Lawyers for Guantanamo Bay detainees told a federal appeals court Wednesday that the United States violated its own rules when it branded hundreds of prisoners as enemy combatants — basing their argument on statements by two US military officers. محامو غوانتانامو المحتجزين امام محكمة الاستئناف الاتحادية الاربعاء ان الولايات المتحدة تنتهك القواعد الخاصة بها عندما تحمل علامة مئات من السجناء كما المقاتلين الاعداء -- بني على حجة على البيانات التى ادلى بها اثنان من الضباط العسكريين من دولارات الولايات المتحدة.
The lawyers asked the US Court of Appeals for the District of Columbia Circuit to order the immediate release of Mohammed Sulaymon Barre, a Somali among some 360 prisoners at Guantanamo Bay. وطلب المحامون من دولارات الولايات المتحدة لمحكمة الاستئناف لمقاطعة كولومبيا الى الدائرة من اجل الافراج الفوري عن محمد sulaymon بري ، 360 الصوماليه بين بعض السجناء في خليج غوانتانامو. Barre was arrested in Pakistan in November 2001 after he had obtained refugee status from a UN agency. بري اعتقل في باكستان في تشرين الثاني / نوفمبر 2001 بعد ان كان قد حصل على وضع اللاجئ من احدى وكالات الامم المتحدة.
Shane Kadidal, a New York lawyer, said petitions will be filed for other Guantanamo detainees, alleging the military violated its own rules in the Combatant Status Review Tribunals — the military panels that determine whether someone was an enemy combatant who should be held. Shane kadidal ، محام في نيويورك ، قال والالتماسات وسيتم رفعها لغيرها من معتقلى جوانتانامو ، زاعما العسكري انتهاك للقواعد الخاصة به في المحاكم المقاتل استعراض -- الافرقه العسكرية التي تحدد ما اذا كان شخص ما كان من مقاتل عدو ينبغي ان تعقد.
Barre’s attorneys say a Navy rear admiral who used to be in charge of the tribunal system noted in an affidavit that the military, at least in some cases, did not present all exculpatory evidence. بري وكلاء اقول البحرية الادميرال من استخدامها ليكون مسؤولا عن نظام المحكمه لاحظت في وثيقة اثبات ان العمليات العسكرية ، على الأقل في بعض الحالات ، لم يقدم ادلة براءه جميع.
In his May 31 statement, Navy Rear Adm. James M. McGarrah acknowledged that “if certain information which suggested that the detainee should not be designated as an enemy combatant was duplicative” then that “duplicative information” might not have been presented to the tribunals at Guantanamo. في تقريره في 31 ايار / مايو بيان البحرية العمق adm. جيمس م. Mcgarrah اقر بان "اذا كانت بعض المعلومات التي اشارت الى ان المعتقل لا ينبغي ان تسمى مقاتل عدو هو ازدواجيه" ثم ان "ازدواجيه المعلومات" الذي قد لا يكون قدمت الى المحاكم في غوانتانامو.

Evidence indicating a detainee was not an enemy combatant may also have been excluded “if it did not relate to a specific allegation being made against the detainee,” McGarrah said. دليل يشير الى معتقل لم يكن المحارب العدو قد استبعدت ايضا "اذا لم تتصل محددة يجري الادعاء ضد المحتجز ،" قال mcgarrah.
Combatant Status Review Tribunals have been held for about 570 detainees at Guantanamo Bay, a US Naval base in southeast Cuba. المقاتل استعراض المحاكم وقد اجريت لنحو 570 محتجزا في خليج غوانتانامو ، وقاعدة للقوات البحرية الامريكية فى جنوب شرق كوبا. Rules issued by Deputy Secretary of Defense Gordon England in July 2006 stipulate that any “evidence to suggest that the detainee should not be designated as an enemy combatant” must be presented to the tribunal. القواعد الصادرة عن نائب وزير الدفاع غوردون انكلترا في تموز / يوليو 2006 تنص على ان اي "الادله التي تشير الى ان المعتقل لا ينبغي ان يكون المعين بوصفه مقاتل عدو" ويجب ان يقدم الى المحكمه.
A Pentagon spokesman defended the process Wednesday, referring a reporter to a statement by Justice Department lawyers that said “it is manifestly reasonable not to fill the administrative record with duplicative material.” واعلن المتحدث باسم البنتاغون أ دافعت عن عملية الاربعاء ، واشار مراسل لبيان من وزارة العدل والمحامين وقال ان "من الواضح انه ليس من المعقول الاداريه لملء المحضر مع المواد مزدوجة".
Furthermore, presenting exculpatory evidence unrelated to a specific allegation against the detainee “would be useless at best and confusing at worst,” the Justice Department lawyers argued. وعلاوة على ذلك ، تقديم أدلة البراءه لا علاقة محددة الادعاء ضد المحتجز "ستكون عديمة الفاءده في احسن الاحوال ومربكه ، في اسوأ الحالات ،" وزارة العدل والمحامين القول.

The petition also cited a statement by Army Reserve Lt. Col. Stephen Abraham, a 26-year veteran of military intelligence who served as a main liaison between the Combat Status Review Tribunals and intelligence agencies. كما اشار الالتماس الى بيان من احتياطي الجيش اللفتنانت كولونيل ستيفن العقيد ابراهيم ، 26 عاما من المحاربين القدامى من المخابرات العسكرية الرئيسية بمثابة همزه وصل بين مركز مكافحة مراجعة المحاكم ووكالات الاستخبارات. Abraham’s affidavit, submitted to the US Supreme Court in June, said Combatant Status Review Tribunal members relied on vague and incomplete intelligence while being pressured to rule against detainees. ابراهيم 'sالشهاده ، الذي قدم الى المحكمه العليا في الولايات المتحدة في حزيران / يونية ، وقال المقاتل اعضاء محكمة اعادة النظر في الاعتماد على الاستخبارات غامضة وغير كاملة في حين يتعرض لضغط لقاعدة ضد المعتقلين.
The petition said that among the exculpatory evidence that the military failed to present was that he was recognized by the United Nations as a refugee from war-torn Somalia. وقالت العريضه ان من بين أدلة البراءه ان العسكريين لم يقدم هو أنه معترف به من قبل الأمم المتحدة بصفة لاجئ من الصومال التى مزقتها الحرب.
He is accused of having links to al-Wafa, a charity the US State Department classifies as a terrorist organization. وهو متهم باقامه صلات ل »وفا ، خيريه في وزارة الخارجية الامريكية يصنف بأنه منظمة ارهابية. Barre has consistently denied having any ties to al-Wafa. وقد دأبت بري ونفى اي روابط ل »وفا.
Meanwhile, the Miami-based Democracy Movement said 22 Cuban men were entering the third day of a hunger strike at the Migrant Operation Center at Guantanamo Bay. وفي الوقت نفسه ، من ميامي مقرا لها 22 وقالت الحركة الديمقراطيه الكوبية دخول الرجال في اليوم الثالث من الاضراب عن الطعام في مركز تشغيل المهاجرين في خليج غوانتانامو. The protesters are among 44 Cubans who were captured at sea but could not be returned to Cuba because US authorities determined they had a credible fear of persecution. ومن بين المحتجين من الكوبيين 44 اسروا في البحر ولكن لا يمكن ان عاد الى كوبا ، لأن السلطات الامريكية انها مصممة موثوق به خوفا من الاضطهاد. They have been detained at Guantanamo while the US seeks to settle them in a third country. انهم احتجزوا في غوانتانامو في حين ان الولايات المتحدة الامريكية تسعى الى توطينهم في بلد ثالث.
