Anti-War T-Shirter Sued for $40B

bushlied.jpgAP – PHOENIX |  A Tennessee couple who lost their son in Iraq want an Arizona merchant to pay more than $40 billion in damages to survivors of soldiers whose names are on the anti-war shirts he is selling online.

A complaint seeking class-action status for the lawsuit by Robin and Michael Read says Dan Frazier of Flagstaff has no right to profit from commercial sale of products that use the dead soldiers’ names without permission.

The change, requested Tuesday in federal court in Tennessee, would cover the heirs of all U.S. service members killed in the Middle East since Sept. 11, 2001, and seek $4 billion in compensatory damages and $36.5 billion of punitive damages.

The Reads’ original lawsuit named only themselves as plaintiffs and sought $10 million in compensatory and punitive damages.

Frazier’s “Bush lied — They died” T-shirts, sold at his site CarryaBigSticker.com, list Iraq war casualties’ names, and Frazier contends he is covered by First Amendment free-speech protections.

“We think it will be clear that this is political expression and not done for profit,” said Lee Phillips, Frazier’s attorney.

The Reads’ amended complaint says Frazier has no right to make a profit from the commercial sale of products using the casualties’ names without permission.

Frazier will ask that the lawsuit be transferred to the federal court in Arizona, which has already begun considering his challenge to an Arizona law barring use of slain service members’ names for commercial purposes without permission, Phillips said.

A federal judge in Arizona said in a preliminary ruling that a portion of that state’s law making violations a misdemeanor crime violates the First Amendment to the U.S. Constitution which guarantees freedom of speech and the press Arizona is among several states that have enacted similar laws.

The Reads’ attorney, Frank Santore, said in an e-mail that court rules barred him from comment.

    I am sure that the pain and suffering the families of the fallen have experienced is incalcuable. Though I do not feel responsible for what these families are going through, like most other Americans, I do wish I could help to ease their suffering. Unfortunately, neither I nor my company has anywhere near the $40 billion some families are apparently now seeking. But we can and will continue to sell our anti-war T-shirts that list the names of the fallen in an effort raise awareness of the enormous human toll that this war is taking on American families.

    The fact remains that the t-shirts we sell are political speech protected by the First Amendment.

    While my heart goes out to the families that have lost their children in the Afghan & Iraqi wars, they made their choice to support those war efforts. Those of us who KNEW 9/11 was an inside job from day one, and knew the Afghan & Iraqi wars were wars for oil and control of the world's resources, advised our children to not join the military. If the American people continue to watch our propaganda news medias, they will never learn of the evil that has invaded our country and are in high offices of our government, until it is too late. As it stands now, our Bill of Rights is being torn to shreds by this evil elitist group. If we don't stand together against this group…we become the new slavery. When Mr. Bush said we need to combat the Axis of Evil…he is right. We need to start with his family and their friends.

    My son's name is on that shirt. While I understand you comment of "freedom of speech". My son died helping you retain that right. He did not die for you to make money from is death! If you were doing this for honor in there memory is would be different. You do not have the right to put my son's name on a shirt without his permission. My son joined the Marine's for honor, something you have no concept of. God forbid you have to go through losing your only son as 22 yrs old, then and only then can you understand how I feel. You should have a least asked permission. I hope you feel better with ever dollar you make off my son's death. How do you sleep at night?

    Your son Died because he has killing people for no reason in a country that did NOTHING to us. He got what he had comimg ,a life is a life Iraq or American its murder and the crooks who sent your son to a WAR killed him to make a buc. we lost all our rights and freedoms at home , he should have defended our rights and freedoms instead he he was ready to go murder inocent people for oil.

    What about the billions that the people in office have made off of your son's death? Where is your class action lawsuit against them? Or better yet, you and yours are seeking to make money off of the $40 billion dollars in damages you claim. You have to be kidding. Where is your honor? Tell us that we have no honor because we stand against what happened to your son. In reality, doesn't it seem kind of backwards that we're the ones without honor in your mind, yet you don't have the honor to stand up and say that what happened to your son wasn't right? Don't tell me he died defending my right to free speech, because he didn't. He died inflating a blue tied snake's wallet.
