FDA Caving to Corps الهيءه رضوخ لفيلق
The Food and Drug Administration is developing a proposal for how drug companies can inform doctors about drug uses that aren’t FDA approved, a contentious but important area of promotion for the industry. ادارة الاغذيه والعقاقير هو إعداد مقترح لمكافحة المخدرات كيف يمكن للشركات ابلاغ الاطباء عن استخدام المخدرات التي ليست الهيءه وافقت ، للجدل ولكنها مهمة لتعزيز مجال الصناعة.
While it is legal for physicians to prescribe drugs or use medical devices in ways not specifically approved by the FDA, companies that make the products aren’t allowed to market such practices. ولئن كان القانونية للاطباء ان يصف الادوية او الاجهزه الطبية في استخدام طرق ليست على وجه التحديد وافقت عليها الهيءه ، والشركات التي تقدم منتجات لا يسمح للسوق مثل هذه الممارسات. A number of drug makers have been prosecuted for allegedly pushing to increase “off-label” use. عدد من صانعي المخدرات وجرت محاكمة لما زعم عن دفع لزيادة "من العلامه" استخدام.
According to a draft of the proposal, the FDA is considering guidelines that would say manufacturers may give doctors articles from medical journals and materials drawn from scientific reference texts that discuss off-label uses of drugs and medical devices. ووفقا لمشروع من هذا الاقتراح ، فإن الهيءه تنظر في المبادئ التوجيهيه التي من شأنها ان اقول قد يعطى الاطباء ومصنعي المواد من المجلات الطبية والمواد المستمده من النصوص المرجعيه العلميه التي تناقش من علامة استخدامات الادوية والاجهزه الطبية. The draft was released Friday by Rep. Henry Waxman (D., Calif.), who criticized it, saying it “would carve a large loophole in the law.” Supporters of allowing distribution of such materials say companies should be allowed to provide doctors with accurate and unbiased information. مشروع تم الافراج الجمعة عن طريق هنري Rep waxman (D. ، Calif) ، من انتقده ، وقال انه "من شأنه ان نحت كبير ثغرة في القانون." انصار السماح للتوزيع هذه المواد يقول ينبغي ان يسمح للشركات لتوفير الاطباء مع معلومات دقيقة وغير منحازه.
Separately, the FDA Friday released a harsh report from a group of its own advisers that warned the agency isn’t equipped to deal with emerging scientific developments. على حدة ، وهيئة التنمية الحرجيه الجمعة الافراج قاسيه تقرير من مجموعة من المستشارين الخاصة بها التي حذرت الوكالة ليست مجهزه للتعامل مع التطورات العلميه المستجدة. The report said that “science at the FDA is in a precarious position: the agency suffers from serious scientific deficiencies and is not positioned to meet current or emerging regulatory responsibilities.” وقال التقرير ان "العلوم في الهيءه في وضع غير مستقر هو الموقف : الوكالة تعاني من اوجه قصور خطيرة والعلميه ليست في وضع يمكنها من تلبية الاحتياجات الحالية او الناشءه المسؤوليات الرقابيه".
The report, from a subcommittee of the FDA’s outside Science Board that included members and advisers from industry as well as academe, echoed past critiques that have said the agency needs substantial new resources. تقرير من لجنة فرعية تابعة للهيئة من خارج العلم ان المجلس ضم اعضاء من المستشارين والصناعة فضلا عن الاوساط الاكاديميه ، صدى الماضي الانتقادات التي وقالت الوكالة تحتاج موارد ضخمة جديدة. According to the draft, the agency would lay out details on what types of publications are appropriate, as well as certain other requirements, such as that the materials come with a copy of the drug or device’s FDA-approved label. ووفقا للمشروع ، من شأنه ان الوكالة تضع على تفاصيل ما هي انواع المنشورات المناسبه ، فضلا عن بعض الشروط الأخرى ، مثل المواد التي تأتي مع نسخة من المخدرات او جهاز لل- وافقت هيئة التنمية الحرجيه التسميه.
Mr. Waxman said the proposal would allow companies to promote off-label uses. وقال السيد waxman الاقتراح من شأنه اتاحة الفرصة للشركات لتعزيز العلامه من الاستخدامات. In a letter to the company, he wrote that articles in medical journals may provide “a distorted picture of a drug’s safety or effectiveness,” because journal editors may not know the full story behind a study — such as whether its design was changed, or if negative results were left out of an article. وفي رسالة موجهة الى الشركة ، انه كتب ان المقالات في المجلات الطبية يمكن ان توفر "صورة مشوهه للمخدرات سلامة او فعالية" ، لأن محرري المجلات قد لا نعرف القصة الكاملة وراء دراسة -- مثل ما اذا كان تم تغيير تصميم ، او اذا كانت النتائج سلبية تركت خارج اطار المادة.
On the other side, courts have pressured the FDA to avoid restricting companies’ free-speech rights. وعلى الجانب الآخر ، والمحاكم لضغوط هيئة التنمية الحرجيه لتجنب تقييد الشركات الحرة كلمة الانسان. “Off-label prescribing is very often the standard of care,” and companies should be able to give doctors “truthful, non-misleading information” about such uses, said Daniel Troy, a former FDA chief counsel who previously helped argue against the agency in a major suit over restrictions on off-label promotion. An FDA spokeswoman declined to comment on the proposal and said the agency would respond directly to Mr. Waxman. وصرحت الناطقه باسم وجود هيئة ورفض التعليق على الاقتراح وقالت الوكالة من شأنه أن يستجيب مباشرة للسيد waxman.
The FDA’s draft proposal seems to try to strike a middle ground, allowing companies to distribute information about off-label uses but setting limits on the practice. هيئة التنمية الحرجيه مشروع اقتراح يبدو محاولة لضرب ارضية مشتركة ، مما يتيح للشركات لتوزيع المعلومات عن علامة من الاستخدامات ولكن وضع حدود على هذه الممارسه. Among other restrictions, the draft suggests that letters to the editor of a medical journal wouldn’t quality and that the scientific articles would have to be peer-reviewed. ومن بين القيود الاخرى ، فان مشروع تشير الى ان الرسائل الموجهة الى المحررين من المجله الطبية لن الجوده والمواد العلميه التي سوف يتعين لاستعراض الاقران. In addition, if the conclusions in a particular article have been disputed, it would have to be distributed along with another article showing the opposing view. وبالاضافة الى ذلك ، اذا كانت الاستنتاجات التي وردت في مادة معينة قد المتنازع عليها ، فانه سيتعين عليها ان توزع جنبا الى جنب مع مادة اخرى تبين الرأي المعارض.
