتشاور مع السلطات العراقية فيما يتعلق باعمال تشييد ، واعادة عرض ، وهذا التعديل. The US will seek the Iraqi government’s approval for major construction or modification projects. الولايات المتحدة ستسعى الحكومة العراقية الموافقة على البناء الكبرى او تعديل مشاريع. In case of shared use of installations and areas agreed upon both sides are responsible for expenses. في حالة الاستخدام المشترك والمنشآت والمناطق المتفق عليها في كلا الجانبين مسؤولة عن النفقات. The US forces will pay the fees of services used exclusively by the USBoth sides cover the expenses of shared installations and areas agreed upon. القوات الامريكية سوف دفع رسوم الخدمات المستخدمة على وجه الحصر من قبل الجانبين usboth تغطية النفقات المشتركة والمنشآت والمناطق المتفق عليها.
3- In the case of a discovery of historic or cultural sites, or the discovery of a strategic natural resource, in the installations and areas agreed upon, all work of construction or modification or remodeling must stop immediately, and the Iraqi representatives in the joint committee must be informed. 3 -- فى حالة وجود اكتشاف المواقع الثقافيه او التاريخية ، او اكتشاف استراتيجية الموارد الطبيعيه ، والمنشآت في المناطق المتفق عليها ، وجميع اعمال بناء او تعديل او اعادة عرض يجب ان تتوقف فورا ، والممثلين العراقيين في المشتركة ويجب ان تكون اللجنة على علم بها.
4- The United States will return all installations and areas agreed upon and any non-mobile buildings that were constructed, remodeled, or modified under this agreement, according to mechanisms and priorities agreed upon by the joint committee. 4 -- ان الولايات المتحدة سوف يعود وجميع المنشآت والمناطق المتفق عليها وغير المتنقله أي المباني التي شيدت ، مشكل ثانية ، او المعدلة بموجب هذا الاتفاق ، وفقا لآليات والاولويات التى اتفقت عليها اللجنة المشتركة. They will be returned to Iraq without charge, unless both sides agree otherwise. وسيتم اعادتها الى العراق دون تهمة ، ما لم يوافق الجانبان على خلاف ذلك.
5- The US will return all installations and areas agreed upon that have special cultural or political importance and that were constructed, remodeled, or modified under this agreement, according to mechanisms and priorities agreed upon by the joint committee. 5 -- الولايات المتحدة سوف يعود وجميع المنشآت والمناطق التي اتفق عليها او الثقافيه او السياسية الخاصة واهمية ان كانت قد شيدت ، مشكل ثانية ، او المعدلة بموجب هذا الاتفاق ، وفقا لآليات والاولويات التى اتفقت عليها اللجنة المشتركة. When this agreement goes into effect, the US will immediately return the properties listed in the attached appendix and mentioned in the letter sent by the US embassy to the Iraqi minister of foreign affairs dated (…) وعندما يذهب هذا الاتفاق حيز التنفيذ ، والولايات المتحدة على الفور اعادة الممتلكات المسجله في التذييل المرفق وجاء في الرسالة التي بعث بها الى السفارة الاميركية العراقي وزير الخارجية المءرخه في (…)
6- What remains of installations and areas agreed upon will be returned to the Iraqi authorities after this agreement expires or if the US forces no longer needs them. 6 -- ما تبقى من المنشآت والمناطق المتفق عليها وسوف تعاد الى السلطات العراقية بعد انتهاء هذا الاتفاق او إذا كانت القوات الأمريكية لم تعد بحاجة اليها.
7- The US forces and US contractors maintain their ownership of all equipment, materials, supplements, mobile structures, and other mobile properties imported to Iraq or obtained in Iraq in accordance to the agreement. 7 -- ان القوات الامريكية والمقاولين من دولارات الولايات المتحدة الحفاظ على ملكيه جميع المعدات والمواد التكميليه ، والهياكل المتحركه ، وغيرها من الممتلكات المتنقله المستورده الى العراق او التي يتم الحصول عليها في العراق وفقا لهذا الاتفاق.
Article Six المادة السادسه
Usage of Installations and areas agreed upon استخدام المنشآت والمناطق المتفق عليها
1- Iraq guarantees the accessibility of the US forces and US contractors to installations and areas agreed upon according to what both sides agree on, while insuring that Iraq’s sovereignty is not undermined. 1 -- العراق امكانيه الحصول على ضمانات من القوات الامريكية والمقاولين الى الولايات المتحدة ومنشآتها والمناطق المتفق عليها وفقا لما يتفق الجانبان على ، في حين ان تأمين وضمان سيادة العراق وعدم تقويض. Installations and areas agreed upon will be returned to Iraq without charge, unless both sides agree otherwise. المنشآت والمناطق التي سيتم الاتفاق عليها عادوا الى العراق دون تهمة ، ما لم يوافق الجانبان على خلاف ذلك.
2- Iraq authorizes the US forces to practice all the authorities and have all the rights to manage construct, use, maintain, and secure installations and areas agreed upon. 2 -- العراق يأذن القوات الامريكية لممارسة جميع السلطات وجميع الحقوق لادارة بناء واستخدام والمحافظة ، وأمن المنشآت والمناطق المتفق عليها. Both sides coordinate and collaborate regarding shared installations and areas agreed upon. كلا الجانبين بشأن التنسيق والتعاون المشتركة والمنشآت والمناطق المتفق عليها.
3- The United States forces control the entrances of the installations and areas agreed upon. 3 -- قوات الولايات المتحدة من السيطرة على مداخل المنشآت والمناطق المتفق عليها. Both sides coordinate their work in shared installations and areas agreed upon based on mechanisms put by the joint military operations committee. كلا الجانبين تنسيق اعمالها والمنشآت المشتركة في المجالات المتفق عليها على اساس الاليات التى طرحتها لجنة عمليات عسكرية مشتركة.
Article 7 المادة 7
Storage of defense equipments تخزين معدات الدفاع
1- The US forces are authorized to store in the installations and areas agreed upon systems, weapons, ammunition, equipment, and materials used by the US forces and related to the US temporary mission in Iraq. 1 -- ان القوات الامريكية هى اذن لتخزين والمنشآت في المناطق المتفق عليها ونظم الاسلحة والذخائر والمعدات ، والمواد المستخدمة من قبل القوات الامريكية وما يتصل بها الى الولايات المتحدة بعثة مؤقتة فى العراق. Weapons that are used by the US forces are not connected in any way to weapons of mass destruction (chemical weapons, nuclear weapons, radiological weapons, biological weapons, and waste related to such weapons). الاسلحة التى تستخدمها القوات الامريكية ولا ترتبط باي شكل من الاشكال لاسلحه الدمار الشامل (الاسلحة الكيمياءيه ، الأسلحة النووية ، والاسلحة الاشعاعيه ، والأسلحة البيولوجية ، والنفايات ذات الصلة لهذه الاسلحة). The US forces control the use and transportation of such weapons. القوات الامريكية تحكم في استخدام ونقل مثل هذه الاسلحة. The US forces guarantees than no weapons or ammunition will be stored near residential areas, and it will inform the Iraqi government with important information regarding their amount and types. القوات الامريكية ضمانات من أية اسلحه او ذخائر وسيتم تخزين بالقرب من المناطق السكنيه ، وسوف تبلغ الحكومة العراقية معلومات مهمة فيما يتعلق المبلغ وأنواع.
Article 8 المادة 8
Environmental Protection حمايه البيئة
Both sides agree to implement this agreement while protecting nature and human security and health. يوافق الجانبان على تنفيذ هذا الاتفاق في حين ان حمايه الطبيعة والانسان والامن والصحة. The US complies with Iraqi environmental laws, and Iraq should comply with its laws and regulations to protect the health of the US armed forces. الولايات المتحدة يتوافق مع القوانين البيءيه العراقية ، والعراق يجب ان تكون متفقة مع القوانين واللوائح لحمايه صحه صفوف القوات المسلحه الامريكية.
Article 9 المادة 9
Movement of vehicles, ships, and airplanes حركة المركبات ، والسفن ، والطائرات
1- US forces’ vehicles and ships are permitted to enter and exit and move inside Iraqi territories for the purposes of this agreement. 1 -- القوات الامريكية 'والمركبات والسفن يسمح لهم بالدخول والخروج والتحرك داخل الأراضي العراقية لاغراض هذا الاتفاق. The joint committee puts the appropriate regulations to control this movement. اللجنة المشتركة ويضع الانظمه المناسبه للسيطره على هذه الحركة.
2- US government airplanes and civilian airplanes contracted with the US Department of Defense are authorized to fly in the Iraqi airspace, refueling in the air, landing and departing in Iraq. 2 -- الحكومة الامريكية الطائرات المدنيه وطائرات تعاقدت مع وزارة الدفاع الامريكية يؤذن لتحلق في المجال الجوي العراقي ، بالوقود في الجو والهبوط والمغادره في العراق. The Iraqi authorities will give a one year authorization to the mentioned airplanes to land and depart from Iraq for the purposes of this agreement. السلطات العراقية في اعطاء الاذن لمدة سنة واحدة على الطائرات المذكورة في الارض والخروج من العراق لاغراض هذا الاتفاق. No parties are allowed aboard US government airplanes and civilian airplanes contracted with the US Department of Defense and related ships and vehicles without US forces consent, and they cannot be searched. الاطراف لا يسمح لحكومة الولايات المتحدة على متن الطائرات والطائرات المدنيه المتعاقده مع وزارة الدفاع الامريكية والسفن والمركبات ذات الصلة دون موافقة القوات الامريكية ، وانها لا يمكن ان يكون للتفتيش. The joint committee puts the appropriate regulations to facilitate their movement. اللجنة المشتركة ويضع اللوائح الملاءمه لتسهيل حركتهم.
3- Air traffic control and surveillance are handed over immediately to the Iraqi authorities as soon as this agreement goes into effect. 3 -- ومراقبة حركة الطيران وتسليمهم فورا الى السلطات العراقية في اقرب وقت وغني عن هذا الاتفاق حيز التنفيذ.
4- Iraq can ask for the US forces to temporarily take responsibility of the control and surveillance of the Iraqi airspace, and these tasks will be handed over to the Iraqi government upon its request. 4 -- يمكن للعراق ان اسأل عن القوات الامريكية لتحمل المسؤولية مؤقتا من المراقبة والاشراف من المجال الجوي العراقي ، وهذه المهام سيتم تسليمهم الى الحكومة العراقية بناء على طلبها. The Iraqi authorities will participate in the control and surveillance of the Iraqi airspace during the temporary period. السلطات العراقية المشاركة في المراقبة والاشراف من الاجواء العراقية خلال فترة مؤقتة.
5- US government airplanes and civilian airplanes contracted with the US Department of Defense are not subject to taxes or related fees, including any fees related to flying in Iraqi airspace, refueling in the air, landing and departing in Iraq. 5 -- طائرات حكومة الولايات المتحدة الامريكية والطائرات المدنيه المتعاقده مع وزارة الدفاع الامريكية لا تخضع للضرائب او رسوم ذات الصلة ، بما في ذلك اية رسوم ذات الصلة التي تحلق في المجال الجوي العراقي ، بالوقود في الجو والهبوط والمغادره في العراق. Also, US ships and civilian ships contracted with the US Department of Defense are not subject to taxes or related fees during using Iraqi ports. كما ان السفن الاميركية والسفن المدنيه المتعاقده مع وزارة الدفاع الامريكية لا تخضع للضرائب او رسوم ذات الصلة خلال استخدام الموانئ العراقية. Airplanes and ships are not subject to any search, and all Iraqi requirements of registration are waived. الطائرات والسفن التي لا تخضع لاي بحث ، وجميع الاحتياجات العراقية للتسجيل هي التنازل عنها.
6- US forces pay money for any services or materials obtained or received in Iraq. 6 -- القوات الامريكية لدفع اموال او اي خدمات او المواد التي حصلت عليها وردت في العراق.
7- Both sides exchange maps and other information on mines and other obstacles in the Iraqi lands and waters that might jeopardize either side’s movement in Iraq’s land and waters. 7 -- تبادل الجانبان والخرائط وغيرها من المعلومات عن الألغام وغيرها من العقبات القائمة في الأراضي العراقية ، والمياه التي يمكن ان يعرض للخطر أي من الجانبين للحركة في العراق والاراضي والمياه.
Article Ten المادة عشر
Contracting المقاولات
US forces are permitted to sign contracts in accordance to US law to obtain materials and services in Iraq, including construction services. القوات الامريكية ويسمح لتوقيع عقود وفقا لقانون الولايات المتحدة للحصول على المواد والخدمات في العراق ، بما فى ذلك البناء والخدمات. US forces can obtain such materials and services from any source, and they must respect Iraq laws when signing contracts, and they will choose Iraqi contractors when possible as long as their bids have the best value. القوات الامريكية ويمكن الحصول على هذه المواد والخدمات من اي مصدر ، وأنها يجب أن تحترم قوانين العراق عند التوقيع على العقود ، وسوف اختيار المقاولين العراقيين عندما يكون ذلك ممكنا ما دام قد عطاءاتهم على أفضل قيمة. The US forces will inform the Iraqi authorities of the Iraqi importers and Iraqi contractors names and the amount of relevant contracts. القوات الامريكية وسوف تبلغ السلطات العراقية للمستوردين عراقيين واسماء المقاولين العراقيين ، ومبلغ من العقود ذات الصلة.
Article Eleven المادة الحاديه عشرة
Services and telecommunications والاتصالات السلكيه واللاسلكيه
1- US forces are permitted to produce and generate water and electricity and other services for the installations and areas agreed upon in coordination with the Iraqi authorities through the joint committee. 1 -- القوات الامريكية يسمح لانتاج وتوليد المياه والكهرباء وغيرها من الخدمات للمنشآت والمناطق المتفق عليها في التنسيق مع السلطات العراقية من خلال اللجنة المشتركة.
2- The Iraqi government owns all frequencies. 2 -- ان الحكومة العراقية تمتلك جميع الترددات. The Iraqi authorities allocate special waves for the US forces based on what both sides decide through the joint committee (JMOCC). السلطات العراقية تخصيص موجات خاصة للقوات الامريكية بناء على ما تقرر كلا الجانبين من خلال اللجنة المشتركة (jmocc). The US forces will give these waves back after it is done with using them. القوات الامريكية وسوف تعطي هذه الامواج الى الوراء بعد ان تتم مع استخدامها.
3- The US forces are permitted to operate their own wired and wireless telecommunications (according to the definition of wired and wireless telecommunications in the Convention of the International Telecommunication Union of 1992), including all the special services needed to secure the full capacity of telecommunications operations. 3 -- ان القوات الامريكية يسمح لتشغيل خاصة بها للاتصالات السلكيه واللاسلكيه (وفقا لتعريف السلكيه واللاسلكيه والاتصالات السلكيه واللاسلكيه في الاتفاقية للاتحاد الدولي للاتصالات لعام 1992) ، بما في ذلك جميع الخدمات الخاصة اللازمة لتأمين القدرة الكاملة للاتصالات السلكيه واللاسلكيه العمليات. The US operates its systems in accordance to the Convention of the International Telecommunication Union whenever it is possible to implement these regulations. وتعمل الولايات المتحدة وانظمتها وفقا لاتفاقيه للاتحاد الدولي للاتصالات كلما كان ذلك ممكنا لتنفيذ هذه الانظمه.
4- For the purposes of this agreement, all fees related to the US usage of telecommunications frequencies are waived, including any administrative or other related fees. 4 -- لأغراض هذا الاتفاق ، جميع الرسوم ذات الصلة الى الولايات المتحدة لاستخدام الترددات والاتصالات السلكيه واللاسلكيه هي التنازل ، بما في ذلك أي او الاداريه او غيرها من الرسوم المتصله.
5- US forces will coordinate with the Iraqi authorities regarding any telecommunications infrastructure projects outside the installations and areas agreed upon. 5 -- القوات الامريكية وسوف تنسق مع السلطات العراقية فيما يتعلق بأي مشاريع البنية التحتية للاتصالات السلكيه واللاسلكيه خارج المنشآت والمناطق المتفق عليها.
Article Twelve المادة الثانية عشرة
Legal Jurisdictions النظم القانونية
1- The US has exclusive legal jurisdiction over US armed forces members and civilian members inside and outside installations and areas agreed upon. 1 -- الولايات المتحدة الحصريه القانونية ولاية قضائية على اعضاء القوات المسلحه الاميركية واعضاء المدنيين داخل وخارج المنشآت والمناطق المتفق عليها.
Iraqi Suggestion:< the Iraqi delegation has suggested the following: The US has the legal jurisdictions over the US armed forces members and civilian members inside installations and areas agreed upon at all times, and outside the installations and areas agreed upon while conducting missions except for intentional crimes and major mistakes. الاقتراح العراقي : <ان الوفد العراقي قد اقترح ما يلي : الولايات المتحدة لديها ولايات قانونيه على مدى اعضاء القوات المسلحه الاميركية واعضاء داخل المنشآت المدنيه والمناطق المتفق عليها في جميع الأوقات ، وخارج نطاق المنشآت والمناطق التي اتفق عليها اثناء اجراء باستثناء البعثات من الجرائم والاخطاء الكبرى.
US suggestion: The US delegation suggested the following:As a temporary regulation, and until the withdrawal of the US combat forces is complete as indicated in paragraph 1 of article 26, until the combat missions are over the US has the exclusive legal jurisdiction over US armed forces members and civilian members inside and outside installations and areas agreed upon. اقتراح امريكى : الولايات المتحدة واقترح وفد التالية : لائحة مؤقتة ، والى ان يتم انسحاب القوات المقاتله الامريكية وفقا لما هو مبين في الفقره 1 من المادة 26 ، الى ان ما يزيد على مكافحة بعثات الولايات المتحدة حصرا القانونية ولاية قضائية على الولايات المتحدة اعضاء القوات المسلحه واعضاء المدنيين داخل وخارج المنشآت والمناطق المتفق عليها.
2- The US will give its full attention to any complaint submitted by Iraq over intentional crimes and major mistakes that break Iraqi laws committed by US armed forces members and civilian members. 2 -- الولايات المتحدة سوف توجه اهتمامها الكامل الى اي شكوى مقدمة من العراق أكثر من الجرائم والاخطاء الرئيسية التى تنتهك القوانين العراقية التي يرتكبها افراد القوات المسلحه الاميركية واعضاء المدنيه. All complaints submitted by the Iraqi legal authorities will be dealt with by the joint committee and settled by mutual agreement of both sides. جميع الشكاوى المقدمة من السلطات القانونية العراقية وسيتم التعامل مع هذا من قبل اللجنة المشتركة وتسوى بالاتفاق المتبادل بين الجانبين.
Iraqi Suggestion: the Iraqi delegation has suggested the following: الاقتراح العراقي : ان الوفد العراقي قد اقترح ما يلي :
Iraq has legal jurisdiction over US armed forces members and civilian members who commit intentional crimes or major mistakes that break the Iraqi laws. العراق قد القانونية الولايه القضاءيه على اعضاء القوات المسلحه الاميركية والمدنيين من اعضاء ارتكاب الجرائم او الاخطاء الرئيسية التى تنتهك القوانين العراقية. The related joint committee concerning jurisdictions takes the appropriate action to solve disputes based on mutual agreement. لجنة مشتركة ذات الصلة بشان السلطات القضاءيه ويتخذ الاجراءات المناسبه لحل النزاعات على اساس اتفاق متبادل.
3- Iraq has legal jurisdiction over US contractors and their employees when they break Iraqi laws. 3 -- العراق قانونيه ولاية قضائية على الولايات المتحدة وموظفيها والمتعاقدين عندما كسر القوانين العراقية.
4- US forces will inform the Iraqi authorities of any criminal investigations that relate to members of the US armed forces or civilian members involved in a crime against a victim that usually lives in Iraq. 4 -- ان القوات الامريكية سوف يبلغ السلطات العراقية اي من التحقيقات الجناءيه التي تتصل افراد من القوات المسلحه الاميركية او المدنيين الاعضاء المشاركة في جريمه ضد المجني عليه عادة ان يعيش في العراق. Both sides put the appropriate regulations to contact people related to incidents, provide details of the case and court dates, and help persons involved contact lawyers in accordance to article 21 of this agreement. كلا الجانبين وضع الانظمه المناسبه للاتصال بالناس الى الحوادث ذات الصلة ، وتقديم تفاصيل عن هذه القضية ، وتواريخ المحكمه ، ومساعدة الاشخاص الضالعين في الاتصال بمحامين وفقا للمادة 21 من هذا الاتفاق. The US will work on holding the court in Iraq when that is appropriate and when both sides agree on it. الولايات المتحدة سوف تعمل على عقد المحكمه في العراق عندما يكون ذلك مناسبا وعندما يوافق الجانبان على ذلك. In case the court was based in the US, the United States will make its best effort to facilitate bringing victims into the court. في حال كانت المحكمه يقع مقرها في الولايات المتحدة ، فان الولايات المتحدة ستبذل اقصى الجهود لتسهيل تحقيق الضحايا الى المحكمه.
5- Both sides agree to help each other in incidents’ investigations and collecting evidences to support a fair judgment. 5 -- يوافق الجانبان على ان تساعد كل منهما الاخرى فى حوادث 'التحقيقات وجمع الادله لدعم حكم عادل.
6- All members of US armed forces or civilian members who get arrested by the Iraqi authorities must be surrendered immediately to the US forces authorities. 6 -- جميع اعضاء القوات المسلحه الاميركية او المدنيين من الحصول على اعتقال اعضاء من قبل السلطات العراقية يجب ان تكون على الفور واستسلم الى القوات الامريكية ، السلطات.
Iraqi Suggestion: the Iraqi delegation has suggested the following: الاقتراح العراقي : ان الوفد العراقي قد اقترح ما يلي :
All members of US armed forces or civilian members who get arrested by the Iraqi authorities must be surrendered to the US forces authorities within 24 hours. جميع اعضاء القوات المسلحه الاميركية او المدنيين من الحصول على اعتقال اعضاء من قبل السلطات العراقية يجب ان يكون تسليمه الى القوات الامريكية للسلطات فى غضون 24 ساعة.
Article Thirteen المادة ثلاثة عشر
Baring Guns and wearing uniforms الكشف البنادق ويرتدون ازياء
US armed forces members and civilian members are authorized to carry US government guns during their presence in Iraq based on the authorities and orders given to them. اعضاء القوات المسلحه الاميركية والمدنيين الاعضاء اذن للقيام الحكومة الامريكية البنادق اثناء وجودها في العراق على اساس السلطات والاوامر المعطاه لهم. US armed forces members are also permitted to wear their official uniforms during duty in Iraq. اعضاء القوات المسلحه الاميركية كما يسمح لارتداء البزات الرسمية خلال واجب في العراق.
Article Fourteen المادة اربعة عشر
Entering and Exiting الدخول والخروج
1- For the purposes of the agreement, US armed forces members and civilian members can enter and exit Iraq from official borders using US-issued ID cards. 1 -- لأغراض هذا الاتفاق ، واعضاء القوات المسلحه الاميركية والمدنيه يمكن للاعضاء دخول وخروج العراق من الحدود الرسمية بين الولايات المتحدة باستخدام بطاقات الهوية الصادرة. The joint committee puts a mechanism for the Iraqi verification process. اللجنة المشتركة ويضع آلية لالعراقية عملية التحقق.
2- For purposes of verification the US forces will submit to the Iraqi authorities a list with the names of US armed forces members and civilian members entering and exiting Iraq or through the Installations and areas agreed upon. 2 -- لاغراض التحقق من ان القوات الامريكية سوف يقدم الى السلطات العراقية لائحة باسماء اعضاء القوات المسلحه الاميركية والمدنيين اعضاء الدخول والخروج من العراق او من خلال المنشآت والمناطق المتفق عليها.
3- The Iraqi entering and exiting laws can be implemented on others, but not on the US armed forces members and civilian members. 3 -- العراقية الدخول والخروج من القوانين لا يمكن تنفيذها على الآخرين ، ولكن ليس على الولايات المتحدة الامريكية اعضاء في القوات المسلحه والمدنيين اعضاء.
Article Fifteen المادة الخامسة
Importing and Exporting استيراد وتصدير
1- For the purposes of the agreement, including training and services, the US forces and their contractors are permitted to import into Iraq and export from Iraq and re-export from Iraq and transport and use any equipments, supplements, materials, technology, training, or services except for those materials banned in Iraq at the time of signing this agreement. 1 -- لأغراض هذا الاتفاق ، بما في ذلك التدريب والخدمات ، فان القوات الامريكية والمقاولين ويسمح لاستيراد وتصدير الى العراق من العراق واعادة التصدير من العراق ونقل واستخدام أي معدات ، وملاحق ، والمواد ، والتكنولوجيا والتدريب ، أو الخدمات باستثناء تلك المواد المحظوره في العراق ، عند توقيع هذا الاتفاق. These materials are not subject to search or to license requirement or any other limitations. هذه المواد لا تخضع للبحث او الترخيص أو شرط أو أي قيود اخرى. Exporting Iraqi goods by the US forces is not subject to search or any other limitations either except the license discussed later in this agreement. تصدير البضائع العراقية من قبل القوات الامريكية ، لا يخضع للبحث أو أي قيود اخرى اما عدا الرخصه التي نوقشت في وقت لاحق من هذا الاتفاق. The joint committee will coordinate with the Iraqi ministry of trade to facilitate getting the required export license in accordance to the Iraqi laws related to exporting goods by US forces. اللجنة المشتركة بالتنسيق مع وزارة التجارة العراقية لتسهيل الحصول على رخصة تصدير المطلوبة وفقا للقوانين ذات الصلة العراقي لتصدير البضائع من قبل القوات الامريكية.
2- US forces members and civilian members are permitted to import, re-export, and use their personal equipment and materials for consumption or personal use. 2 -- افراد القوات الامريكية والمدنيين ويسمح لاعضاء استيراد واعادة تصدير ، واستخدام حقوقهم الشخصيه ومعدات ومواد للاستهلاك او للاستعمال الشخصي. Such materials are not subject to any licenses, limitations, taxes and customs or other fees defined in paragraph 10 of article 2, except for required or obtained services. هذه المواد لا تخضع لأي التصاريح ، وقيود وضرائب ورسوم جمركيه او غيرها المحددة في الفقره 10 من المادة 2 ، باستثناء الخدمات المطلوبة او الحصول عليها. The amount of imports must be reasonable and for personal use. كمية الواردات يجب ان يكون معقولا وللاستعمال الشخصي. The US forces authorities will put the needed regulations to insure no materials or articles of cultural or historical value are exported. السلطات ان القوات الامريكية وسوف يضع الانظمه اللازمة لتأمين المواد او اي مواد او ثقافية او تاريخية قيمة ويتم تصدير.
3- Materials mentioned in paragraph 2 will be searched in a speedy fashion in a specific location agreed upon according to the joint committee. 3 -- المواد المشار اليها في الفقره 2 وسيتم تفتيش سريع في الازياء في موقع معين يتفق عليه وفقا لما اللجنة المشتركة.
4- If the tax exempt materials in accordance to this agreement were to be sold in Iraq to individuals or entities not included in tax exemption, taxes and customs as defined in paragraph 10 of article 2 are to be paid by the buyer. 4 -- إذا كانت معفاه من الضرائب وفقا لمواد هذا الاتفاق كان من المقرر ان تباع في العراق الى كيانات او افراد غير المدرجه في الاعفاء من الضرائب ، والضرائب والجمارك على النحو المحدد في الفقره 10 من المادة 2 على ان تدفع من قبل المشتري.
5- It is not permissible to import any of the materials mentioned in this article for commercial reasons. 5 -- لا يجوز استيراد اي من المواد المذكورة في هذه المادة لاسباب تجارية.
Article Sixteen المادة السادسه عشرة
Taxes الضرائب
1- Services and goods obtained by US forces in Iraq for official use are not subject to taxes and fees as defined in paragraph 10 of article 2. 1 -- الخدمات والسلع التي حصلت عليها القوات الامريكية فى العراق للاستعمال الرسمي ، لا تخضع للضرائب ورسوم على النحو المحدد في الفقره 10 من المادة 2.
2- US forces members and civilian members are not subject to any taxes or fees in Iraq except for services obtained or requested by them. 2 -- افراد القوات الامريكية والمدنيين اعضاء لا تخضع لأية ضرائب أو رسوم في العراق باستثناء الحصول على الخدمات او طلب منها.
Article Seventeen المادة السابعه
Licenses and Permits رخص وتصاريح
1- Iraq agrees to accept valid US-issued drivers’ licenses held by US forces members, civilian members and US contractors without subjecting them to any tests or operation fees for vehicles, ships, and airplanes owned by the US forces in Iraq. 1 -- العراق وافق على قبول صالحة لنا - أصدر السائقين رخص الذي عقده اعضاء القوات الامريكية ، والولايات المتحدة اعضاء المدنيين المتعاقدين دون اخضاعها لاختبارات او أي رسوم لتشغيل المركبات والسفن ، والطائرات التي تملكها القوات الامريكية فى العراق.
2- Iraq agrees to accept valid US-issued drivers’ licenses held by US forces members, civilian members and US contractors to operate their personal cars in Iraq without subjecting them to any tests or fees. 2 -- العراق وافق على قبول صالحة لنا - أصدر السائقين رخص الذي عقده اعضاء القوات الامريكية ، والولايات المتحدة اعضاء المدنيين المتعاقدين لتشغيل السيارات الشخصيه في العراق دون اخضاعها لاختبارات او اي رسوم.
Article Eighteen المادة الثامنة عشرة
Official and Military Vehicles والمركبات العسكرية الرسمية
For the purposes of this article: لاغراض هذه المادة :
1- Officials vehicles are commercial vehicles that might be modified for security reasons, and they will carry Iraqi license plates to be agreed upon by both sides. 1 -- المسؤولين المركبات المركبات التجارية التي يمكن تعديلها لاسباب امنية ، وأحيانا تحمل لوحات عراقيه يتم الاتفاق عليها بين الجانبين. Iraqi authorities will issue, based on a request by the US forces authorities, license plates for US forces official cars without fees, and US forces will reimburse the Iraqi authorities for the cost of these plates. السلطات العراقية في هذه المساله ، بناء على طلب من السلطات ان القوات الامريكية ، لوحات لمواجهة القوات الامريكية دون رسوم السيارات الرسمية ، والقوات الامريكية سوف تسدد السلطات العراقية لتغطية تكاليف هذه اللوحات.
2- Iraq agrees to accept the validity of US-issued licenses and registrations for the US forces official vehicles. 2 -- العراق وافق على قبول صحه بنا - تصدر التراخيص والتسجيلات القوات الامريكية للسيارات الرسمية.
3- All US military vehicles are exempt from registration and licenses requirements. 3 -- جميع المركبات العسكرية الأمريكية معفاه من شروط التسجيل والتراخيص. These vehicles will be identified with distinguishable numbers and signs. هذه المركبات وسيتم تحديد مميزة مع الارقام والعلامات.
Article Nineteen المادة تسعة عشر
Support Services خدمات الدعم
1- US forces, or others acting on its behalf, are permitted to create and manage activities and entities inside the installations and areas agreed upon. 1 -- القوات الأميركية ، أو غيرهم يعمل نيابة عنه ، ويسمح لانشاء وادارة الانشطه والكيانات داخل المنشآت والمناطق المتفق عليها. This includes providing services to US forces members, civilian members, and their contractors. وهذا يشمل تقديم الخدمات لافراد القوات الامريكية ، اعضاء المدنيه ، والمقاولين. These activities and entities might include military post offices, financial services, stores selling food, medicine, goods and other services, and it includes other areas providing entertainment and telecommunications. وهذه الانشطه يمكن ان تشمل الكيانات العسكرية ومكاتب البريد ، والخدمات المالية ، ومتاجر بيع الاغذيه والادوية والسلع والخدمات الأخرى ، ويشمل مجالات اخرى وتوفير وسائل الترفيه والاتصالات السلكيه واللاسلكيه. All of the mentioned services do not require a permit. كل من الخدمات المذكورة لا تحتاج الى ترخيص.
2- Radio, media, and entertainment activities that reache beyond the installations and areas agreed upon must comply with Iraqi laws. 2 -- راديو ، ووسائط الاعلام ، وسائل الترفيه والانشطه التي reache خارج المنشآت والمناطق المتفق عليها ان تمتثل للقوانين العراقية.
3- Support services are for the exclusive use of the US forces members, civilian members, their contractors, and other entities to be agreed upon. 3 -- خدمات الدعم للاستعمال الحصري لافراد القوات الامريكية ، اعضاء المدنيه ، والمقاولين ، والكيانات الأخرى التي يتم الاتفاق حولها. US forces will take the required measures to ensure none of the mentioned support services are misused, and to insure services and goods will not be re-sold to unauthorized individuals. القوات الأمريكية سوف تتخذ الاجراءات اللازمة لضمان ان ايا من خدمات الدعم المذكورة اسيء استعمالها ، وذلك لتأمين الخدمات والسلع لن يعاد بيعها لاشخاص غير مأذون لهم. The US forces will limit radio and TV broadcasting to authorized receivers. القوات الامريكية سوف تحد من الاذاعة والتليفزيون ، اذن لاستقبال البث الاذاعي.
4- Entities and facilities offering services indicated this is article enjoy the same tax exemptions offered to the US forces, including those exemptions mentioned in articles 15 and 16 of this agreement. 4 -- الهيئات والمرافق التي تقدم الخدمات المشار اليها وهذا هو مادة تتمتع بنفس الاعفاءات الضريبيه المقدمة الى القوات الامريكية ، بما في ذلك الاعفاءات المشار اليها في المادتين 15 و 16 من هذا الاتفاق. These entities and facilities offering services are to be operated in accordance to US regulations, and will not be obligated to collect or pay any taxes or fees on its operations. هذه الكيانات والمرافق التي تقدم الخدمات وسيتم تشغيلها فى الولايات المتحدة وفقا للانظمة ، ولن تكون ملزمة لجمع او دفع اي ضرائب او رسوم على عملياتها.
5- Outgoing mail, sent through military postal services, is verified by the US authorities and is exempt from being searched, examined, or confiscated by the Iraqi authorities. 5 -- البريد الصادر ، من خلال ارسال العسكرية والخدمات البريديه ، ويتم التحقق من جانب السلطات الامريكية ومعفى من يجري تفتيشه ، درست ، او المصادره من قبل السلطات العراقية.
Article Twenty المادة العشرون
Currency and Foreign exchange العملة والنقد الاجنبى
1- US forces are permitted to use any amount of US currency or bonds for the purposes of this agreement. 1 -- ان القوات الاميركية تجري يسمح باستعمال اي مبلغ من العملة الامريكية او السندات لاغراض هذا الاتفاق. Using Iraqi currency in US military banks must be in compliance with Iraqi laws. استخدام العملة العراقية في المصارف العسكرية الامريكية يجب ان يكون في الامتثال للقوانين العراقية.
2- US forces are permitted to distribute or exchange any amount of currency to the US forces members, civilians’ members, and their contractors for purposes of travelling, including vacations. 2 -- ان القوات الاميركية تجري يسمح للتبادل او توزيع او اي مبلغ من العملة الى القوات الامريكية ، اعضاء ، المدنيين الاعضاء والمقاولين لاغراض السفر ، بما فيها الاجازات.
3- US forces will not take Iraqi currency out of Iraq, and will take all required measures to insure none of the US forces members, civilian members, or their contractors take Iraqi currency out of Iraq. 3 -- ان القوات الامريكية لن تتخذ العملة العراقية الى خارج العراق ، وستتخذ كل الاجراءات اللازمة لضمان ان ايا من افراد القوات الامريكية ، اعضاء المدنيه ، او المتعاقدين اتخاذ العملة العراقية الى خارج العراق.
Article Twenty One المادة العشرون واحد
Claims الإدعاءات
1- Except for contract related claims, both sides waive their rights to request compensation because of any harm, loss, or destruction of property, or request compensation for injury or death of forces members or civilian members from both sides occurring during their official duties. 1 -- باستثناء العقد المطالبات ذات الصلة ، كلا الجانبين التنازل عن حقهم في طلب تعويضات بسبب اي ضرر او خسارة أو تدمير للممتلكات ، أو طلب التعويض عن الاصابة او الوفاه من افراد القوات المسلحه او المدنيين اعضاء من كلا الجانبين وقعت اثناء تادية واجباتهم الرسمية.
2- Us forces authorities will pay fair and reasonable compensation to settle third party claims arising due to a member of the armed forces or civilian members during their official duties, or due to non-combat accidents caused by US armed forces. 2 -- لنا قوات السلطات ستدفع تعويضات عادلة ومعقولة لتسوية المطالبات الناشءه عن طرف ثالث نتيجة لمن افراد القوات المسلحه او الافراد المدنيين فى اثناء ادائهم لواجباتهم الرسمية ، او بسبب عدم مكافحة الحوادث التي تسببها القوات المسلحه الاميركية. The US forces’ authorities may settle claims caused by non-official duties actions. القوات الامريكية 'يجوز للسلطات تسوية المطالبات الناجمة عن عدم اتخاذ اجراءات لواجباتهم الرسمية. Claims must be dealt with urgently by the US forces’ authorities in accordance to US laws and regulations. يجب ان تكون المطالبات معالجتها على وجه السرعه من قبل القوات الامريكية 'السلطات في الولايات المتحدة وفقا للقوانين والانظمه. When settling claims, the US forces authorities will take in consideration any investigation reports, opinions regarding responsibility, or opinions regarding amount of damages issued by the Iraqi authorities. عند تسوية المطالبات ، ان القوات الامريكية سوف تتخذ السلطات اي تحقيق في النظر في التقارير والآراء المتعلقة بالمسءوليه ، او الرأى بشان مبلغ التعويضات عن الاضرار التي أصدرتها السلطات العراقية.
3- The joint committee will study issues related to claims resulting from paragraph 1 and 2 of this article and find resolutions in accordance to US and Iraqi laws. 3 -- اللجنة المشتركة لدراسة القضايا المتعلقة بالمطالبات الناشءه عن الفقره 1 و 2 من هذه المادة وايجاد قرارات وفقا للقوانين الامريكية والعراقية.
Article Twenty Two المادة اثنين وعشرين
Detention الاحتجاز
1- All detention operations in this agreement must be conducted in accordance to the Iraqi law, constitution, sovereignty and national interest as decided by the Iraqi government in accordance to the international law. 1 -- جميع عمليات الاعتقال في هذا الاتفاق يجب ان تتم وفقا للقانون العراقى ، والدستور والسياده والمصلحه الوطنية على النحو الذي قررته الحكومة العراقية وفقا للقانون الدولي.
2- All individuals detained by US forces must be prepared to be handed over to the Iraqi authorities within 24 hours. 2 -- جميع الافراد المحتجزين من قبل القوات الامريكية يجب ان تكون على استعداد لتسليمها الى السلطات العراقية في غضون 24 ساعة.
3- No detention operations can take place without a warrant issued by the specialized Iraqi authorities in accordance to the Iraqi law. 3 -- لا يمكن لعمليات الاعتقال تتم من دون امر صادر عن السلطات العراقية المتخصصه وفقا للقانون العراقى.
4- When Iraqi authorities conduct detention operations, they may ask for the help of the US forces. 4 -- عندما السلطات العراقية اجراء عمليات الاعتقال ، ويجوز لهم طلب للمساعدة من القوات الاميركية.
5- Detainees are kept in locations prepared by the Iraqi authorities and under its exclusive supervision and control. 5 -- المعتقلين موجودة في المواقع التي اعدتها السلطات العراقية وتحت السيطرة الحصريه الاشراف والرقابة.
6- US forces are not permitted to search houses and other properties without a judicial warrant, unless there was an active combat operation, and in coordinating with the specialized Iraqi authorities. 6 -- ان القوات الامريكية لا يسمح للبحث فى المنازل والممتلكات الاخرى دون امر قضائي ، ما لم يكن هناك نشط فى مكافحة تشغيل ، والتنسيق مع السلطات العراقية المتخصصه.
Article Twenty three المادة الثلاثة والعشرين
Extending this agreement to other countries تمديد هذا الاتفاق الى بلدان اخرى
1- Iraq may reach an agreement with any other country participating in the Multi-National forces to ask for their help in achieving security and stability in Iraq. 1 -- العراق قد توصل الى اتفاق مع أي بلد آخر المشاركة في القوات المتعددة الجنسيه لطلب مساعدتهم في تحقيق الأمن والإستقرار فى العراق.
2- Iraq is permitted to reach an agreement that includes any of the articles mentioned in this agreement with any country or international organization to ask for help in achieving security and stability in Iraq. 2 -- العراق يسمح للتوصل الى اتفاق وذلك يشمل اي من المواد المذكورة في هذا الاتفاق مع اي بلد او منظمة دولية لتطلب المساعدة فى تحقيق الامن والاستقرار فى العراق.
Article twenty four المادة اربع وعشرين
Implementation تطبيق
The following entities are responsible of the implementation of this agreement and the settlement of any disputes over its interpretation and application: الكيانات التالية هي المسءوله من تنفيذ هذا الاتفاق وتسوية أي منازعات على تفسيرها وتطبيقها :
1- A joint committee of ministers from both sides that deal with the basic issues needed to interpret the implementation of this agreement. 1 -- لجنة مشتركة من وزراء من كلا الجانبين التى تتعامل مع القضايا الاساسية اللازمة لتفسير هذا الاتفاق حيز التنفيذ.
2- A joint committee to coordinate military operations. 2 -- لجنة مشتركة لتنسيق العمليات العسكرية. This committee will be formed by the joint committee of ministers and includes representatives from both sides. ستكون هذه اللجنة التي شكلتها لجنة مشتركة من وزراء وتضم ممثلين من كلا الجانبين. The joint committee to coordinate military operations will be jointly led by both sides. فان لجنة مشتركة لتنسيق العمليات العسكرية ستكون مشتركة بقيادة كلا الجانبين.
3- A joint committee formed by both sides that includes representatives chosen by both sides. 3 -- تشكيل لجنة مشتركة من الجانبين التى تضم ممثلين عن اختيار من كلا الجانبين. This committee deals with all issues related to this agreement that do not fall under the mandate of the joint committee to coordinate military operations; this committee will jointly led by both sides. هذه اللجنة تتناول جميع القضايا ذات الصلة في هذا الاتفاق التي لا تدخل في إطار ولاية من لجنة مشتركة لتنسيق العمليات العسكرية ؛ هذه اللجنة برئاسة مشتركة من الجانبين.
4- Sub-committees in all different areas created by the joint committee. 4 -- لجان فرعية في جميع المجالات المختلفة التي انشأتها اللجنة المشتركة. Subcommittees will discuss issues related to interpretation and implementation of this agreement each in accordance to its expertise. وسوف لجان فرعية لمناقشة المسائل المتعلقة بتفسير وتطبيق هذا الاتفاق في كل وفقا لخبرته الفنية.
Article twenty five المادة خمسة وعشرين
Implementation Arrangements ترتيبات التنفيذ
Both sides enter into implementation arrangements to execute this agreement. كلا الجانبين الدخول فى تنفيذ ترتيبات لتنفيذ هذا الاتفاق.
Article Twenty Six المادة السادس والعشرون
Targeted times to handover complete security responsibilities to the Iraqi security forces, and withdrawal of US forces from Iraq مرات المستهدفة لاتمام تسليم المسئوليات الامنية الى قوات الامن العراقية ، وانسحاب القوات الامريكية من العراق
Iraqi Suggestion: the Iraqi delegation has suggested the following title to this article: الاقتراح العراقي : ان الوفد العراقي قد اقترح العنوان التالي لهذه المادة :
Transferring security responsibilities to Iraqi authorities, and the withdrawal of the US forces from Iraq نقل المسئوليات الامنية الى السلطات العراقية ، وانسحاب القوات الامريكية من العراق
US Suggestion: the US delegation has suggested combining paragraphs 1 and 2 as follows: اقتراح امريكى : الوفد الامريكى قد اقترح الجمع بين الفقرتين 1 و 2 على النحو التالي :
1- Both sides have agreed on the following time targets to handover complete security responsibilities to the Iraqi security forces and the withdrawal of the US forces from Iraq: 1 -- اتفق الجانبان على ما يلي اهداف الوقت لاتمام تسليم المسئوليات الامنية الى قوات الامن العراقية وسحب القوات الامريكية من العراق :
A- US combat troops will withdraw from Iraq completely at the latest on (…) أ - القوات القتاليه الامريكية سوف تنسحب من العراق في موعد لا يتجاوز تماما على (…)
B- US forces will withdraw from all cities, towns, and villages at latest by June 30, 2009 unless the Iraqi authorities request otherwise.
Note: the head of the US delegation offered to accept the new title only if their combined paragraph is accepted, and he linked the two as one deal
3- All US combat troops regroup in installations and areas agreed upon after the date mentioned in paragraph 2 of this article.
4- After the withdrawal of all combat troops as mentioned in paragraph 1 of this article, the rest of these forces will stay based on a request from the Iraqi government in accordance to this agreement. The joint committee for operations and coordination will determine the tasks and level of the troops that will focus on training and supporting Iraqi security forces.
5- Both sides review the progress towards achieving dates mentioned in this article and the conditions that might lead to one side asking the other to extend or reduce the time periods mentioned in paragraph 1 and paragraph 2 of this article. Any extension or reduction of the time period is subject to both side’s approval.
6- US forces may withdraw from Iraq before the dates indicated in this article if either of the two sides should so request. Both sides recognize the Iraqi government’s sovereign right to request a withdrawal of US forces at anytime.
Article Twenty Seven
Contract Validity
1- This agreement is valid for (…) years unless it is terminated earlier based on a request from either sides or extended with the approval of both sides.
2- This agreement can be modified with the written approval of both sides and in accordance to constitutional procedures in both countries.
3- Cancellation of this agreement requires a written notice provided on year in advance.
4- This agreement goes into effect on the day that diplomatic memos confirming all constitutional procedures have been met in both countries are exchanged.
5- These memos will be exchanged before the expiration of UN resolution number 1790 at latest by December 31st, 2008.
